On 6 May 2014, the Commission decided not to oppose the above notified concentration and to declare it compatible with the internal market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004 (1). appointing one member of the Management Board of the European Chemicals Agency

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No 793/93 and Commission Regulation (EC) No 1488/94 as well as Council Directive 76/769/EEC and Commission Directives 91/155/EEC, 93/67/EEC, 93/105/EC and 2000/21/EC (1), and in particular Article 79 thereof,
Whereas:

Article 79 of Regulation (EC) No 1907/2006 provides that the Council is to appoint as members of the Management Board of the European Chemicals Agency (‘the Management Board’) one representative from each Member State. |
(2) |
By its Decision of 17 May 2011 (2), the Council appointed 15 members of the Management Board. |
(3) |
The Government of Denmark has informed the Council of its intention to replace the Danish representative on the Management Board and has submitted a nomination for a new representative, who should be appointed for a period which runs until 31 May 2015, |
HAS ADOPTED THIS DECISION:
Article 1
Mr Henrik Søren LARSEN, of Danish nationality, born on 9 December 1961, shall be appointed member of the Management Board of the European Chemicals Agency, replacing Mr Peter ØSTERGAARD, for the period from 6 May 2014 to 31 May 2015.
Article 2
This Decision shall enter into force on the date of its adoption.

appointing and replacing members of the Governing Board of the European Centre for the Development of Vocational Training

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to Council Regulation (EEC) No 337/75 of 10 February 1975 establishing the European Centre for the Development of Vocational Training, and in particular Article 4 thereof (1),
Having regard to the nomination submitted by the Italian government,
Whereas:

By its Decision of 16 July 2012 (2), the Council appointed the members of the Governing Board of the European Centre for the Development of Vocational Training for the period from 18 September 2012 to 17 September 2015. |
(2) |
A member’s seat is available for Italy on the Governing Board of the Centre in the category of Government representatives as a result of the resignation of Ms Lucia SCARPITTI. |
(3) |
The members of the Governing Board of the aforementioned Centre should be appointed for the remainder of the current term of office, which expires on 17 September 2015. |
HAS DECIDED AS FOLLOWS:

(1) Directive 98/34/EC of 22 June 1998 (OJ L 204 of 21 July 1998) codifies Directive 83/189/EEC, as amended principally by Directives 88/182/EEC and 94/10/EC. Directive 98/34/EC was amended by Directive 98/48/EC of 20 July 1998 (OJ L 217 of 5 August 1998), which extended its scope to Information Society services.
(2) Article 8.2 of the Directive.
(3) Article 9.2 of the Directive (‘detailed opinion... to the effect that the measure envisaged may create obstacles to the free movement of goods or the free movement of services or to the freedom of establishment of service operators within the internal market’.)
(4) Under the Agreement on the European Economic Area, the EFTA countries which are contracting parties to this Agreement shall apply Directive 98/34/EC, adapted as necessary in accordance with Annex II, Chapter XIX, point 1, and may thus put forward observations concerning drafts notified by European Union Member States. Switzerland may also put forward such observations, on the basis of an informal agreement on the exchange of information in the field of technical regulations.
(5) The 98/34/EC procedure was extended to Turkey under the Association Agreement concluded with that country (the Association Agreement between the European Economic Community and Turkey (OJ 1964, p. 3687) and Decisions No 1/95 and No 2/97 of the EC-Turkey Association Council).
(6) Article 9.3 of the Directive requiring Member States to postpone adoption of the notified draft (with the exception of draft regulations relating to services) for 12 months from its reception by the Commission if the latter announces its intention to propose or adopt a directive, regulation or decision on this subject.
(7) Article 9.4 of the Directive requiring Member States to postpone adoption of the notified draft for 12 months from its reception by the Commission if the latter announces its finding that the draft concerns a matter which is covered by a proposal for a directive, regulation or decision presented to the Council.
(8) The Agreement on the European Economic Area (see note 4) lays down the obligation for EFTA countries party to this Agreement to notify draft technical regulations to the Commission.
(9) On the basis of the informal agreement on the exchange of information in the field of technical regulations (see note 4), Switzerland also submits its draft technical regulations to the Commission.
(10) The only type of reaction provided for under the Agreement on the European Economic Area (see notes 4 and 7) is the possibility that the EU put forward observations (Article 8.2 of Directive 98/34/EC as included in Annex II, Chapter XIX, point 1 of this Agreement). The same type of response may be issued with regard to notifications from Switzerland on the basis of the informal agreement between the EU and this country (see notes 4 and 8).

On 5 May 2014 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which Centrica plc. (Centrica) of UK will acquire within the meaning of Article 3(1)(b) of the Merger Regulation control of the whole of Bord Gáis Energy Limited (BGE) of Ireland, a wholly owned subsidiary of Bord Gáis Éireann of Ireland, by way of purchase of shares. |

On 6 May 2014, the European Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which Hitachi Metals Ltd (‘HML’, Japan) and Mitsubishi Materials Corporation (‘MMC’, Japan) acquire within the meaning of Article 3(1)(b) of the Merger Regulation joint control of the whole of MMC Superalloy Corporation (‘MMC Superalloy’, Japan) by way of purchase of shares. MMC Superalloy is currently a wholly owned subsidiary of MMC. |

The business activities of the undertakings concerned are: — for HML: manufacturer and supplier of high-functional materials for use in automobile-related products (including engines and exhaust systems), electronics and infrastructure-related products, — for MMC: publicly listed company operating across eight different businesses (cement, metals, advanced materials and tools, aluminium, electronic materials and components, energy, precious metals, and recycling), — for MMC Superalloy: manufacturer of specialist super alloys of non-ferrous metals used in a range of sectors, including aerospace. |

On preliminary examination, the European Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice. |
