COMMISSION OPINION

of 16 June 2023

relating to the modified plan for the disposal of radioactive waste arising from the dismantling of the Brennilis (B-NPS) nuclear power station in the Finistère Department, France(Only the French text is authentic)

The assessment below is carried out under the provisions of the Euratom Treaty, without prejudice to any additional assessments to be carried out under the Treaty on the Functioning of the European Union and the obligations stemming from it and from secondary legislation (1).

On 22 June 2022, the European Commission received from the Government of France, in accordance with Article 37 of the Euratom Treaty, the General Data relating to the modified plan for the disposal of radioactive waste (2) arising from the dismantling of the Brennilis nuclear power station.

On the basis of these data and additional information requested by the Commission on 19 October 2022 and provided by the French authorities on 9 February 2023, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance from the site to the nearest border of another Member State, in this case Ireland, is 468 km.

2.

The modified plan involves an increase of the authorised discharge limits for airborne radioactive effluents. No liquid radioactive effluents are authorised.

3.

During normal dismantling operations, the discharge of gaseous radioactive effluents is not liable to cause an exposure of the population in another Member State that would be significant from the point of view of health, in respect of the dose limits laid down in the Basic Safety Standards Directive (3).

4.

In the event of unplanned releases of radioactive effluents that may follow an accident of the type and magnitude considered in the modified plan, these releases are not liable to result in a radioactive contamination of the water, soil or airspace of another Member State which is significant from the point of view of health, in compliance with the provisions of the Basic Safety Standards Directive.

In conclusion, the Commission is of the opinion that the implementation of the modified plan for the disposal of radioactive waste in whatever form, arising from the dismantling of the Brennilis (B-NPS) nuclear power station, located in the Finistère Department, France, both in normal operation and in the event of the accidents of the type and magnitude considered in the General Data, is not liable to result in a radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State, in respect of the provisions laid down in the Basic Safety Standards Directive.

Non-opposition to a notified concentration

(Case M.11088 – LIBERTY GLOBAL / NRJ GROUP / MEDIAHUIS / VLAANDEREN EEN)

On 13 June 2023, the Commission decided not to oppose the above notified concentration and to declare it compatible with the internal market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004 (1). THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 314 thereof, in conjunction with the Treaty establishing the European Atomic Energy Community, and in particular Article 106a thereof,

Having regard to Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union, amending Regulations (EU) No 1296/2013, (EU) No 1301/2013, (EU) No 1303/2013, (EU) No 1304/2013, (EU) No 1309/2013, (EU) No 1316/2013, (EU) No 223/2014, (EU) No 283/2014, and Decision No 541/2014/EU and repealing Regulation (EU, Euratom) No 966/2012 (1), and in particular Article 44 thereof,

Prior notification of a concentration

On 14 June 2023, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

Samvardhana Motherson Automotive Systems Group B.V. (‘SMRP,’ Netherlands), wholly owned by the Samvardhana Motherson International Limited (‘SAMIL,’ India),

SAS Autosystemtechnik GmbH (‘SAS,’ Germany), a wholly-owned indirect subsidiary of the Faurecia SE (‘Faurecia,’ France).

SMRP will acquire within the meaning of Article 3(1)(b) of the Merger Regulation sole control of the whole of SAS.

The concentration is accomplished by way of purchase of shares.

2.   

The business activities of the undertakings concerned are the following:

SMRP is a global supplier of automotive components, namely of instrument panels, door panels, centre consoles and decorative trims, and the assembly of cockpit modules,

SAS is specialised in the assembly of cockpit modules, centre consoles and other interior modules for passenger cars and light commercial vehicles.

3.   

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

4.   

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. The following reference should always be specified:

This notification concerns the following undertakings:

Hedin Automotive Oy (‘Hedin’, Finland), belonging to Hedin Mobility Group AB (Sweden),

Delta Auto Oy (‘Delta Auto’, Finland).

Hedin will acquire within the meaning of Article 3(1)(b) of the Merger Regulation sole control of Delta Auto.

The concentration is accomplished by way of purchase of shares.

2.   

The business activities of the undertakings concerned are the following:

Hedin is active in the retail sale of new and used passenger cars and light commercial vehicles, the provision of repair and maintenance services and the retail sale of original equipment spare parts in Finland,

Delta Auto is active in the retail sale of new and used passenger cars and light commercial vehicles, the provision of repair and maintenance services and the retail sale of original equipment spare parts in Finland.

3.   

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

On 9 June 2023, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

Emil Frey France (‘Emil Frey’, Switzerland), belonging to the Emil Frey Group,

Sacapuce (France),

Jam Prod (France), and

Groupe Kertrucks Finance (‘GKF’, France).

Emil Frey, Sacapuce and Jam Prod will acquire within the meaning of Article 3(1)(b) of the Merger Regulation joint control of GKF.

The concentration is accomplished by way of purchase of shares.

2.   

The business activities of the undertakings concerned are:

Emil Frey is active in France in the retail sale of new and second-hand motor vehicles,

Sacapuce is a financial holding company,

Jam Prod is a financial holding company,

GKF is the management holding company of Groupe Kertrucks. Groupe Kertrucks is active in the sale and leasing of industrial vehicles, and the provision of associated services.

3.   

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2), it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.   

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
