COMMISSION DECISION

of 27 March 2015

amending the Annex to the Monetary Agreement between the European Union and the Republic of San Marino

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Monetary Agreement of 27 March 2012 between the European Union and the Republic of San Marino, and in particular Article 8(5) thereof,

Whereas:

(1)

Article 8 of the Monetary Agreement between the European Union and the Republic of San Marino (hereinafter ‘the Monetary Agreement’) requires the Republic of San Marino to implement Union acts concerning the rules on euro banknotes and coins, banking and financial law, prevention of money laundering, prevention of fraud and counterfeiting of cash and non-cash means of payment, medals and tokens and statistical reporting requirements. Those acts are listed in the Annex to the Monetary Agreement.

(2)

The Annex needs to be amended by the Commission every year to take into account the new relevant legal acts and rules of the Union and the amendments to the existing ones.

(3)

Some legal acts and rules of the Union are not relevant anymore and should therefore be deleted from the Annex, while some new relevant legal acts and rules of the Union and some amendments to existing legal acts were adopted and have to be added to the Annex.

(4)

The Annex to the Monetary Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to the Monetary Agreement between the European Union and the Republic of San Marino is replaced by the Annex to this Decision.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

Call for applications for the selection of experts of the Commission stakeholder expert group on public procurement

By Decision of 3 September 2011 (1) (the Decision), the Commission set up a stakeholders expert group on public procurement. The task of the group is to provide the Commission with high-quality legal, economic, technical and/or practical insight and expertise to help it shape the EU’s public procurement policy.

Under Article 4 of the Decision, the group of experts will consist of 20 members. Members will be chosen either in their personal capacity and will act independently and in the public interest, or will represent a common interest that is relevant to the field of procurement or will represent organisations in the broad sense.

On 6 July 2012, the Director-General of DG Internal Market and Services appointed 20 members of the group for a three-year renewable mandate. Following the decision of the Director-General of DG GROW (ex DG MARKT), to replace members of the group, the Commission’s departments are calling for applications for the next mandate with a view to selecting new members of the group to represent a common interest that is relevant to the field of procurement or to represent organisations in the broad sense, in accordance with Article 4 of the Decision.

The Commission seeks experts with first-hand experience in the award of public contracts, either due to their position on the supply chain, on the awarding side, or due to regular contacts or experience in the field of public procurement. He/she may be an expert from business, including SMEs, associations of contracting authorities, academia, a lawyer, economist, statistics expert or other.

In all cases, the Commission will take the following criteria into account when assessing applications:

proven competence and experience, including at European and/or international level, in areas relevant to public procurement, in particular:

application of public procurement procedures,

long-term and highly complex PPPs and IPPPs set ups and concessions,

public contracts between authorities in the public sector,

SMEs participation in public tenders,

environmental and social aspects of public procurement,

electronic procurement, in particular in the pre-award phase,

economic analysis of public procurement markets,

relations between public procurement and competition/State aid,

international dimension of public procurement,

access to third countries public procurement markets,

aggregation of public procurement,

professionalization of public procurement,

fight against corruption in public procurement,

management of prequalification in public procurement,

innovation and public procurement,

defence and sensitive security procurement,

and more generally:

national, European and international procurement legislation;

the need to strike a balance within the group in terms of representation of interests and expertise in procurement, and in terms of gender and geographical origin (2).

The members of the group of experts must be nationals of any Member State of the European Union or of an acceding country or a European Economic Area. Signed applications must be sent by 25 April 2015 at the latest. The date of sending will be established as follows:

a)

If applications are sent by e-mail, the date of the e-mail will be the date of sending. Applications by e-mail must be sent to GROW-COMMITTEES-PP@ec.europa.eu with the subject ‘Application for stakeholders expert group on PP’.

b)

If applications are sent by post, the postmark will be considered the date of sending. The postal address for applications is European Commission, DG for Internal Market, Industry, Entrepreneurship and SMEs, GROW E.2, Avenue des Nerviens, 105, 1040 Brussels, Belgium. Subject: ‘Application for Commission stakeholder expert group on public procurement’.

c)

If applications are hand-delivered to the address indicated above, the date on the receipt given upon delivery will be considered the date of sending.

The meetings of the group will take place in English. The applicant must be able to express himself/herself fluently in English. Knowledge of French or German will be an asset. Applications must be completed in English, clearly indicating the applicant’s nationality and including the necessary documentation.

All applicants must submit a curriculum indicating their educational background, professional experience and language knowledge (active and passive). The following information should also be included:

the authority/organisation for which the applicant has been working and the length of time he/she has worked there,

the specific projects and or tasks he/she has been involved in and which are of special relevance in the procurement field,

any works that he/she has published in the procurement field,

any experience he/she has acquired at EU and international level, and

any interests that he/she has, which may prejudice his or her independence.

The Commission’s departments reserve their right to ask for any supporting documents at a later stage, and to replace any member who has provided inaccurate or false declarations as regards the information above.

Pursuant to Article 4 of the Decision, all members of the group must participate actively in the meetings and in their preparation and follow up, as needed. Meetings of the group are expected to take place at least twice a year.

Details of conduct of the Group will be governed by the rules of procedure to be established at the first meeting.

Members must respect the conditions of confidentiality set out in Article 5 of the Commission Decision establishing this group of experts (3). Members appointed in their personal capacity must commit to act independently and in the public interest.

The Commission will reimburse travel and subsistence expenses incurred by participants in their work strictly related to the activities of the group in accordance with the provisions in force at the Commission, within the limits of the available budget. Members will receive no remuneration for their activities in the group.

The list of members of the group of experts will be published in the Register of expert groups (4).

Personal data will be collected, processed and published in accordance with the provisions of Regulation (EC) No 45/2001 of the European Parliament and of the Council (5).

On 25 March 2015, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Constellation Hotels Holding Ltd S.C.A. (‘Constellation’, Luxembourg) and InterContinental Hotels Group (‘IHG’, United Kingdom) acquire within the meaning of Article 3(1)(b) of the Merger Regulation Joint control over the whole of the undertaking InterContinental Paris Le Grand Hotel (‘Le Grand Hotel’, France) by way of purchase of shares and management contract.

The business activities of the undertakings concerned are:

Constellation acquires and owns hotels and real estate.

IHG operates, franchises, and owns hotels on a worldwide basis.

Le Grand Hotel is a four star hotel located in Paris, France.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
