Where the beneficiary has not received de minimis aid over a period of three fiscal years and is not able to indicate in the application the specific amount of State aid applied for, may the maximum amount of the beneficiary’s claims that can be satisfied, which has been calculated, by the national authority responsible for managing the aid, on the basis of an order of the Minister for Agriculture of the Republic of Lithuania on aid intensity that was adopted after the application was submitted, automatically be regarded as exceeding the de minimis aid ceiling?

If the answer to the first question is in the affirmative, in a situation such as that in the present administrative case, is an interpretation according to which the national authority responsible for managing the aid, having assessed the applicant’s application and found that the amount of the applicant’s claims that can be satisfied exceeds the de minimis aid ceiling, would pay as State aid to the applicant, without a separate request from it, only that part of the aid which does not exceed that ceiling, contrary to the provisions of Article 3(3a) and (7) and Article 6(3) of Regulation No 1408/2013, as amended by Commission Regulation (EU) 2019/316 (1) of 21 February 2019?
