Commission notice on current State aid recovery interest rates and reference/discount rates applicable as from 1 September 2020
(Published in accordance with Article 10 of Commission Regulation (EC) No 794/2004 of 21 April 2004 (OJ L 140, 30.4.2004, p. 1))

Base rates calculated in accordance with the Communication from the Commission on the revision of the method for setting the reference and discount rates (OJ C 14, 19.1.2008, p. 6.). Depending on the use of the reference rate, the appropriate margins have still to be added as defined in this communication. For the discount rate this means that a margin of 100 basis points has to be added. The Commission Regulation (EC) No 271/2008 of 30 January 2008 amending Regulation (EC) No 794/2004 foresees that, unless otherwise provided for in a specific decision, the recovery rate will also be calculated by adding 100 basis points to the base rate.
Modified rates are indicated in bold.

Notice amending the deadline for the submission of bids for a concession for the prospection and exploration of oil and natural gas deposits and the extraction of oil and natural gas
On 13 March 2020, the Government of the Republic of Poland published a Communication concerning Directive 94/22/EC of the European Parliament and of the Council on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons – Public invitation to bid for a concession for the prospection and exploration of oil and natural gas deposits and the extraction of oil and natural gas in the ‘Żabowo’ area.
The Communication specifies the deadline for the submission of bids, namely no later than 12.00 noon (CET/CEST) on the last day of the 180-day period commencing on the day following the date of publication of the communication in the Official Journal of the European Union (i.e. by 9 September 2020).
Under the Regulation of the Minister for Health of 20 March 2020 declaring a state of epidemic in the Republic of Poland (Journal of Laws 2020, item 491, as amended), a state of epidemic was declared in the Republic of Poland in the period from 20 March 2020 until further notice in connection with infections with the SARS-CoV-2 virus.
Article 15zzr(1)(2) of the Act of 2 March 2020 on special arrangements for the prevention, combating and control of COVID-19, other communicable diseases and related emergency situations (Journal of Laws 2020, item 374, as amended) came into force on 31 March 2020. Under that provision, during an epidemic threat or a state of epidemic declared on account of COVID-19, the administrative time-limits laid down by administrative law for the performance by a party of acts forming its rights and obligations do not start to run or are suspended for that period.
On 16 May 2020, Article 68(2) of the Act of 14 May 2020 amending various acts concerning the safety net in relation to the spread of the SARS-CoV-2 virus (Journal of Laws 2020, item 875, as amended) came into force. Under that provision, the time-limits for the performance by a party of acts forming its rights and obligations which were suspended on the basis of Article 15zzr(1)(2) of the Act of 2 March 2020 on special arrangements for the prevention, combating and control of COVID-19, other communicable diseases and related emergency situations (Journal of Laws 2020, item 374, as amended) are to continue after seven days from the date of entry into force of the Act amending various acts concerning the safety net in relation to the spread of the SARS-CoV-2 virus (i.e. after 24 May 2020).
This being so, I hereby inform you that the deadline for the submission of bids for a concession for the prospection and exploration of oil and natural gas deposits and the extraction of oil and natural gas in the ‘Żabowo’ area has been extended until 12.00 noon (CET/CEST) on 2 November 2020.

for Cypress Creek Holdings: Cypress Creek Holdings is a utility-scale solar developer and long-term owner and operator of solar projects in the USA. |

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.Observations must reach the Commission not later than 10 days following the date of this publication. The following reference should always be specified:

On 1 September 2020, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).This notification concerns the following undertakings:

PPF Group N.V. (‘PPF’, the Netherlands), ultimately controlled by Mr Petr Kellner, |
|
— |
Central European Media Enterprises Ltd. (‘CME’, Bermuda), ultimately controlled by AT&T Inc. |
PPF acquires within the meaning of Article 3(1)(b) of the Merger Regulation sole control of the whole of CME.
The concentration is accomplished by way of purchase of shares.
