Update of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (1)

The publication of the list of residence permits referred to in Article 2(16) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (2) is based on information communicated by the Member States to the Commission in conformity with Article 39 of the Schengen Borders Code.

In addition to publication in the Official Journal, a regular update is available on the website of the Directorate-General for Migration and Home Affairs.

LIST OF RESIDENCE PERMITS ISSUED BY MEMBER STATES

CZECH REPUBLIC

Replacement of the list published in OJ C, C/2025/2330, 25.4.2025 .

1) Uniform format (ID card)

Residence permits are issued in the form of an ID card made of a polycarbonate card with biometric features following to a uniform model. The validity period depends on the type of stay, in accordance with Act No. 326/1999 Coll., on the Residence of Foreign Nationals in the Territory of the Czech Republic and on Amendments to Certain Acts, as well as Act No. 325/1999 Coll., the Asylum Act, as amended.

A) Residence Permit/ Povolení k pobytu

This document can be obtained by third-country nationals with a long-term or permanent residence permit in the Czech Republic, family members of EU, Norwegian, Swiss, Icelandic, and Liechtenstein citizens who do not meet the conditions for issuing a ‘Permanent Residence Card’/ ‘Karty trvalého pobytu’ or ‘Residence Card’/ ‘Pobytové karty’ , and persons granted asylum or subsidiary protection.

Since 2 August 2021, the document has also been issued to UK citizens and their family members covered by the Withdrawal Agreement.

The ‘Remarks’/ ‘Poznámky’ section includes a two-digit code specifying the purpose of stay (see table below). For permits issued for reasons other than employment, the note ‘Free access to the labour market – YES/NO’ / ‘Volný přístup na trh práce – ANO/NE’ is added. The address of residence is provided only for authorisations of the type ‘PERMANENT STAY’ / ‘TRVALÝ POBYT’, ‘ASYLUM’ / ‘AZYL’ , and ‘SUBSIDIARY PROTECTION’ / ‘DOPLŇKOVÁ OCHRANA’.

(i)

Residence Permits issued from 4 July 2011 until 26 June 2020 in the form of ID cards in accordance with Council Regulation (EC) No 380/2008 of 18 April 2008 amending Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. These permits remain valid until June 2030.

Under the heading Type of permit, the relevant type of stay is specified: ‘Long-term residence’/, ‘Dlouhodobý pobyt’ , ‘Employee card’/‘Zaměstnanecká karta’ , ‘EU Blue Card’ / ‘ Modrá karta EU ’ (Council Directive 2009/50/EC), ‘ICT’ (Intra-Company Transfer Card under Directive 2014/66/EU), ‘MOBILE ICT’ (Intra-Company Transfer Card from another EU Member State under Directive 2014/66/EU), or ‘ Permanent’/‘Trvalý’.

(ii)

Residence Permits issued since 27 June 2020 in the form of ID cards in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals.

B) Residence Card/ Pobytová karta

Residence Card issued since 2 August 2021 in the form of an ID card in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. The back of the card is identical to the residence permit (see section A above for more details). Issued only to family members of EU citizens who are not themselves EU citizens.

C) Permanent Residence Card/ Karta trvalého pobytu

Permanent Residence Card issued since 2 August 2021 in the form of an ID card in accordance with Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals. The back of the card is identical to the residence permit (see section A above for more details). Issued only to family members of EU citizens who are not themselves EU citizens.

2) All other documents issued to third-country nationals of equivalent value to a residence permit

A) Residence Card of a Family Member of a Citizen of the European Union/ Pobytová karta rodinného příslušníka občana Evropské unie

A dark blue document in the form of a booklet. Document issued from 1 January 2013 until 1 August 2021 to family members of EU citizens who have been granted temporary residence in the Czech Republic. The card was valid until 3 August 2023 , after which it was fully replaced by a document with biometric data (see section 1 – uniform format for more details).

B) Permanent Residence Card/ Průkaz o povolení k trvalému pobytu

(i)

Permanent Residence Card is a dark green document in the form of a booklet. Since 2 August 2021, this card has only been issued to citizens of the EU, Switzerland, Norway, Iceland, and Liechtenstein.

Previously, this permanent residence card was also issued to family members of EU, Swiss, Norwegian, Icelandic, and Liechtenstein citizens. However, since 2 August 2021, these family members receive documents with biometric data (see section 1 – uniform format for more details). This also applies to UK citizens and their family members who are covered by the Withdrawal Agreement. Documents issued before 2 August 2021 remain valid until their expiry date.

(ii)	Permanent Residence Card of a citizen of the European Union is a red document in the form of a booklet. This type of document was issued to EU citizens until August 2017. It can remain in circulation until 2027.

C) Residence Permit Card for Foreigners/ Průkaz o povolení k pobytu pro cizince

A light green document in the form of a booklet with red print on the front. Until 14 August 2017, it was issued to citizens of Switzerland, Norway, Iceland, and Liechtenstein with permanent residence in the Czech Republic, as well as their family members with temporary residence permits. Since 15 August 2017, it has been intended only for family members of citizens of these states for temporary residence. The document expired on 3 August 2023 , after which it was fully replaced by documents containing biometric data (see section 1 above – uniform format).

D) Identity Card/ Identifikační průkaz

Since 15 August 2017, an identity card has been issued with black color inscription on the front side ‘Identity Card and long-term residence permit’ /‘Identifikační průkaz a povolení k pobytu’.

This document is in the form of a paper card sealed in foil, with dimensions of 105 × 74 mm. On the front side, there is a photograph of the holder along with details such as name, nationality, date of birth, gender, function, address, and the card’s validity date. On the back, it is stated that this identity card serves as an official document and proof of identity, as well as proof of long-term residence in the Czech Republic.

The identification card is issued by the Ministry of Foreign Affairs with the following designation:

E) Residence Documents Issued to Holders of Temporary Protection and Foreign Nationals Granted Long-Term Visas for a Stay Longer than 90 Days for the Purpose of Tolerated Stay Due to the Armed Conflict in Ukraine

Under Council Implementing Decision (EU) 2024/1836 of 25 June 2024 extending temporary protection as introduced by Implementing Decision (EU) 2022/382 of 4 March 2022 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC and having the effect of introducing temporary protection (OJ L 71, 4.3.2022, p. 1), and § 7b of Act No. 24/2025 Coll., amending Act No. 65/2022 Coll., on certain measures in connection with the armed conflict on the territory of Ukraine caused by the invasion of the armed forces of the Russian Federation, the following system of residence documents for displaced persons from Ukraine applies in the Czech Republic.

Residence documents for temporary protection in the Czech Republic consist either of a visa sticker for residence authorisation (affixed in the passport or on a state border crossing report) or a PDF confirmation of the extension of temporary protection. Combined with a travel document, these entitle displaced persons to cross the external border of the Schengen area without a visa. Temporary protection documents (visa sticker or PDF confirmation) constitute a residence permit in accordance with Article 2(16) of the Schengen Borders Code.

1. Visa Stickers for Residence Authorisation (Temporary Protection)

—

Holders of temporary protection who in 2025 received a long-term visa for the purpose of temporary protection have a visa sticker affixed in their passport or on a state border crossing report with validity until 31 March 2026. The validity of these visa stickers may exceed 365 days. These holders do not register for electronic extension and do not receive a PDF confirmation; the visa sticker is their sole and full-fledged residence and travel document within Schengen.

Holders of temporary protection who in 2024 had a visa valid until 31 March 2025 registered electronically for extension in 2025. If they do not yet have a new visa sticker valid until 31 March 2026 affixed, they possess a visa sticker valid until 31 March 2025 along with the PDF confirmation of electronic registration for extension of temporary protection. This confirmation is a valid residence document until 30 September 2025.

Holders of temporary protection who have already successfully completed the extension have a new visa sticker valid until 31 March 2026 affixed in their passport or on a state border crossing report. There is no need to prove the existence of a PDF confirmation; the visa sticker is a full-fledged document.

2. Confirmation of Electronic Registration for the Extension of Temporary Protection

Pursuant to § 7b of Act No. 24/2025 Coll., which amends Act No. 65/2022 Coll., it was possible to automatically extend the validity of authorisations for temporary protection without the need for a new application through electronic registration. A ‘Confirmation of Electronic Registration for the Extension of Temporary Protection’ issued by 15 March 2025 entitles the holder to reside in the territory of the Czech Republic and to move freely within the Schengen area until 30 September 2025. The validity of this confirmation can be verified by QR code or via the website of the Ministry of the Interior of the Czech Republic: https://ipc.gov.cz/docasna-ochrana/overeni-potvrzeni/.

POLAND

Replacement of the list published in OJ C 304, 9.8.2022, p. 5

List of documents caught by Article 2(16)(a) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code)

Residence documents issued in accordance with the uniform format set out in Council Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals.

—	Karta pobytu (Residence card)

Residence cards are issued to aliens who have obtained:

—	zezwolenie na pobyt czasowy (POBYT CZASOWY) - temporary residence permit;

—	zezwolenie na pobyt stały (POBYT STAŁY) - permanent residence permit;

—	zezwolenie na osiedlenie się (OSIEDLENIE SIĘ) – permit to settle, issued before 1 May 2014;

—	zezwolenie na pobyt rezydenta długoterminowego WE/UE (POBYT REZYDENTA DŁUGOTERMINOWEGO WE/UE) - a long-term EC resident's residence permit (issued after 1 October 2005). With effect from 12 June 2012 the term 'EC' was replaced by 'EU';

—	zgoda na pobyt ze względów humanitarnych (POBYT ZE WZGLĘDÓW HUMANITARNYCH)

—	consent for stay for humanitarian reasons;

—	status uchodźcy (STATUS UCHODŹCY) - refugee status;

—	ochrona uzupełniająca (OCHRONA UZUPEŁNIAJĄCA) - subsidiary protection;

—

Documents issued to the United Kingdom nationals and their family members - the beneficiaries of the Withdrawal Agreement in Poland, after the end of transition period:

—	Zaświadczenie o zarejestrowaniu pobytu (Certificate of registration of stay – for UK nationals possessing the right of residence)

—	Dokument potwierdzający prawo stałego pobytu (Document certifying permanent residence – for UK nationals possessing the right of permanent residence),

—	Karta pobytowa (Residence card - for non UK family member possessing the right of residence),

—	Karta stałego pobytu (Permanent residence card - for non UK family member possessing the right of permanent residence).

All the above mentioned documents will bear: ‘Article 50 TUE’ in the field: ‘type of permit’ and ‘Article 18 ust. 4 Umowy Wystąpienia’ in the field: ‘remarks’.

Residence cards issued in accordance with Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC.

—	Karta pobytu członka rodziny obywatela Unii Europejskiej (Residence card for an EU citizen family member);

—	Karta stałego pobytu członka rodziny obywatela Unii Europejskiej (Permanent residence card for an EU citizen family member).

Documents issued to the United Kingdom nationals and their family members before the end of transition period referred to in the Withdrawal Agreement under the Directive 2004/38/EC which may be used by them after the end of transition period (the documents will remain valid no later than until 31 December 2021):

—	Dokument potwierdzający prawo stałego pobytu (Document certifying permanent residence right),

—	Karta pobytu członka rodziny obywatela UE (Residence card of an EU citizen family member),

—	Karta stałego pobytu członka rodziny obywatela UE (Permanent residence card of an EU citizen family member).

Diia.pl (or Diia.pl service) – a digital identity document issued to beneficiaries of temporary protection under the Act of 12 March 2022 on assistance to citizens of Ukraine in connection with the armed conflict in the territory of Ukraine (Journal of Laws of 2022, item 583) in connection with Council Implementing Decision (EU) 2022/382 of 4 March 2022 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC, and having the effect of introducing temporary protection (OJL 71, 4.3.2022, p. 1).

Diia.pl is a service provided by the Minister, responsible for computerisation, as referred to in Article 19e.2(2) of the Computerisation Act in connection with Article 10.1 of the Act on assistance to citizens of Ukraine, available in the Application on the User's mobile device, which allows personal data of a User who is a citizen of Ukraine or a spouse of a Ukrainian citizen not having a Ukrainian citizenship as long as he/she is not a citizen of Poland or other EU Member State and arrived in the Republic of Poland from Ukraine in the period beginning on 24 February 2022 to be downloaded from the Register, as well as to be stored in an encrypted form on the User's mobile device, and be presented to other persons in order to confirm the User's identity.

Diia.pl may be used by Ukrainian temporary protection beneficiaries refugees who stay legally in the territory of Poland based on art. 2.1 of Act on assistance to citizens of Ukraine and who received a National Identification Number (PESEL).

Based on art. 2.1 of the Act on assistance to citizens of Ukraine ‘If a Ukrainian citizen in the meaning of art. 1.1, arrived legally to the territory of the Republic of Poland in the period after 24 February 2022 until the day indicated in provisions adopted based on Article 2.4 (the date has not been determined yet) and declares the intention to stay on the territory of the Republic of Poland, his/her stay is considered legal within the period of 18 months from 24 February 2022 (…) Stay of a child born on the territory of the Republic of Poland by a mother who is a person mentioned in the first sentence is also considered legal in the same period as the stay of the mother’.

Diia.pl is issued based on

—	Article 10 of the Act on assistance to citizens of Ukraine. Diia.pl serves as a confirmation of the User's identity and is an evidence equivalent to a document in line with

—

Article 8.1 of the Council Directive 2001/55/EC of 20 July 2001 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof

and should be considered a residence permit within the meaning of

—	Article 2(g) of the Council Directive 2001/55/EC. The Diia.pl document can be used by any person who is of legal age.

Zaświadczenie o korzystaniu z ochrony czasowej (Enjoyment of Temporary Protection Certificate) issued to foreigner enjoying temporary protection pursuant to Article 106 of Act of 13 June 2003 on granting protection to foreigners within the territory of the Republic of Poland (Journal of Law, 2021, item 1108 , as amended) in connection with Council Implementing Decision (EU) 2022/382 of 4 March 2022 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC, and having the effect of introducing temporary protection (OJL 71, 4.3.2022, p. 1). Where period of temporary protection is extended by European Union law, the validity of the certificate is to be extended accordingly.

In line with Article 8.1 of the Council Directive 2001/55/EC of 20 July 2001 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof the Certificate should be considered a residence permit within the meaning of Article 2(g) of the Council Directive 2001/55/EC.
