Base rates calculated in accordance with the Communication from the Commission on the revision of the method for setting the reference and discount rates (OJ C 14, 19.1.2008, p. 6). Depending on the use of the reference rate, the appropriate margins have still to be added as defined in this Communication. For the discount rate this means that a margin of 100 basis points has to be added. The Commission Regulation (EC) No 271/2008 of 30 January 2008 amending the Implementing Regulation (EC) No 794/2004 foresees that, unless otherwise provided for in a specific decision, the recovery rate will also be calculated by adding 100 basis points to the base rate.

I. Article 21(c) — Possibility for a Member State to provide by law for an obligation to hold or carry papers and documents
The Republic of Slovenia implemented that obligation in Article 7(1) of the Aliens Act (Uradni List RS (UL RS = Official Gazette of the Republic of Slovenia) No 50/2011), which provides that every alien must have a valid passport to enter, leave or stay in the Republic of Slovenia. The penalty for breaching that requirement is laid down in point 1 of Article 143 of the Act.
II. Article 21(d) — Obligation on third-country nationals to report their presence on the territory of any Member State
In Slovenia, the reporting requirement is laid down in Article 10 of the Residence Registration Act (UL RS No 59/2006 and amendments in UL RS No 111/2007). The arrival or departure of an alien staying in a tourist or hotel establishment must be reported by the accommodation provider within 12 hours of the alien's reception or departure. If aliens who do not have a residence permit or a residence registration certificate in the Republic of Slovenia do not stay with an accommodation provider, they must themselves report to the relevant police station within three days of crossing the national border and report their departure when they leave. The penalty for breaching that requirement is laid down in Article 24 of the Residence Registration Act.
III. Article 4(3) — Penalties for the unauthorised crossing of external borders at places other than border crossing points or at times other than the fixed opening hours
In Slovenia, a fine is provided for in Article 145 of the Aliens Act (UL RS No 50/2011). The fine laid down for the offence is between EUR 500 and EUR 1 200.
