Non-opposition to a notified concentration

(Case M.7149 — La Banque Postale/SNCF/SOFIAP)

On 30 April 2014, the Commission decided not to oppose the above notified concentration and to declare it compatible with the internal market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004 (1). The full text of the decision is available only in the French language and will be made public after it is cleared of any business secrets it may contain. It will be available:

in the merger section of the Competition website of the Commission (http://ec.europa.eu/competition/mergers/cases/). This website provides various facilities to help locate individual merger decisions, including company, case number, date and sectoral indexes,

in electronic form on the EUR-Lex website (http://eur-lex.europa.eu/en/index.htm) under document number 32014M7149. EUR-Lex is the online access to European law.

Notice for the attention of the persons and entities subject to the restrictive measures provided for in Council Decision 2014/145/CFSP, as amended by Council Decision 2014/265/CFSP, and in Council Regulation (EU) No 269/2014 as implemented by Council Implementing Regulation (EU) No 477/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

The following information is brought to the attention of the persons and entities that appear in the Annex to Council Decision 2014/145/CFSP (1), as amended by Council Decision 2014/265 CFSP (2), and in Annex I to Council Regulation (EU) No 269/2014 (3), as implemented by Council Implementing Regulation (EU) No 477/2014 (4) concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine.

The Council of the European Union has decided that the persons and entities that appear in the above-mentioned Annexes should be included in the list of persons and entities subject to restrictive measures provided for in Decision 2014/145/CFSP and in Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine. The grounds for designations of those persons appear in the relevant entries in those Annexes.

The attention of the persons and entities concerned is drawn to the possibility of making an application to the competent authorities of the relevant Member State(s) as indicated in the web sites in Annex II to Regulation (EU) No 269/2014, in order to obtain an authorisation to use frozen funds for basic needs or specific payments (cf. Article 4 of the Regulation).

The persons and entities concerned may submit a request to the Council, together with supporting documentation, that the decision to include them on the above-mentioned list should be reconsidered, to the following address:

The following information is brought to the attention of the persons who appear in Annex II to Council Decision 2010/656/CFSP (1), as implemented by Council Implementing Decision 2014/271/CFSP (2), and in Annex IA to Council Regulation (EC) No 560/2005 (3), as implemented by Council Implementing Regulation (EU) No 479/2014 (4), imposing certain restrictive measures directed against certain persons and entities in Côte d'Ivoire.

The Council of the European Union has determined that the persons that appear in the abovementioned Annexes should continue to be included in the list of persons subject to restrictive measures provided for in Decision 2010/656/CFSP and in Regulation (EC) No 560/2005.

The attention of the persons concerned is drawn to the possibility of making an application to the competent authorities of the relevant Member State(s) as indicated on the websites in Annex II to Regulation (EC) No 560/2005, in order to obtain an authorisation to use frozen funds for basic needs or specific payments (cf. Article 3 of the Regulation).

For the purpose of the Council's next review of the list of persons subject to restrictive measures, the persons concerned may submit a request to the Council before 31 March 2015, together with supporting documentation, that the decision to include them on the said list should be reconsidered, to the following address:

Notice to importers

Imports of tuna from Colombia and El Salvador into the EU

By a notice to importers published in the Official Journal C 132 of 21.5.2010, p. 15, the Commission informed EU traders presenting documentary evidence of origin in order to benefit from preferential treatment for canned tuna and frozen tuna loins of HS subheading 1604 14 imported from Colombia and El Salvador to take all necessary precautions, since the release of the goods in question for free circulation could give rise to a customs debt and lead to fraud against the EU’s financial interests.

Certain measures to remedy this situation have meanwhile been introduced.

In addition, the GSP rules of origin rules have been modified and relaxed in particular for fishery products. The crew composition requirement, whose breach was one of the reasons which gave rise to the above publication, is no longer applicable.

Therefore, the notice to importers published in the Official Journal C 132 of 21.5.2010, p. 15 is hereby withdrawn.

Prior notification of a concentration

(Case M.7207 — Clayton Dubilier & Rice/Ashland Water Technologies)

On 2 May 2014, the European Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Clayton, Dubilier & Rice Fund IX, L.P. (‘CD&R Fund IX’, US), acquires within the meaning of Article 3(1)(b) of the Merger Regulation sole control over entities and assets that comprise Ashland Water Technologies (‘AWT’, US) by way of purchase of shares.

The business activities of the undertakings concerned are:

—   CD&R Fund IX: a private equity fund with investments in a variety of sectors,

—   AWT: the supply of specialty chemicals and the provision of different services such as performance-based feed and control systems, proprietary monitoring devices, remote system surveillance, as well as advice on minimising energy, water and other operational costs to different industries.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication.
