Information related to data on Member States’ trusted lists as notified under Commission Decision 2009/767/EC, as amended by Decision 2010/425/EU and Implementing Decision 2013/662/EU and as notified under Implementing Decision (EU) 2015/1505

Pursuant to Article 2.4 of Commission Decision 2009/767/EC (1), as amended by Decision 2010/425/EU (2) and Implementing Decision 2013/662/EU (3), in application until 1 July 2016, the European Commission makes available to the Member States, through a secure channel to an authenticated web server, the information notified by Member States under Article 2.3 of Decision 2009/767/EC as amended in a signed machine-processable form,

and

Pursuant to Article 4.3 of Commission Implementing Decision (EU) 2015/1505 (4), entering in application on 1 July 2016, the European Commission makes available to the public, through a secure channel to an authenticated web server, the information notified by Member States under Articles 4.1 and 4.2 of Implementing Decision (EU) 2015/1505, in a signed or sealed form suitable for automated processing.

The information provided below replaces the information published in OJ C 435 of 24 December 2015, page 1 on the same topic.

The information notified by Member States is available as a signed or sealed XML machine-processable form (hereafter the ‘compiled list’) at the following URL: https://ec.europa.eu/information_society/policy/esignature/trusted-list/tl-mp.xml

The authenticity and integrity of ‘the compiled list’ is ensured through an electronic signature (or electronic seal when applicable) supported by one of the following digital certificates that can be authenticated through the following digest information:

The authenticity and integrity of the ‘compiled list’ should be verified by relying parties prior to any use. The Commission accepts no responsibility or liability whatsoever with regard to the content of the pointed national trusted lists which lies exclusively with the Member States.

From the date of publication of the present information the ‘compiled list’ shall include the URL of the ‘compiled list’ together with the PEM representation of the above digital certificates as provided in the Annex (hereafter the ‘secure pointer to the compiled list’).

Any future change in the ‘secure pointer to the compiled list’ shall likewise be reflected in the publication of a new instance of the ‘compiled list’ which will include a new URL or a modified set of digital certificates for relying parties to use when authenticating the ‘compiled list’.

Starting at the date of issuance of the ‘compiled list’ in which this new information is first published, this ‘secure pointer to the compiled list’ may be used by relying parties to locate and authenticate the ‘compiled list’ in replacement of the formerly issued ‘secure pointer to the compiled list’. The European Commission will also ensure that the formerly issued ‘secure pointer to the compiled list’ can still be used to locate and authenticate the ‘compiled list’ until 15 days after the publication of the new ‘secure pointer to the compiled list’. This provides a transition period for relying parties to consume the new information at their most convenient time within this period.

The duration of this transition period may however be abruptly changed by the European Commission in a new publication in the Official Journal of the European Union, for instance as a temporary response to an emergency situation requiring the immediate replacement of all the digital certificates of the ‘secure pointer to the compiled list’.

Each instance of the ‘compiled list’ shall include, as the first part of the information regarding the underlying scheme, in their chronological order showing the most recent element first, the list of:

the URLs where the last archived previous instance of the compiled list containing a new ‘secure pointer to the compiled list’ is published, back until and followed by

the URL of the latest relevant publication in the Official Journal of the European Union setting the ‘secure pointer to the compiled list’.

Until 30 June 2016, the information notified by Member States is also available in human-readable form at the following URL: https://ec.europa.eu/information_society/policy/esignature/trusted-list/tl-hr.pdf

As of 1 July 2016 and in line with the applicable legal framework, the publication will be ensured only in a machine-processable form.

EU Guidelines for the application of State aid rules in relation to the rapid deployment of broadband networks: acceptance of the proposed appropriate measures pursuant to Article 108(1) of the Treaty on the Functioning of the European Union by all Member States

In paragraphs 89-90 of the EU Guidelines for the application of State aid rules in relation to the rapid deployment of broadband networks (1), the Commission proposed to Member States, on the basis of Article 108(1) TFEU, to take appropriate measures and amend, where necessary, their existing aid schemes in order to bring them into line with the provisions of these Guidelines within 12 months after their publication in the Official Journal of the European Union. Member States were requested to confirm their acceptance of the proposed appropriate measures within 2 months from the date of publication of the Guidelines in the Official Journal of the European Union.

Pursuant to Council Regulation (EU) 2015/1589 (2), the Commission recorded the unconditional and explicit agreement to the appropriate measures by all Member States that had existing schemes in place at the time of the adoption of the EU Guidelines for the application of State aid rules in relation to the rapid deployment of broadband networks.

On 17 June 2016, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Konecranes PLC (‘Konecranes’, Finland) acquires within the meaning of Article 3(1)(b) of the Merger Regulation control of the Material Handling and Port Solutions business part of Terex (‘Terex’, United States of America).

2.

The business activities of the undertakings concerned are:

—   for Konecranes PLC: lifting businesses, serving a broad range of customers, including manufacturing and process industries, shipyards, ports and terminals. Konecranes provides productivity-enhancing lifting solutions as well as services for lifting equipment and machine tools of all makes,

—   for Terex MHPS: Terex MHPS supplies industrial cranes, hoists and services, as well as port technology with a broad range of manual, semi-automated and automated solutions. MHPS has manufacturing facilities in 16 countries on five continents and operates a sales and service network in more than 60 countries.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

On 17 June 2016, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking TOTAL SA (‘TOTAL’, France) acquires within the meaning of Article 3(1)(b) of the Merger Regulation control of the whole of Saft Groupe SA (‘Saft’, France) by way of public bid announced on 9 May 2016.

2.

The business activities of the undertakings concerned are:

—   for TOTAL: Energy production in the gas and oil sector including (i) exploration and production; (ii) operations on the whole liquefied natural gas chain; (iii) refining and chemicals; (iv) trading and shipping; (v) marketing and services. TOTAL has activities in the sector of renewable energies including solar energy and biomass

—   for Saft: Design, development, manufacture and supply of rechargeable and non-rechargeable industrial batteries for a wide range of civil and military applications, including industrial infrastructure and transportation systems, smart cities and medical devices, energy storage and telecom networks, industrial vehicles and defence systems, and satellites and space applications.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
