Are Article 3(3) of, and paragraph 1(b) and (c) of Annex I to, Directive 2009/73/EC (2) to be interpreted as meaning that a gas supplier is required to provide the final customer, prior to the entry into force of an annual index-based price adjustment, with a written notification of the new energy price following an index adjustment, where the new price consists of the factors

[a]	Energy consumption price; calculated according to the formula: CPnew  (3) = CPold  (4) × AGPI-12-Months-Ønew  (5) / AGPI-12-Months-Øold  (6)

[b]	Basic energy price; calculated according to the formula: BPnew  (7) = BPold  (8) × (CPInew  (9) / CPIold  (10)), (11) failing which, the supplier is not entitled to an increased energy consumption price?

(9)  First published Consumer Price Index (CPI) value in the quarter preceding the quarter in which the price adjustment takes place.

(10)  CPI value which was published 12 months before the CPInew value.
