Non-opposition to a notified concentration

(Case M.9267 — KKR/Telepizza)

On 8 March 2019, the Commission decided not to oppose the above notified concentration and to declare it compatible with the internal market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004 (1). The full text of the decision is available only in English and will be made public after it is cleared of any business secrets it may contain. It will be available:

Communication from the EFTA Surveillance Authority under Article 21(7) of the Act referred to at point 1 of Annex VII to the EEA Agreement

Article 21(7) of the Act referred to at point 1 of Annex VII to the EEA Agreement (Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications), foresees that the EFTA States shall notify the EFTA Surveillance Authority (‘the Authority’) of the legislative, regulatory and administrative provisions they adopt with regard to the issuing of evidence of formal qualifications in the fields covered by Chapter III of the Act.

The Authority has the task to publish an appropriate communication indicating the titles adopted by Iceland, Liechtenstein and Norway for evidence of formal qualifications and, where appropriate, the body which issues the evidence of formal qualifications, the certificate which accompanies it and the corresponding professional title referred to in Annex V of the Act, points 5.1.1, 5.1.4, 5.2.2, 5.3.2, 5.3.3, 5.4.2, 5.5.2, 5.6.2 and 5.7.1 respectively.

Since Norway has notified changes regarding titles of training courses in specialised medicine, the Authority publishes the present communication in accordance with Article 21(7) of the Act.

Prior notification of a concentration

(Case M.9253 — Mercuria/Aegean)

Candidate case for simplified procedure

On 7 March 2019, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

Mercuria Energy Group Limited (‘Mercuria’, Cyprus), controlled by MDJ Oil Trading Limited,

Aegean Marine Petroleum Network Inc. (‘Aegean’, the Republic of the Marshall Islands).

Mercuria acquires within the meaning of Article 3(1)(b) of the Merger Regulation sole control of the whole of Aegean.

The concentration is accomplished by way of purchase of shares.

The business activities of the undertakings concerned are:

Mercuria is a global energy and commodities trading group, headquartered in Switzerland and the United Arab Emirates,

Aegean is an international marine fuel logistics company headquartered in Greece which markets and physically supplies bunker fuels to vessels in port, at sea, on rivers and other waterways around the globe.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. The following reference should always be specified:
