Artikel 275/4 van het Wetboek van Inkomstenbelastingen 1992 (hierna WIB92), ingevoegd bij De oorspronkelijke nationale rechtsgrond van de steunregeling was de Programmawet van 24 december 2002, met name de artikelen 387-388. Dit artikel 387 werd bij de wet van 23 december 2005 betreffende het generatiepact ingevoegd in art. 275/4, § 1 WIB 92 (zie artikel 107) en vervolgens opgeheven (zie art. 112). Artikel 275/4, § 2 WIB92 stemt overeen met artikel 388 van de Programmawet van 24 december 2002, dat niet werd opgeheven.

De wet van 23 december 2005 betreffende het generatiepact werd gepubliceerd in het Belgisch Staatsblad van 30 december 2005.
