on a proposal for a regulation of the European Parliament and of the Council amending Regulation (EU) No 1092/2010 on European Union macro-prudential oversight of the financial system and establishing a European Systemic Risk Board

INTRODUCTION AND LEGAL BASIS

On 27 November 2017, the European Central Bank (ECB) received a request from the Council of the European Union for an opinion on a proposal for a regulation of the European Parliament and of the Council amending Regulation (EU) No 1092/2010 on European Union macro-prudential oversight of the financial system and establishing a European Systemic Risk Board (1) (hereinafter the ‘proposed regulation’).

The ECB’s competence to deliver an opinion is based on Articles 127(4) and 282(5) of the Treaty on the Functioning of the European Union since the proposed regulation contains provisions affecting the contribution of the European System of Central Banks (ESCB) to the smooth conduct of policies pursued by the competent authorities relating to the prudential supervision of credit institutions and the stability of the financial system, pursuant to Article 127(5) of the Treaty, and the specific tasks conferred upon the ECB concerning the prudential supervision of credit institutions and the functioning of the European Systemic Risk Board (ESRB), pursuant to Article 127(6) of the Treaty. In accordance with the first sentence of Article 17.5 of the Rules of Procedure of the European Central Bank, the Governing Council has adopted this opinion.

GENERAL OBSERVATIONS

The proposed regulation is part of a comprehensive package of proposals to strengthen the European System of Financial Supervision (ESFS), consisting of the three European supervisory authorities (ESAs) and the ESRB. The ECB is of the view that the ESRB has played a central and successful role since its inception with regard to preventing or mitigating systemic risks to financial stability in the Union that may arise within the financial system (2).

Therefore, the ECB supports the limited number of targeted changes to the ESRB’s governance and operational framework proposed by the European Commission, which aim to further strengthen the ESRB’s efficiency and effectiveness and enable the ESRB to better fulfil its mandate. More specifically, the ECB considers the proposed changes to Regulation (EU) No 1092/2010 of the European Parliament and of the Council (3) necessary to properly reflect the establishment of the Single Supervisory Mechanism (SSM) (4) and to ensure that the ESRB is able to perform macro-prudential oversight of the entire financial system given the increasing importance of market-based financing, in particular as a result of the establishment of the capital markets union. The ECB and the ESRB are of the view that the ECB is well placed to continue to provide analytical, statistical, financial and administrative support to the ESRB in line with the existing arrangements (5). Moreover, the ECB will also continue to support the ESRB to avoid duplicating work, thus taking advantage of the benefits arising from the ECB’s risk assessment role and analysis of the banking sector in the Member States participating in the SSM.

In addition, the ECB notes that Regulation (EU) No 1092/2010 requires the ESRB to provide the ESAs with the information necessary for the achievement of their tasks, but does not regulate the exchange of information between the ESRB and macro-prudential authorities in Member States that have been established after its adoption in 2010. Against this backdrop, the ECB would welcome a legislative proposal aiming to revise the current information sharing regime laid down in Regulation (EU) No 1092/2010. A revision of the current information sharing regime should allow the ESRB to provide national macro-prudential authorities with relevant supervisory data necessary for the fulfilment of their mandates under national law, provided that sufficient safeguards are established to ensure conformity with relevant Union law. Moreover, a corresponding clarification may be warranted to enable ESRB members from the ESCB and the supervisory authorities to use information received from the ESRB for the exercise of their statutory tasks.

SPECIFIC OBSERVATIONS

1.   The Chair of the ESRB

The proposed regulation provides for the ECB President to chair the ESRB, thereby creating a permanent link between the ECB President and the ESRB Chair (6). While the ESRB remains autonomous, it has also greatly benefited from the visibility, independence and reputation of the ECB (7). As previously noted (8), central banks play an important role in macro-prudential policy, given their responsibility for contributing to financial stability and their analytical expertise on the real economy, financial markets and market infrastructure. In this regard, the ECB provides analytical, statistical, administrative and logistical support to the ESRB. Furthermore, close cooperation at the technical level between the ECB and ESRB is ensured by cross-representation on the ESRB’s Advisory Technical Committee (ATC) and the ECB’s Financial Stability Committee. Against this background, the attribution of the ESRB Chair to the President of the ECB under Article 5(1) of Regulation (EU) No 1092/2010 underlines the importance of the central banks’ role in the functioning of the ESRB (9). Therefore, the ECB supports the Commission’s proposal to link the ESRB Chair and the ECB Presidency.

2.   ESRB organisation

2.1.   Appointment procedure for the Head of the ESRB Secretariat

The proposed regulation stipulates that, when consulted on the appointment of the Head of the ESRB Secretariat, following an open and transparent procedure, the General Board assesses the suitability of the candidates for the position of Head of the ESRB Secretariat and also informs the European Parliament and the Council about the consultation procedure (10). The ECB generally supports the proposal to raise the profile of the Head of the ESRB Secretariat, and would like to make a few specific comments regarding the ECB’s role in supporting the ESRB Secretariat and its current role in the appointment procedure for the Head of the ESRB Secretariat. The ESRB Secretariat is ensured by the ECB and, to this effect, the ECB should provide sufficient human and financial resources (11). The Head of the ESRB Secretariat is appointed by the ECB, with the General Board of the ESRB acting in a consultative capacity (12). Against this background, the ECB considers that this procedure, which tasks the General Board of the ESRB, when consulted on the appointment of the Head of the ESRB Secretariat, with assessing the suitability of the candidates, should be without prejudice to the ECB’s ultimate responsibility to appoint the Head of the ESRB Secretariat, whilst fully respecting the consultation procedure laid down in Article 3(2) of Council Regulation (EU) No 1096/2010 (13).

2.2.   The tasks of the Head of the ESRB Secretariat

The proposed regulation provides that the ESRB Chair and the Steering Committee may entrust the Head of the ESRB Secretariat with specific tasks. These include, inter alia, the day-to-day management of the ESRB Secretariat, the coordination and preparation of the work and the decision-making of the General Board, and the preparation of the annual ESRB programme proposal and its implementation (14). The ECB welcomes this clarification of the tasks that the Head of the ESRB Secretariat may exercise. From a practical perspective, the Head of the ESRB Secretariat already carries out the majority of the tasks listed in the proposed regulation. With respect to the preparation of the annual ESRB programme proposal, the ECB considers that the ESRB should remain able to respond flexibly to address potential vulnerabilities in the financial system, which may require a temporary and exceptional deviation from the annual work programme, depending on the specific circumstances of the situation.

2.3.   The external representation of the ESRB by the Head of the ESRB Secretariat

The proposed regulation includes the possibility for the Chair of the ESRB to delegate his or her tasks related to the external representation of the ESRB to the Head of the ESRB Secretariat (15). The ECB generally supports the Commission’s objective of raising the profile of the Head of the ESRB Secretariat by providing for the delegation of certain tasks. However, the ECB considers that the proposed regulation should clarify whether the Head of the ESRB Secretariat may also represent the ESRB in relation to tasks laid down in Article 19(1), (4) and (5) of Regulation (EU) No 1092/2010 regarding accountability and reporting obligations (16). Given the importance of ensuring the ESRB’s accountability, the ECB is of the view that the Chair of the ESRB should continue to represent the ESRB externally with respect to the tasks set out in Article 19(1), (4) and (5) of Regulation (EU) No 1092/2010 and may only delegate such external representation to the Vice-Chair of the ESRB.

2.4.   Changes related to the establishment of the SSM

In order to take into account the creation of the Banking Union in general, and the establishment of the SSM in particular, the proposed regulation includes the Chair of the Supervisory Board of the ECB among the members of the General Board with voting rights (17), in the Steering Committee (18), and his/her representative in the ATC (19). The establishment of the Banking Union and the related changes in the institutional framework for the prudential supervision of credit institutions following the establishment of the SSM are of relevance to the ESRB’s tasks and functions. Therefore, the ECB welcomes the changes proposed by the Commission, which are generally in line with previous recommendations made by the ECB on enhancing the ESRB’s governance (20). The ECB notes that the proposed regulation attributes voting rights to the Chair of the Supervisory Board on the ESRB General Board, and ensures that the Chair of the Supervisory Board is represented on the ESRB Steering Committee. In addressing these specific aspects, due consideration could be given to weighing up the European dimension of the SSM with the need to ensure an appropriate institutional balance between the voting and non-voting rights of the banking supervisory representatives of those Member States participating in Banking Union and of the non-participating Member States.

2.5.   The participation of authorities from third countries in the ESRB General Board

The Commission proposes deleting the provision under Regulation (EU) No 1092/2010 whereby participation in the work of the ESRB may be open to high-level representatives of relevant authorities from third countries, in particular from countries in the European Economic Area. Their participation is strictly limited to issues of particular relevance to those countries (21). This provision serves as the legal basis for the ESRB General Board to invite high-level representatives of relevant authorities from third countries and enables the ESRB to make arrangements specifying the nature, scope and procedural aspects of the involvement of those third countries in the work of the ESRB (22). The ECB suggests maintaining this provision in order to preserve the necessary flexibility for the ESRB to continue to include, where relevant, such high-level representatives from the relevant third-country authorities in the ESRB’s work.

3.   ESRB warnings and recommendations

3.1.   The ECB as an addressee of ESRB warnings and recommendations

The proposed regulation amends Regulation (EU) No 1092/2010 to, inter alia, provide that warnings or recommendations by the ESRB may also be addressed to the ECB, as a competent or designated authority in Member States participating in the SSM, for tasks conferred on the ECB in accordance with Articles 4(1), 4(2) and 5(2) of Regulation (EU) No 1024/2013. The ECB welcomes the clarification of the list of potential addresses of ESRB warnings and recommendations, which duly recognises the establishment of the Banking Union and the related changes in the institutional set-up in the regulatory framework for macro-prudential policy (23).

3.2.   The transmission of ESRB warnings and recommendations to the European Parliament

The ECB generally supports the proposal to transmit ESRB warnings and recommendations to the European Parliament (24). However, the ECB would like to emphasise that all bodies must ensure strict confidentiality and professional secrecy in order to mitigate potential risks stemming from a premature or undue disclosure of market sensitive information that may compromise financial stability in the Union. Any addition to the number of recipients of ESRB warnings and recommendations must take full account of such risks, which arise before these warnings and recommendations have been communicated to the wider public.

4.   Collection and exchange of information

4.1.   The involvement of the ESAs in respect of requests of disaggregated information from ESCB central banks

The ECB considers that the proposed regulation would benefit from clarifying the scope of Article 15(7) of Regulation (EU) No 1092/2010. At the current juncture, it is not entirely clear from the drafting of this provision whether the ESAs must also be consulted when the ESRB requests disaggregated information from ESCB central banks. The ECB sees no reason why the ESAs should be involved in assessing whether the ESRB’s request for non-supervisory information is justified and appropriate. Therefore, it suggests clarifying that the ESAs must only be consulted if ESRB requests pertain to disaggregated supervisory information.

New national side of euro coins intended for circulation

Image

Euro coins intended for circulation have legal tender status throughout the euro area. For the purpose of informing the public and all parties who handle the coins, the Commission publishes a description of the designs of all new coins (1). In accordance with the Council conclusions of 10 February 2009 (2), euro-area Member States and countries that have concluded a monetary agreement with the European Union providing for the issuing of euro coins are allowed to issue commemorative euro coins intended for circulation, provided that certain conditions are met, particularly that only the 2-euro denomination is used. These coins have the same technical characteristics as other 2-euro coins, but their national face features a commemorative design that is highly symbolic in national or European terms.

Subject of commemoration : Slovenia World Day of Bees

Description of the design : In the middle of the inner ring of the coin is the image of honeycomb in a form of a globe, which shows the eastern hemisphere. Around the honeycomb on the left upper side is the inscription ‘SVETOVNI DAN ČEBEL’, and on the lower right side the inscription ‘SLOVENIJA 2018’.

The coin’s outer ring depicts the 12 stars of the European flag.

THE AUTHORITY FOR EUROPEAN POLITICAL PARTIES AND EUROPEAN POLITICAL FOUNDATIONS,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU, Euratom) No 1141/2014 of the European Parliament and of the Council of 22 October 2014 on the statute and funding of European political parties and European political foundations (1), in particular Article 9 thereof,

Having regard to the application received from Alliance of European National Movements,

Whereas:

The Authority for European political parties and European political foundations (‘Authority’) received an application for registration as a European political party under Article 8(1) of Regulation (EU, Euratom) No 1141/2014 from Alliance of European National Movements (the ‘applicant’) on 20 September 2017.

On 27 September 2017, the Authority informed the applicant, pursuant to Article 9(2), third subparagraph, of Regulation (EU, Euratom) No 1141/2014, that its application was incomplete and set out the documents and information needed to complete the application.

The applicant filed an additional submission supplementing its application on 29 September 2017.

On 3 October 2017, the Authority informed the applicant that its application was still incomplete and reiterated that additional documents and information were necessary to complete the application.

The Authority received additional documents and information supplementing the application on 3 and 4 October 2017. The applicant also filed a further submission supplementing its application on 5 October 2017.

Modification des articles 11, 12 et 13.

PRÉAMBULE

Vu le traité instituant la Communauté européenne, et notamment son article 191 ;

Vu le Règlement (CE) no 2004/2003 du Parlement européen et du Conseil du 4 novembre 2003 relatif au statut et au financement des partis politiques au niveau européen tel que modifié par le Règlement (CE) no 1524/2007 du 18 décembre 2007 ;

Les partis politiques, mouvements nationaux, personnes morales ou physiques soussignés dont la liste est fournie à la fin des présents statuts conviennent de créer une association sans but lucratif selon la loi française et de déterminer ses statuts comme suit :

I.   NOM - BASE LEGALE - OBJET - SOCIAL - BUT - DUREE

Article 1

Dénomination

L'association, une alliance politique de partis nationaux et de personnes morales ou physiques au niveau européen, est dénommée « Alliance Européenne des Mouvements Nationaux ». En abrégé, «AEMN».

Ce nom doit toujours être précédé ou suivi des mots « parti politique européen », ou de l'abréviation PPEU/EUPP/EUPP.

Article 2

Base légale

« L'Alliance Européenne des Mouvement Nationaux » poursuit ses objectifs, exécute ses activités et est organisé et financé conformément aux conditions exposées dans le règlement (UE/EURATOM) No 1141/2014 du Parlement européen et du Conseil du 22 octobre 2014 relatif au statut et au financement des partis politiques européens et des fondations politiques européennes.

Pour les questions non réglementées par le règlement européen susmentionné, « L'Alliance Européenne des Mouvement Nationaux » est établie conformément à la loi française donnant la personnalité juridique aux associations, y inclus la loi du 1er août 2003, les articles 21 à 79 de la droit civile locale, et autre disposition particulières à l’Alsace-Moselle.

AEMN ne poursuit pas de but lucratif.

Le logo de l'association est défini à l'ANNEXE 1 des statuts.

Article 3

Hiérarchie des normes

Au cas où les présents statuts et le règlement intérieur qui sera ultérieurement adopté contredirait ou viendraient à contredire les textes légaux résultant de la législation française, les textes communautaires issus du traité instituant la Communauté européenne, et notamment son article 191, ainsi que le Règlement (CE) no 2004/2003 relatif aux statuts et au financement des partis politiques au niveau européen, ces normes européennes et françaises prévaudrait sans qu'il soit nécessaire de procéder à une modification des statuts.

Elles s'appliquent également en cas de silence de ces mêmes statuts

Article 4

Siege social

Le siège social de l'association est établi : 11 rue de Wissembourg - 67000 STRASBOURG (France).

Le Bureau de l'association est autorisé à transférer le siège social de l'association en un autre endroit, sous réserve de l'accomplissement des formalités prescrites par la loi. Il peut établir d'autres bureaux sur tout le territoire européen.

Article 5

Buts

L'Alliance Européenne des Mouvements Nationaux, en conformité avec l'article 3 § c du Règlement (CE) no 2004/2003 du Parlement européen et du Conseil du 4 novembre 2003, est fondée sur les principes du respect des libertés fondamentales, de la démocratie, des droits de l'homme et de l'État de droit tels que hérités des meilleurs traditions spirituelles et doctrinales de la civilisation européennes. Elle précisera ses objectifs politiques dans une déclaration commune.

Ses buts sont en outre les suivants :

Développer des relations de travail plus étroites et rapprocher les partis politiques nationaux membres ;

Définir des objectifs communs sur les enjeux relatifs à l’Union européenne ;

Établir une structure facilitant le dialogue et la coopération avec les forces politiques semblables au sein des États membres de l’Union, ainsi qu’au sein des autres pays européens, candidats ou non à l’adhésion à l’Union européenne.

Participer ou contribuer à la participation aux élections européennes, au sens de l'article 3 § d du règlement (CE) No 2004/2003 du Parlement européen et du Conseil du 4 novembre 2003

L'association est autorisée à prendre tous les actes juridiques (y compris les transactions immobilières), directement ou indirectement nécessaires ou utiles à la promotion et à la réalisation des objectifs susmentionnés.

Dans le cadre national, les partis membres maintiennent leur propre nom, leur identité et leur liberté d'action. L'association est représentée au Parlement européen par les députés des partis nationaux membres de «L'Alliance Européenne des Mouvements Nationaux».

Les Partis membres s'engagent à inciter leurs élus au Parlement européen ainsi que les membres des autres assemblées parlementaires européennes à adhérer à « L'Alliance Européenne des Mouvement Nationaux », ainsi qu'aux groupes parlementaires ou aux coordinations se proposant les mêmes buts et recommandés par elle.

Article 6

Durée

L'association est constituée pour une durée indéterminée.

II.   MEMBRES

L'association est composée de partis membres, de membres associés et d’observateurs.

Article 7

Membres et Membres Associés

Le nombre de membres est illimité. Une demande d'adhésion doit être soumise au Président par écrit. Elle comporte une déclaration d'adhésion au programme politique, aux statuts et au règlement intérieur de l'association. Le Président transmet ensuite cette demande au Bureau.

Le Bureau est habilité à accorder le statut de partis membres à des mouvements patriotiques et nationaux de la même sensibilité, basés dans l'Union européenne, qui souscrivent au programme politique de l'association et acceptent ses statuts et son règlement intérieur.

Le Bureau est également habilité à octroyer le statut de membre associé à des personnes morales souscrivant aux mêmes conditions, ainsi qu'aux personnes physiques exerçant ou ayant exercé les mandats de parlementaires européen, parlementaire national ou élu régional.

Chaque parti candidat doit désigner une personne physique comme représentant légal dans le processus d'adhésion à l'association.

Article 8

Membres observateurs

Sur proposition du Président, des Partis ou Mouvements proches de “ L'Alliance Européenne des Mouvements Nationaux ” au sein d'États membres de l'Union européenne ou d'États européens ayant demandé ou non l'adhésion à l'Union européenne peuvent se voir octroyer le statut d'Observateurs par le Bureau.

Article 8 bis

Sur proposition du Président, des membres de soutien sans droits de vote peuvent être admis par une demande d'adhésion qui doit être soumise au Président par écrit. Elle comporte une déclaration d'adhésion au programme politique, aux statuts et au règlement intérieur de l'association. Le Président transmet ensuite cette demande au Bureau.

Article 9

Cotisation

Les partis membres, les personnes physiques ou morales, les membres associés ainsi que les observateurs et les membres de soutien versent une cotisation annuelle individuelle. Le montant de cette cotisation est fixé annuellement par le Bureau. Les membres ne contractent aucune obligation personnelle relativement aux engagements de l'association.

Article 10

Perte de la qualité de membre

Tout membre peut démissionner de l'association à tout moment. Le membre remet sa démission au Président par lettre recommandée.

Le membre qui démissionne est tenu de s'acquitter de ses obligations financières envers l'association pour l'année pendant laquelle la démission est soumise et pour toutes les années précédentes.

La suspension d'un membre ne peut être décidée à titre conservatoire que par le Bureau. L’exclusion définitive ne peut être prononcée que par l’Assemblée. Elle doit être motivée.

III.   ORGANES

Les organes de “L'Alliance Européenne des Mouvements Nationaux” sont :

 

Le Bureau, faisant fonction de Conseil d’Administration ;

 

L'Assemblée, faisant fonction d’Assemblée Générale dans l'intervalle du Congrès ;

 

Le Congrès, faisant fonction d'Assemblée générale extraordinaire.

 

Ils sont présidés par le Président et assistés par le Secrétaire Général.

Article 11

Nomination, composition et pouvoirs du Bureau

Le Bureau est l'organe exécutif de « L'Alliance Européenne des Mouvement Nationaux ». Aux fins de dépôt des présents statuts, il se compose à titre provisoire de personnes dont les noms figurent à l'article 19. Il sera ensuite complété de façon à comprendre :

Un Président ;

Si nécessaire un ou plusieurs Vice-présidents ;

Un Trésorier ;

Un Secrétaire Général ;

Si nécessaire, un Secrétaire Général Adjoint ;

Des représentants de membres associés, selon les modalités déterminées par le règlement intérieur.

Le ou les trésoriers sont élus par l'Assemblée. Tout parti membre a le droit de nommer un Vice-président, qui peut recevoir le droit de représenter l’association dans l’État membre dont il est originaire.

Chaque parti ayant la qualité de membre observateur a la faculté de désigner un représentant membre du Bureau sans droit de vote, qui peut recevoir le droit de représenter l'Association dans l'État membre dont il est originaire.

Un membre du Bureau peut donner procuration à un autre membre nommément désigné de le représenter.

Le Bureau convoque, sur proposition du Président, les réunions de l'Assemblée et du Congrès.

Le Bureau représente « L'Alliance Européenne des Mouvement Nationaux » au cours des périodes séparant chaque réunion de l'Assemblée et du Congrès. Si une vacance se produit dans ses rangs par suite de décès, de démission ou pour toute autre cause, il peut pourvoir au remplacement à titre provisoire, sous réserve de ratification de son choix par l’Assemblée ou le Congrès qui suivent.

Le Bureau est responsable devant l'Assemblée et le Congrès.

Le Bureau est l’organe exécutif de « L'Alliance Européenne des Mouvement Nationaux ». Sauf disposition contraire de la loi ou des statuts, il prend ses décisions à la majorité simple des votes exprimés. Un membre du Bureau peut donner procuration à un autre membre nommément désigné de le représenter. En cas d’égalité, la voix du Président est prépondérante.

Les réunions du Bureau sont convoquées par le Président ou à la demande des deux-tiers des membres du Bureau ayant un droit de vote. Elles ont lieu aussi souvent que nécessaire pour la gestion de « L'Alliance Européenne des Mouvement Nationaux ».

Article 12

Nomination, composition et pouvoirs de l'Assemblée

Dans l'intervalle des Congrès, et sous réserve de prérogatives spécialement dévolues au Congrès aux termes de l'article 13 des présents statuts, l'Assemblée exerce les compétences dévolues par la loi à l'Assemblée générale. L'Assemblée se réunit aussi souvent que nécessaire et au moins une fois par an.

Elle est convoquée au moins quinze jours avant sa tenue, par lettre ordinaire, courriel ou télécopie, adressée à ceux qui en sont membres. La convocation mentionne l'ordre du jour de la réunion.

L'Assemblée se compose des participants suivants :

Du Président de “L'Alliance Européenne des Mouvements Nationaux” ;

De deux représentants de chaque parti membre, chaque représentant est considéré comme un participant ;

Des membres du Bureau ;

Des Chefs de délégation nationale au Parlement européen ou de leurs représentants ;

D’un représentant de chaque parti observateur ;

De représentants des membres associés personnes physiques ou morales selon les modalités arrêtées par un règlement intérieur

Des personnes supplémentaires peuvent être invitées par l'Assemblée à participer aux travaux en tant que membres sans droit de vote.

L'Assemblée élit le Président et le ou les Trésoriers. Elle peut au besoin les révoquer.

L'Assemblée est l’organe délibérant entre la tenue de deux Congrès. Sauf disposition contraire de la loi ou des statuts, elle prend ses décisions à la majorité simple des votes exprimés. Un membre de l'Assemblée peut donner procuration à un autre membre nommément désigné de le représenter. En cas d’égalité, la voix du Président est prépondérante.

Sur proposition du Président, l'Assemblée nomme le Secrétaire Général et le Secrétaire Général Adjoint.

L'Assemblée adopte le budget annuel, approuve et publie chaque année les recettes et dépenses de “L'Alliance Européenne des Mouvements Nationaux” ainsi qu’une déclaration relative à son actif et à son passif, sur la base des propositions du (des) Trésorier(s).

L'Assemblée fournit au Parlement européen une liste précisant des donateurs et de leurs dons, exception faite des dons n’excédant pas 500 EUR. Cette liste est préparée par le(s) Trésorier(s).

L'Assemblée peut constituer des groupes de travail, auxquels peuvent participer des non-membres pour avis, expertise ou conseil.

Article 13

Nomination, composition et pouvoirs du Congrès

Le Congrès de “L'Alliance Européenne des Mouvements Nationaux” se réunit au moins une fois par législature du Parlement européen.

Le Congrès constitue l’instance souveraine d’orientation de “L'Alliance Européenne des Mouvements Nationaux”. Il fait notamment fonction d'Assemblée Générale extraordinaire.

Le Congrès définit les grandes orientations politiques, et le programme politique de “L'Alliance Européenne des Mouvements Nationaux”

Le Congrès se compose :

des membres de l'Assemblée ;

des membres associés ;

des parlementaire européens et nationaux des partis membres, associés et observateurs ;

des élus régionaux des partis membres et observateurs ;

d’autres délégués des partis membres et observateurs dans une proportion arrêtée par le règlement intérieur.

Le lieu, la date et l’ordre du jour des travaux du Congrès sont fixés par le Bureau ; chaque parti membre a le droit de proposer l’inscription de nouveaux points à l’ordre du jour.

Le Congrès, sauf disposition contraire de la loi ou des statuts, il prend ses décisions à la majorité simple des votes exprimés. Un membre du Congrès peut donner procuration à un autre membre nommément désigné de le représenter. En cas d’égalité, la voix du Président est prépondérante.

Le Président, le Secrétaire Général et le Trésorier de “L'Alliance Européenne des Mouvements Nationaux” font rapport de leurs activités au Congrès.

Article 14

Nomination et pouvoirs du Président

Le Président, élu par l'Assemblée ;

Préside les réunions du Bureau, de l'Assemblée et du Congrès ;

Représente “L'Alliance Européenne des Mouvements Nationaux” à l'égard des tiers ;

Transmet au Parlement européen et à la Cour des comptes, dans un délai de six mois à compter de la fin de l’exercice concerné, la certification annuelle établie par un audit externe et indépendant des comptes de “L'Alliance Européenne des Mouvements Nationaux” ;

Soumet annuellement au Parlement européen la demande de financement de “L'Alliance Européenne des Mouvements Nationaux” en provenance du budget général de l’Union européenne ;

Peut convier les Présidents des partis membres, associés et observateurs à se réunir pour toute question importante se posant à “L'Alliance Européenne des Mouvements Nationaux”

Article 15

Nomination et pouvoirs du Secrétaire Général

Le Secrétaire général est élu par l'Assemblé sur proposition du Président

Le Secrétaire général, sous le contrôle du Président :

Organise les réunions des différents organes de “L'Alliance Européenne des Mouvements Nationaux” ;

Autorise toutes les dépenses en conformité avec la loi ;

Demande chaque année un audit externe et indépendant des comptes de “L'Alliance Européenne des Mouvements Nationaux” ;

Fournit tout document ou toute information jugée nécessaire par la Cour des comptes à l’accomplissement de sa mission de contrôle ;

Dirige le secrétariat, dont il propose la composition et l’organisation au Bureau ;

Fait rapport au Président, au Bureau, à l'Assemblée et au Congrès ;

Met en œuvre les décisions prises par les organes de “L'Alliance Européenne des Mouvements Nationaux” ;

Entretient les contacts avec les Secrétaires Généraux des partis membres et des partis associés.

Le Secrétaire Général est assisté par le Secrétaire Général Adjoint désigné par l'Assemblée sur proposition du Président.

Article 16

Règlement intérieur

L'Assemblée, sur proposition du Bureau, arrête le règlement intérieur qui fixe les modalités de fonctionnement non précisées dans les statuts. À titre transitoire, le texte adopté par le bureau s'appliquera, s'il y a lieu, jusqu'à sa validation par la première Assemblée.

Article 17

Modifications des Statuts

Le Congrès, sur proposition du Bureau, décide toute modification des statuts à la majorité des 2/3 selon les modalités définies à l'article 13 précédent. Il peut également décider selon ces mêmes modalités la dissolution de l’association et toute mesure en découlant.

Article 17 bis

Définition

Identité et traditions européennes (ci-après “ITE”) est la fondation politique européenne officielle de l’Alliance Européenne des Mouvements Nationaux.

ITE fonctionnera comme seul groupe de réflexion officiel de l’AEMN et servira, en particulier, de Structure européenne commune pour les fondations/groupes de réflexion nationale reconnus par les partis membres de l’AEMN.

ITE est constitué comme une entité légale à part, avec des comptes financiers distincts, agissant en conformité avec ses propres statuts et règlements intérieurs.

IV.   QUESTIONS FINANCIERES

Article 18

Le Trésorier

Le Trésorier, élu par l'Assemblée,

Propose à l'Assemblée un projet de budget annuel, dont les recettes provenant du budget de l’Union ne peuvent excéder 85 % du total ;

Soumet chaque année à l'Assemblée les recettes et dépenses de “L'Alliance Européenne des Mouvements Nationaux” ainsi qu’une déclaration relative à son actif et à son passif ;

Tient à la disposition de l'Assemblée la liste des donateurs et les dons de chaque donateur

Soumet à l'Assemblée les contributions annuelles des membres et des membres associés ;

Rend compte à l'Assemblée, sur une base annuelle, des dépenses du Secrétariat et des organes de “L'Alliance Européenne des Mouvements Nationaux” ;

Approuve les paiements effectués à partir des fonds de “L'Alliance Européenne des Mouvements Nationaux”.

Summary of the Opinion of the European Data Protection Supervisor on the proposal for a recast of the Brussels IIa Regulation

The Brussels IIa Regulation is the cornerstone of judicial cooperation in family matters in the European Union. It establishes uniform jurisdiction rules for divorce, separation and annulment of marriage as well as for disputes about parental responsibility in cross-border situations. The overall objective of the recast of the Brussels IIa Regulation is to remove the remaining obstacles to the free movement of judicial decisions in line with the principle of mutual recognition and to better protect the best interest of the child by simplifying the procedures and enhancing their efficiency.

The new proposed rules aim to promote better cooperation between central authorities, which exchange information within and across Member States, without involving the creation of any IT system. The EDPS had not been consulted on the proposal by the Commission. Given that concerns regarding the relationship between the proposed recast and the Union law on protection of personal data were raised during the discussions within the Council Working Party on Civil Law Matters, the Council formally requested an opinion of the EDPS. The EDPS welcomes this request for consultation from the Council.

The Opinion focuses on specific recommendations to strengthen the lawfulness of the processing provided for under Articles 63 and 64 of the Proposal. Additionally, the EDPS provides recommendations for suitable and specific safeguards to protect the fundamental rights and interests of the data subjects.

In the light of Articles 6(3) and 9(2)(g) of the GDPR and in consideration of the context, the aim of the Proposal and the fact that children are among the data subjects affected by the Proposal, the EDPS recommends including in the Regulation specific clauses in relation to the purpose of processing and the types of data subject to the processing. In particular, the EDPS recommends clarifying whether the cooperation framework set up under Chapter V of the Proposal covers parental responsibility matters only or includes international child abduction as well. Thus, considering that Chapter V appears to include both areas of cooperation, and in order to provide more legal certainty and to satisfy the requirements of the purpose limitation principle, the EDPS considers that Article 63(3) could be modified to narrow the purposes to ‘cooperation in specific cases relating to parental responsibility and international child abduction’. In addition, the EDPS would welcome an explicit reference to the principles of data quality and minimisation in the Regulation.

In the context of the current Proposal, the EDPS is satisfied that Article 63(4) provides for the obligation, as a principle, to notify the data subject about the transmission of information. This obligation may be postponed, as an exception, until the request has been carried out. This limitation, which aims to ensure a fair balance between the rights of the data subjects to be informed about the transmission and the interests of the Member States to exchange information, in itself does not appear to raise fundamental questions from the point of view of the general principles of lawfulness, fairness and transparency. However, the EDPS considers that the reference to the ‘national law of the requested Member State’ may be subject to confusion in that it seems to allow the introduction of national restrictions to the duty to inform. The EDPS recommends specifying that the reference to the national law of the requested Member State under Article 63(4) does not allow further limitations on the right to information to be introduced at national level, so that the specific measure envisaged to ensure fairness of the processing enshrined in this provision be consistently applied across the Union.

In addition, the EDPS recommends establishing in the Regulation, as a principle, the right of access of data subjects to the information transmitted to the requesting authority of a Member State. The EDPS further recommends, to the extent restrictions to the rights of access and rectification are considered necessary in the particular context of the Proposal, supplementing the Proposal with a clear and specific provision laying down ‘the scope of the restrictions’, in accordance with Article 23(2)(c) of the GDPR.

1.   INTRODUCTION AND BACKGROUND

On 30 June 2016, the Commission submitted to the Council a Proposal for a Council Regulation on jurisdiction, the recognition and enforcement of decisions in matrimonial matters and the matters of parental responsibility, and on international child abduction (recast). The Proposal is a recast of Council Regulation (EC) No 2201/2003 of 27 November 2003, repealing Regulation (EC) No 1347/2000 (the so-called Brussels IIa Regulation, hereinafter the ‘Proposal’).

The Brussels IIa Regulation is the cornerstone of judicial cooperation in family matters in the European Union. It establishes uniform jurisdiction rules for divorce, separation and annulment of marriage as well as for disputes about parental responsibility in cross-border situations. It facilitates the free circulation of judgements, authentic instruments and agreements in the Union by laying down provisions on their recognition and enforcement in other Member States. It applies since 1 March 2005 to all Member States (1) except Denmark (2).

The Commission has assessed the operation of the Regulation in practice and considered necessary to amend the instrument in its application report adopted in April 2014 (3). The evaluation showed that between the two major areas covered by the Regulation, matrimonial and parental responsibility matters, the latter was identified to have caused acute problems. In addition, the European Court of Justice (CJEU) has so far rendered 24 judgments concerning the interpretation of the Regulation, which were taken into account.

The overall objective of the Proposal is to further develop the European area of Justice and Fundamental Rights based on mutual trust by removing the remaining obstacles to the free movement of judicial decisions in line with the principle of mutual recognition and to better protect the best interest of the child by simplifying the procedures and enhancing their efficiency.

In particular, the Proposal abolishes the procedure of exequatur  (4) for all decisions covered by the Regulation’s scope, introducing, instead, automatic recognition of all judgments from other EU Member States. The Proposal also clarifies a number of issues concerning cross-border child abduction, with the aim of improving the efficiency of the return of an abducted child.

The new rules aim to promote better cooperation between central authorities, which exchange information within and across Member States, without involving the creation of any IT system. The Council Working Party on Civil Law Matters has nevertheless raised concerns during the discussions about the relationship between the proposed recast and the Union law on protection of personal data.

On 11 January 2018, the Council submitted to the EDPS a formal request for an opinion, in particular on Articles 63(3) and 63(4) of the Proposal, concerning rules on how information collected by central authorities dealing with cross-border cases may further be used and how notification to data subjects should be done.

The EDPS welcomes that he has been consulted by the Council. The focus of this Opinion, is to provide specific recommendations to strengthen the lawfulness of the processing provided for under Articles 63 and 64 of the Proposal (Section 2). Additionally, the EDPS provides recommendations for suitable and specific safeguards to protect the fundamental rights and interests of the data subjects (Section 3).

4.   CONCLUSION

Lawfulness of the processing

38.

As a main recommendation and in order to strengthen the lawfulness of the processing envisaged (under Articles 6(3) and 9(2)(g) of the GDPR) and considering the context and aim of the Proposal, the EDPS recommends clarifying the scope and purpose(s) of the cooperation established under Chapter V of the Proposal:

The EDPS recommends clarifying whether the cooperation framework set up under Chapter V of the Proposal covers parental responsibility matters only or includes international child abduction as well. Considering that Chapter V includes both areas of cooperation, and in order to provide more legal certainty and to satisfy the requirements of the purpose limitation principle, the EDPS considers that Article 63(3) should be modified to narrow the purposes to ‘cooperation in specific cases relating to parental responsibility and international child abduction’, thus excluding ‘matrimonial matters’, which is the other major area covered by the Regulation. The definitions of ‘competent authority’ etc. should be adapted accordingly.

As an additional recommendation to strengthen the lawfulness of the processing:

The EDPS would welcome an explicit reference to the principles of data quality and data minimisation under Article 64(1) of the Proposal.

Suitable and specific measures to safeguard the fundamental rights and interests of the data subject

As a main recommendation:

The EDPS recommends specifying that the reference to the national law of the requested Member State under Article 63(4) does not allow further limitations on the right to information to be introduced at national level, so that the specific measure envisaged to ensure fairness of the processing enshrined in this provision be consistently applied across the Union.

41.

As an additional recommendation, the EDPS suggests supplementing the Proposal with specific measures to safeguard the rights access and rectification of data subjects:

The EDPS recommends establishing in the Regulation, as a principle, the right of access of data subjects to the information transmitted to the requesting authority of a Member State. The EDPS further recommends, to the extent restrictions to the rights of access and rectification are considered necessary in the particular context of the Proposal, supplementing the Proposal with a clear and specific provision laying down ‘the scope of the restrictions’, in accordance with Article 23(2)(c) of the GDPR.

On 28 March 2018, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), whereby Prysmian S.p.A. (‘Prysmian’, Italy) acquires control of General Cable Corporation (‘General Cable’, United States), by way of purchase of shares.

Both Prysmian and General Cable are active in the production and sale of cable and cable systems, mainly in the energy cable and telecom cable sectors.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

On 28 March 2018, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

ElvalHalcor SA (Greece), controlled by Viohalco SA (Belgium),

NedZink BV (Netherlands), currently controlled by Koramic Holding NV (Belgium).

ElvalHalcor SA and Koramic Holding NV acquire within the meaning of Article 3(1)(b) and 3(4) of the Merger Regulation joint control of NedZink BV.

The concentration is accomplished by way of purchase of shares.

The business activities of the undertakings concerned are:

—   for Viohalco SA: manufacturing and sale of products, including copper, aluminium and steel for the construction industry, in particular copper elements for roofing and rainwater systems; aluminium elements for roofing systems, facades and rainwater systems steel sandwich panels,

—   for Koramic Holding NV: investment in industrial and commercial companies, real estate investment and development, private equity and treasury activities, in particular production of rolled zinc products for roofing systems and rainwater systems; zinc production activities are mainly conducted through NedZink BV.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
