(Residence permits falling under ‘authorisation of establishment’ (Niederlassungsbewilligung), ‘family member’ (Familienangehörige), ‘permanent residence — EU’ (Daueraufenthalt- EG), ‘permanent residence — family member’ (Daueraufenthalt-Familienangehöriger) and ‘authorisation of residence’ (Aufenthaltsbewilligung), in the form of the ID1 card in accordance with the joint actions based on Council Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals — issued in Austria between 1 January 2003 and 1 January 2006).

The ‘authorisation of residence’ (Aufenthaltsbewilligung) permit indicates the specific purpose for which it was issued.

An ‘authorisation of residence’ permit (Aufenthaltsbewilligung) may be issued for the following purposes: job rotation worker, posted worker, self-employed, artist, special cases of employment, school pupil, student, social service provider, researcher, family reunification and Section 69a of the Establishment and Residence Act (NAG).

The ‘authorisation of establishment’ (Niederlassungsbewilligung) residence permit may be issued without further details or for the following purposes: no gainful activity and dependant.

‘Authorisation of establishment’ (Niederlassungsbewilligung) residence permits were issued in Austria until 30 June 2011 for the categories of key worker, unlimited and limited.

Residence cards issued in accordance with Directive 2004/38/EC

Residence cards to family members who are third country nationals, of EEA nationals who are exercising a Treaty Right in Malta in accordance with Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, are issued documentation in plastic card format, utilising the same features of the format stipulated in Regulation (EC) No 1030/2002. The title of the said document, which is in the English language, is ‘Residence Documentation’ and the space reserved for Type of Permit is left blank. The following text features in the space reserved for Remarks: ‘Residence Card of a Family Member of a Union Citizen — (Art 10 — Dir 2004/38)’.

Residence permits to other third country nationals

Residence permits issued to third country nationals (other than in accordance with Directive 2004/38/EC) are issued in the uniform format in accordance with Council Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third- country nationals.

In the blank space provided on each document for ‘Type of Permit’ the following categories are being utilised:

This document was issued between 2007-2009 by producer Bundesdruckerei and between 2009-2011 by the National Printing House, but still in use and valid, bearing in mind that the validity period for such a document is 5 years.

PERMIS DE ȘEDERE (Residence permit) – tipul de permis (type of permit):

PERMIS DE SEDERE TEMPORARA (Temporary residence permit)

This document was issued between June 2009 — September 2011 by the National Printing House. As a general rule, it was issued for 1 year, but there were situations allowing an exception to be made (for important trade activities) and therefore the permit was issued for up to 5 years. As a consequence, there are still in use and valid such documents for holders whose right of residence didn’t expired.

PERMIS DE ȘEDERE (Residence permit) – tipul de permis (type of permit):

PERMIS DE SEDERE TEMPORARA (Temporary residence permit)

This document was issued starting with September 2011 by National Printing House with a period of validity of 1 to 5 years, depending on the purpose for issuing the document.

The document was issued to foreigners to whom the right of residence was granted or extended or to foreigners granted with a form of protection into Romania, in accordance with the Law on asylum.

Under the heading ‘Observatii’ (remarks) the purpose of stay may be: ‘Angajare’ (employment), ‘Reintregire familie’ (family reunification), ‘Student’ (student), ‘Membru de familie cetatean roman’ (family member of a Romanian citizen), ‘Specializare’ (specialization), ‘Activitati religioase’ (religious activities), ‘Activitati profesionale’ (professional activities), ‘Acte comerciale’ (commerce acts), ‘Detasat’ (seconded), ‘Alte calitati studii’ (other studies-related qualities), ‘Activitate cercetare stiintifica’ (research activity), ‘Elev’ (student), ‘Student an pregatitor’ (preparatory year student), ‘Doctorand’ (PHD candidate), ‘Alte scopuri’ (other purposes) or ‘Fost posesor de Carte albastra a UE’ (former holder of EU Blue Card), followed by a personal identification number.

In case of documents issued to foreigners granted with a form of protection into Romania, under the heading ‘Observatii’ (remarks), the purpose of stay may be ‘Refugiat’ (refugee) — valid for 3 years, or ‘Protectie subsidiara’ (subsidiary protection — valid for 1 year), followed by a personal identification number.

CARTEA ALBASTRA A UE (EU Blue Card) — in accordance with Directive 2009/50

This document was issued starting with September 2011 by Imprimeria Nationala with a period of validity of up to 2 years, to third country nationals granted with the right of residence as highly qualified employees.

Under the heading ‘Observatii’ (remarks) the purpose of stay is ‘Inalt calificat’ (highly qualified), followed by a personal identification number.

5.

PERMIS DE ȘEDERE (Residence permit) – tipul de permis (type of permit):

REZIDENT PE TERMEN LUNG CE (Long term resident — EC)

This document was issued starting with 2011 to aliens to whom the long-term residence was granted or extended and has a validity of 5 (regular) to 10 years (for family members of Romanian citizens).

Under the heading ‘Observatii’ (remarks) there is inserted the personal identification number allotted to the foreigner.

This card-type document (one side printed) was issued between 2007-2011 (September) for 10 years/5 years in case of persons aged up to 14 years — to citizens of Member States of the European Union and the European Economic Area.

Mention should be made that the expiring date is not written on the card.

This card-type document (one side printed) was issued starting with September 2011 to EU/EEA/CH citizens, for a period of 10 years, except for persons aged up to 14 years (in this case, the validity period is 5 years).
