Communication of the European Parliament concerning the European Citizen’s Prize
CIVI EUROPAEO PRAEMIUM
(2022/C 283/01)
The Chancellery of the European Citizen’s Prize held its annual meeting on 22 June 2022 with Mrs Dita Charanzová, Vice-President of the European Parliament and Chancellor of the European Citizen’s Prize in the chair.
At that meeting the following list of prize winners for 2022 was drawn up.
The prizes will be awarded at public award ceremonies in the Member States where laureates are based. The ceremonies are organized by the Liaison Offices of the European Parliament. The laureates will also attend a central award ceremony at the European Parliament in Brussels in November 2022.

Implementation of a transaction in contravention of a condition attached to a clearance decision

The Advisory Committee (14 Member States) agrees with the Commission that by failing to close the sale of the Divestment Business by the end of the Closing Period, Novelis breached a condition attached to the Clearance Decision. |

The Advisory Committee (14 Member States) agrees with the Commission that Novelis implemented the Novelis/Aleris transaction in contravention of a condition attached to a decision under 8(2) of the Merger Regulation, which had found that, in the absence of the condition, the concentration would fulfil the criterion laid down in Article 2(3) of the Merger Regulation, by closing the acquisition of Aleris and failing to close the sale of the Divestment Business by the end of the Closing Period. |
Need for the Commission to adopt final measures

The Advisory Committee agrees (14 Member States) with the Commission that, as Novelis closed the sale of the Divestment Business to Liberty when the Commitments were no longer applicable and the Interim Measures adopted provisionally on the basis of Article 8(5) of the Merger Regulation will expire, there is a need for the Commission to adopt final measures on the basis of Article 8(4) of the Merger Regulation. |
Dissolution of the Transaction to restore the situation prevailing before the implementation of the concentration

The Advisory Committee agrees with the Commission that it is impossible to achieve the restoration of the situation prevailing before the implementation of the Novelis/Aleris transaction through a dissolution of the concentration, taking into account also that the sale of the Divestment to Liberty was closed with the express encouragement of the Commission. 13 Member States voted in favour, 1 Member State abstained. |
Other measures to restore the situation prevailing before the implementation of a concentration

The Advisory Committee (14 Member States) agrees with the Commission that there is a need to adopt Final Restorative Measures to ensure and maintain the structural effect of the sale of the Divestment Business, its viability and competitiveness, in order to restore the situation prevailing before the implementation of the Novelis/Aleris transaction as far as possible. |

The Advisory Committee (14 Member States) agrees with the Commission that the Final Restorative Measures are necessary, appropriate and proportionate to restore the situation prevailing prior to the implementation of the Transaction as far as possible. |
Penalty payments

The Advisory Committee (14 Member States) agrees with the Commission that, pursuant to Article 15(1)(d) of the Merger Regulation, if Novelis were to fail to comply with any of the measures set out in the Article 8(4) decision, the Commission is entitled to impose on Novelis a periodic penalty of up to […] % of its average daily aggregate turnover of the business year, preceding such failure to comply for each working day in which it is in breach until it complies. |

Final Report of the Hearing Officer (1)
Case M.9076 – Novelis/Aleris (Restorative Measures)

This report relates to a draft decision pursuant to Article 8(4) of Regulation No 139/2004 (2) (the ‘Draft Decision’) addressed to Novelis Inc. (‘Novelis’). In the Draft Decision, the Commission finds that Novelis implemented its acquisition of Aleris Corporation (‘Aleris’) in contravention of a condition attached to a decision under Article 8(2) of the Merger Regulation and that such implementation justifies the adoption of appropriate measures pursuant to Article 8(4)(b) of the Merger Regulation.
Background - Novelis’s acquisition of Aleris

On 1 October 2019, the Commission declared Novelis’s acquisition of Aleris compatible with the internal market and with the EEA Agreement (the ‘Clearance Decision’), subject to Novelis’s full compliance with the commitments as set out in the Clearance Decision (the ‘Commitments’) (3). |

Under the Commitments, Novelis committed to divest (i) Aleris’s aluminium automotive body sheets (‘Aluminium ABS’) business and (ii) other aluminium flat-rolled products business located in Aleris’s plant in Belgium, (the ‘Divestment Business’), and to find a purchaser and enter into a final binding sale and purchase agreement for the Divestment Business within six months from the Clearance Decision. Novelis also committed to close the sale of the Divestment Business within a period of […] months from the approval of the purchaser and the terms of sale by the Commission (the ‘Closing Period’). |

On 26 November 2019, Novelis proposed Liberty as a suitable purchaser for the Divestment Business. The Commission approved Liberty as a suitable purchaser for the Divestment Business on 7 April 2020. |

On 14 April 2020, Novelis implemented its acquisition of Aleris. |
Extension of the Closing Period

Novelis requested an extension of the Closing Period on 7 June 2020, […]. Novelis requested further extensions on 14 July 2020 and on 21 July 2020. In response to these successive requests, the Commission extended the Closing Period four times:

On 28 August 2020, Novelis requested another extension of the Closing Period (the ‘Fourth Extension Request’). |

On 31 August 2020, the monitoring trustee under the Commitments (the ‘Monitoring Trustee’) submitted a reasoned opinion on the Fourth Extension Request. |

At a state of play meeting held on 31 August 2020 following the submission of the Monitoring Trustee’s opinion, and later by a reasoned letter, the Commission informed Novelis that the Commission would not grant the Fourth Extension Request. The Commission explained that Novelis had failed to inform the Commission in a timely fashion of outstanding closing deliverables and did not provide certainty that the closing of the sale of the Divestment Business to Liberty would take place on 30 September 2020 (4). |
Decision imposing Provisional Interim Measures under Article 8(5)(b) of the Merger Regulation

By decision of 1 September 2020, the Commission found that, as Novelis had failed to close the sale of the Divestment Business within the Closing Period, it had implemented its acquisition of Aleris in contravention of a condition attached to the Clearance Decision. The Commission considered that there was an urgent need to restore or maintain conditions of effective competition in the EEA market for the supply of Aluminium ABS. Therefore, the Commission imposed provisional interim measures on Novelis pursuant to Articles 8(5)(b) and 18(2) of the Merger Regulation, which mostly reproduced Novelis’s obligations under the Commitments (the ‘Provisional Interim Measures Decision’). |

The Commission extended Novelis’s initial ten working day time-limit to submit its observations on the Provisional Interim Measures Decision multiple times on its own initiative as well as upon Novelis’s request. Novelis submitted its comments on the said decision on 16 October 2020. |

The measures ordered in the Provisional Interim Measures Decision will lapse with the adoption of the Draft Decision. |
Procedure under Article 8(4) of the Merger Regulation

On 18 September 2020, the Commission adopted a statement of objections (‘SO’) in which the Commission set out the preliminary view that, absent the closing of the sale of the Divestment Business to Liberty by the Closing Period, Novelis had implemented a concentration which gives rise to a significant impediment to effective competition in relation to the EEA market for the production and supply of Aluminium ABS, in contravention to a condition attached to the Clearance Decision. In the SO, the Commission also expressed its intention to order the dissolution of the concentration pursuant to Article 8(4)(b) of the Merger Regulation and other appropriate measures to restore the situation prevailing before its implementation as far as possible. If restoring the situation prevailing before the implementation of the concentration through its dissolution would not be possible, the Commission expressed its intention to order the sale of the Divestment Business by a divestiture trustee as well as certain measures preserving its value. |

On 30 September 2020, Novelis informed the Commission that the sale of the Divestment Business to Liberty had been closed on that day. |

On 23 November 2020, the Commission sent a letter to Novelis, in which it explained that, in light of the closing of the sale of the Divestment Business to Liberty and of the circumstances set forward by Novelis in its response to the SO, it no longer appeared possible to restore the situation prevailing prior to the concentration through its dissolution (the ‘Letter of 23 November’). The Commission stated its intention to order the measures that are still necessary to ensure and maintain the structural effect of the transfer of the Divestment Business and to protect its viability and competitiveness. The Letter of 23 November also informed Novelis of additional factual elements and pieces of evidence which had not been expressly mentioned in the SO and which, after analysing Novelis’s response to the SO, the Commission intended to refer to or rely on in its final decision. |

On 8 September 2020 and 21 September 2020, Novelis was granted access to the Commission’s file. On 5 October 2020, Novelis requested further access to documents, which was granted by the Directorate-General for Competition on the same day and on 8 October 2020. |

On 16 October 2020, Novelis submitted its reply to the SO. |
18. |
On 30 November 2020, Novelis again requested further access to certain items on the file. The Directorate-General for Competition subsequently provided Novelis with further access to the requested information on 2, 3, 4, 7, 8 and 9 December 2020. |

On 14 December 2020, Novelis submitted its reply to the Letter of 23 November and made another request for further access to the Commission’s file. On 18 December 2020, the Directorate-General for Competition granted access to the further documents requested and offered Novelis the possibility to submit further comments by 22 December 2020. Novelis made no further comments. |

I have not received any complaint or request from Novelis regarding access to the file. |

In the Draft Decision, the Commission imposes certain restorative measures on Novelis in order to restore the situation prevailing before the implementation of the concentration as far as possible, within the meaning of Article 8(4)(b) of the Merger Regulation. The Commission considers these measures necessary to ensure the effectiveness of the sale of the Divestment Business to Liberty and to preserve the viability and competitiveness of the Divestment Business. |
Conclusion

Overall, I consider that the effective exercise of procedural rights has been respected during the present proceedings. |

On 18 February 2021, the Commission adopted a Decision in a merger case under Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (1) , and in particular Article 8(4)(b) of that Regulation. 1. INTRODUCTIVE SUMMARY

The Decision adopts final measures pursuant to Article 8(4)b of the Merger Regulation to restore the situation prevailing before the implementation of the acquisition of Aleris Corporation (‘Aleris’) by Novelis Inc. (‘Novelis’) (the ‘Transaction’) as far as possible. |
(2) |
Novelis and former Aleris manufacture and supply various aluminium flat-rolled products (‘FRPs’) in the EEA, including aluminium automotive body sheets (‘Aluminium ABS’). Aluminium ABS are used in the automotive industry to manufacture vehicle bodies. |
(3) |
By decision dated 1 October 2019 (the ‘Clearance Decision’), adopted in application of Article 8(2) of the Merger Regulation, the Commission declared the Transaction compatible with the internal market and with the EEA Agreement, subject to full compliance with the commitments submitted by Novelis and annexed to the Clearance Decision (the ‘Commitments’). The Commitments included the divestment within a certain deadline of Aleris’ entire EEA ABS business, conducted from a plant in Duffel (Belgium). Although the Commission granted several extensions on the closing deadline set in the Commitments, Novelis failed to close the sale of Aleris’ plant in Duffel within the extended closing deadline, thus failing to implement the Commitments in a timely fashion. |

On 1 September 2020, the Commission adopted a decision ordering interim measures to restore or maintain conditions of effective competition pursuant to Article 8(5) of the Merger Regulation. |

With the decision of 18 February 2021, the Commission adopted final restorative measures pursuant to Article 8(4) of the Merger Regulation. These measures are necessary to protect the future viability and competitiveness of the Duffel plant, which Novelis eventually divested to Liberty, and to preserve the divestiture, similarly to the safeguards usually put in place when a divestiture takes places under a normal commitment process. |
2. PROCEDURE

In the Clearance Decision, the Commission found that following the Transaction Novelis would have had very high market shares and controlled a very significant proportion of the manufacturing capacity for aluminium automotive body sheets in the EEA. In addition, the limited number of smaller remaining competitors active in the market would not have been able to defeat a price increase, also due to their limited spare capacity. The Transaction was also found to reduce the incentives of the merged entity to invest in additional manufacturing capacity. The Commission therefore had concerns that the Transaction, absent the Commitments, would have resulted in higher prices for European customers for aluminium automotive body sheets. |

Under the Commitments, Novelis committed to divest or procure the divestiture of (i) Aleris’ Aluminium ABS business and (ii) other aluminium FRPs business located in Aleris’ plant in Duffel, Belgium, (the ‘Divestment Business’), and to find a purchaser and enter into a final binding sale and purchase agreement for the Divestment Business within a certain number of months from the date of adoption of the Clearance Decision (the ‘First Divestiture Period’). The First Divestiture Period was set to expire on a certain date. |

Under Section B of the Commitments, Novelis further committed to close the sale of the Divestment Business within the period of a certain number of months from (i) the approval of the purchaser and the terms of sale by the Commission or (ii) the date that all of the approvals, clearances or waiting periods applicable to the Transaction under the HSR Act and the Hart-Scott-Rodino Antitrust Improvements Act of 1976 of the United States and the antimonopoly law of China, have been obtained, expired or terminated; whichever is the later, but ending in all instances the latest a certain number of months from the approval of the purchaser and the terms of sale by the Commission (the ‘Closing Period’). |

On 22 November 2019, Novelis entered into a binding sale and purchase agreement (‘SPA’) for the sale of the Divestment Business to Liberty House Group (‘Liberty’). On 7 April 2020, the Commission approved Liberty as a suitable purchaser for the Divestment Business. On 14 April 2020, Novelis implemented its acquisition of Aleris. |

Following requests from Novelis due to difficulties in closing the sale of the Divestment Business, the Commission extended the Closing Period pursuant to paragraph 49 of the Commitments on 7 July 2020 (the ‘First Extension’), 14 July 2020 (the ‘Second Extension’), 22 July 2020 (the ‘Third Extension’) and 31 July 2020 (the ‘Fourth Extension’). Following the Fourth Extension, the Closing Period was set to expire on 31 August 2020. |

By letter of 28 August 2020, one working day before the expiry of the Closing Period as extended by the Fourth Extension, Novelis requested a further extension of the Closing Period until 30 September 2020 (the ‘Fourth Extension Request’). At a state of play meeting held on 31 August 2020 following the submission of the reasoned opinion of the Monitoring Trustee (the ‘Reasoned Opinion’), and later by a reasoned letter (the ‘Extension Rejection Letter’), Novelis was informed that the Commission would not grant the Fourth Extension Request. |

On 31 August 2020, the Closing Period as extended by the Fourth Extension expired. |
(13) |
On 1 September 2020, the Commission considered that, by implementing the acquisition of Aleris and not closing the sale of the divestment business within the Closing Period, Novelis had implemented the Transaction in contravention of a condition attached to the Clearance Decision. The Commission therefore imposed provisional interim measures on Novelis, which mostly reproduced Novelis’ obligations under the Commitments, pursuant to Articles 8(5)(b) and 18(2) of the Merger Regulation. |

By letters of 2 and 14 September 2020 to Novelis and Novelis’ counsel, respectively, the Commission confirmed to Novelis that any action that Novelis would take to mitigate the situation resulting from the failure to implement the sale of the Divestment Business to Liberty by the expiry of the Closing Period would be welcomed by the Commission and taken into consideration in determining the further steps it would need to take. |

On 18 September 2020, the Commission adopted a statement of objections (the ‘Statement of Objections’) pursuant to Article 8(4) of the Merger Regulation stating its intention to order either the dissolution of the Transaction or any other appropriate measures to restore the situation prevailing before its implementation as far as possible. |

On 30 September 2020, Novelis informed the Commission that the sale of the divestment business to Liberty had closed on that day. |
(17) |
On 16 October 2020, Novelis submitted its reply to the Statement of Objections (the ‘Reply to the Statement of Objections’). |

On 23 November 2020, the Commission sent a letter to Novelis, in which it explained that in light of the closing of the sale of the Divestment Business, which occurred with the express encouragement of the Commission, and of the circumstances set out by Novelis in the Reply to the Statement of Objections, it no longer appeared possible to restore the situation prevailing prior to the implementation of the Transaction through its dissolution (the ‘Letter of 23 November’). In the Letter of 23 November, the Commission also stated its intention to order only those measures that are still necessary to ensure and maintain the structural effect of the transfer of the Divestment Business and to protect its viability and competitiveness. |

On 14 December 2020, Novelis submitted its reply to the Letter of 23 November (the ‘Reply to the Letter of 23 November’). |

In light of the foregoing, the Commission has adopted the Decision pursuant to Article 8(4)(b) of the Merger Regulation. |

Prior to its adoption, the Member States were consulted on the draft Decision during the Advisory Committee on Concentrations meeting on 9 February, which provided a favourable opinion. The Hearing Officer provided its favourable opinion on the proceedings in his report, which was submitted on 27 January 2021. |
3. LEGAL FRAMEWORK

Where a concentration raises concerns as to its compatibility with the internal market, the notifying party(ies) can offer to modify the concentration to remedy those concerns. Pursuant to paragraph (19) of the Remedies Notice, whilst commitments have to be offered by the parties, the Commission will ensure the enforceability of commitments by making the authorisation of the merger subject to compliance with the commitments. |

A distinction must be made between conditions and obligations. The achievement of the structural change of the market is a condition — for example, that a business is to be divested. The implementing steps which are necessary to achieve this result are generally obligations on the parties, e.g. such as the appointment of a trustee with an irrevocable mandate to sell the business. Paragraph (20) of the Remedies Notice states that when a condition is breached, e.g. a business is not divested in the time-frame foreseen in the commitments or afterwards re-acquired, the compatibility decision is no longer applicable. |

In such circumstances, the Commission may, first, adopt interim measures appropriate to maintain or restore conditions of effective competition pursuant to Article 8(5)(b) of the Merger Regulation. Second, pursuant to Article 8(4)(b) of the Merger Regulation, the Commission may, where it has already found in a decision taken pursuant to Article 8(2) of the Merger Regulation that in the absence of the condition, the concentration would be incompatible with the internal market, order the dissolution of the concentration. Where the restoration of the situation prevailing before the implementation of the concentration is not possible through such a dissolution, pursuant to Article 8(4)(b) of the Merger Regulation, the Commission may take any other appropriate measure to achieve such restoration as far as possible. |
4. IMPLEMENTATION OF THE TRANSACTION IN CONTRAVENTION OF A CONDITION ATTACHED TO THE CLEARANCE DECISION

Under the Commitments, Novelis committed to close the sale of the Divestment Business within the Closing Period. On 14 April 2020, Novelis implemented its acquisition of Aleris. However, by the last day of the Closing Period as extended by the Fourth Extension, the sale of the Divestment Business to Liberty had not closed. |
(26) |
As a result, the Clearance Decision became inapplicable and Novelis had ipso facto implemented the Transaction but failing to fulfil a condition attached to the Clearance Decision pursuant to which, in the absence of the condition, the Transaction would significantly impede effective competition in the common market or in a substantial part of it. |
(27) |
Therefore, the conditions of Article 8(4)(b) of the Merger Regulation were met in the present case and the Commission was entitled to order measures in view of restoring the situation prevailing prior to the implementation of the Transaction as far as possible. None of the arguments put forward by Novelis in the Reply to the Statement of Objections or the Reply to the Letter of 23 November called into question that conclusion. |
5. NO DISSOLUTION OF THE TRANSACTION
(28) |
Under Article 8(4)(b) of the Merger Regulation, the Commission’s primary means to restore the situation prevailing prior to the implementation of a concentration is ordering the dissolution of said concentration. In circumstances where it is impossible to achieve such restoration through dissolution of the concentration, the Commission can order alternative restorative measures. |

Novelis closed the sale of the Divestment Business after the end of the Closing Period as extended by the Fourth Extension. The Commission expressly encouraged Novelis to proceed with the closing, even though the Closing Period had lapsed. |
(30) |
A different part of the former Aleris business was the object of a divestiture trustee-led selling process by orders of the US Department of Justice (‘DOJ’), after Novelis failed to sell the relevant business within the timeframe allotted by the DOJ in the context of the conditions to its clearance decision on the main transaction. |
(31) |
Under these circumstances, in line with Article 8(4)(b) of the Merger Regulation, the Commission does not order the dissolution of the Transaction and instead orders other measures to restore the situation prevailing before the implementation of the Transaction as far as possible as described in the following section. |
6. OTHER MEASURES ARE NECESSARY TO RESTORE THE SITUATION PREVAILING PRIOR TO IMPLEMENTATION OF THE CONCENTRATION SO FAR AS POSSIBLE

The Commission considers that in the specific circumstances of this case, Novelis must comply with a number of final restorative measures, which are necessary to ensure that the sale of the Divestment Business to Liberty remains effective and that the viability and competitiveness of the Divestment Business are preserved, in order to restore the situation prevailing before the implementation of the Transaction as far as possible, within the meaning of Article 8(4)(b) of the Merger Regulation (the ‘Final Restorative Measures’). |
(33) |
More specifically, the Commission has ordered a non-reacquisition measure, a non-solicitation measure, a measure on the provision of information to the Commission, a measure on transitional supply agreements, a measure on other ancillary agreements, measures on CAPEX funding for the benefit of the Divestment Business, and measures regarding the appointment of a divestiture trustee to oversee Novelis’ compliance with the Final Restorative Measures, under the supervision of the Commission. |
7. CONCLUSION
(34) |
For the reasons mentioned above, the decision concludes that the Transaction, a concentration which as notified gives rise to a significant impediment to effective competition within the meaning of Article 2(3) of the Merger Regulation and Article 57 of the EEA Agreement in relation to the EEA market for the production and supply of Aluminium ABS, has been implemented in contravention of a condition attached to the Clearance Decision. |
(35) |
Pursuant to Article 8(4)(b) of the Merger Regulation, the Commission has ordered the measures described above. |
(36) |
Pursuant to Article 15(1)(d) of the Merger Regulation, if Novelis were to fail to comply with any of the measures set out in this Decision, Novelis shall incur a periodic penalty of up to a specified percentage of Novelis’ average daily aggregate turnover of the business year preceding such failure to comply for each working day in which it is in breach until it complies. |

In the years immediately after it was founded, Asso-consum was mainly active in the parliamentary field: between 2002 and 2007, at least 600 parliamentary questions were prompted by its reports. As it gradually recruited more staff, it acquired the additional capacity to provide assistance, guidance and training for consumers (both members and non-members) and also free legal advice in the following areas: credit and savings, contracts, telecommunications, transport, class actions, health, tourism, the environment, food and privacy. Asso-Consum has recently been involved in initiatives of national significance: namely, the negotiations with Costa Crociere on compensation for the Concordia passengers, the presentation of the referendum on abolishing the reimbursement of political parties' election expenses and the class action against the Banca di Campania in respect of commission charged on highest debit balances. |

On 18 July 2022, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).This notification concerns the following undertakings:

TotalEnergies and GIP will acquire indirectly within the meaning of Articles 3(1)b and 3(4) of the Merger Regulation joint control of Clearway Energy Group and SunPower Group.
The concentration is accomplished by way of purchase of shares.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

1 Harvesting
Producers have to harvest the sap of the palm trees which are located in the defined geographical area.
2 Palm sap collection
The Palm sap collection and processing are conducted for a period from 1st December to 31st May of the subsequent year with a specific tool, a Bamboo or plastic container called ‘Bampong’.
After taking the Bampong from the palm trees, the producers cannot pour the sap into a plastic bottle or other containers prior to processing.
Before processing, producers shall filter the palm sap by using tight strainers with a mesh of no more than 15 microns.
3 Processing (cooking) of palm sap
The processing of palm sap takes place in pans on cook stoves, no additional substances are authorised into the pans. When the evaporation has reached its target point, the pan is taken out of the stove and the product starts to crystallize and to whiten the palm sugar. Some specific tools as Antoks and Khnos are used for the processing of palm sap (traditional tools made of wood or stainless steel).

5. Link with the geographical area
A causal link exists between both the reputation and quality of the product and its geographical origin.
History and reputation
Sugar Palm (borassus flabellifer; Doeum Thnot in Khmer) is present in many parts of Cambodia. Farmers plant Palm trees around houses and villages, along roads, on the rice bunds around the mounds. Agricultural bibliography in Cambodia cites the year 1901 as a starting point for the expansion of the culture of the Palm sugar, with a royal order directing each farmer to plant the Borassus on his rice field. In 2005, sugar palm was recognized as the emblem of Cambodia by a Royal Decree.
In 1967, Jean Delvert, a well-known French geographer, wrote that the region of Kampong Speu was the main area of cultivation of the palm sugar with 375 000 cultivated trees (Le Paysan Cambodgien, Jean Delvert, 1961). According to Jean Delvert, in the 1950s farmers in Kampong Speu and Kandal provinces were already reputed for their expertise and know how in Palm sugar harvest: ‘cultivationg and farming the “
The name of ‘Kampong Speu’ is related to sugar production and palm sugar is known as a traditional production of this area. Guide books refer to reputation of palm sugar production in Kampong Speu region notably the ‘Asia life guide’ (article of Anita Surewicz, 1 March 2008).

Studies and analysis have shown that palm saps coming from these three districts have a high sugar concentration. All the palm sugar operators (producers, processors and local traders) acknowledge that the localization of the trees on deep sandy soils is a key factor of the quality of the sugar. The results of the analysis of palm sap coming from different districts and provinces show that in the 3 districts of the delimited production area, the sugar concentration in the sap is the highest. The poverty of the sandy soils of the region would give a more aromatic and more concentrated sap into sugar (2 to 3° Brix more than in other areas) than that of the palm trees of other provinces where the soil is richer. |

Human factors/Specific Know-how
The practices of producers: their expertise is involved in the management of the harvesting of the sap and in the production of the palm sugar.
The harvesting of palm sugar is done by local skilled and agile sugar producers that climb to the top of the palm trees to collect the sap from the palm flowers. The palm sap is collected by using Bamboo container or Plastic container called ‘Bampong’. A small piece of Popel wood or Koki wood is placed in the Bampong to decrease the speed of fermentation of the palm sap. The processing of the palm sap requires the use of typical tools such as Antok and Khnos.
The aromatic quality of the sap depends on both the number of Bampongs placed at the level of the inflorescence and on the flow of the sap. The producer can put a maximum of 1 female flower or 4 male flowers of palm tree per 1 container.
Each container is collected from the palm tree within 15 hours after they were installed, and the processing of the sap harvested starts within 2 hours after the sap is collected.
Producers have a developed a specific knowledge to cook the sap in order to extract a high-quality sugar, depending on the final product they want to obtain.
