Explanatory Notes to the Combined Nomenclature of the European Union

Pursuant to the second indent of Article 9(1)(a) of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), the Explanatory Notes to the Combined Nomenclature of the European Union (2) are hereby amended as follows:

In subheading ‘3907 60 20 Having a viscosity number of 78 ml/g or higher’, the last phrase is replaced by the following:

‘The viscosity number is calculated in accordance with ISO Standard 1628-5, using dichloroacetic acid as solvent.’

Explanatory Notes to the Combined Nomenclature of the European Union

Pursuant to the second indent of Article 9(1)(a) of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), the Explanatory Notes to the Combined Nomenclature of the European Union (2) are hereby amended as follows:

On page 101, after subheading ‘2402 10 00 Cigars, cheroots and cigarillos, containing tobacco’ the current text is replaced by the following:

‘Cigars, cheroots and cigarillos are rolls of tobacco, which can be smoked and, given their properties, are exclusively intended to be smoked as they are, having:

(a)

an outer wrapper of natural tobacco covering the product in full including, where appropriate, the filter (but without any further layer partially covering the outer wrapper), but not, in the case of tipped cigars, the tip; or

(b)

a threshed blend filler and an outer wrapper of the normal colour of a cigar, of reconstituted tobacco of subheading 2403 91 00, covering the product in full, including, where appropriate, the filter but not, in the case of tipped cigars, the tip, where the unit weight, not including filter or mouthpiece, is not less than 2,3 g and not more than 10 g, and the circumference over at least one third of the length is not less than 34 mm.

Providing that they meet the above criteria, products with a wrapper of reconstituted tobacco, which may consist partly of substances other than tobacco, are classified in this subheading.’

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Commission Decision 2009/705/EC of 14 September 2009 setting up a European Consumer Consultative Group (1), and in particular Article 4 thereof,

Whereas:

(1)

The mandate of the current members of the European Consumer Consultative Group expired on 28 February 2013.

(2)

Therefore, it is necessary to appoint new members and alternates for a three-year period, on the basis of the proposals put forward by the Member States and the European consumer organisations,

Commission notice on current State aid recovery interest rates and reference/discount rates for 28 Member States applicable as from 1 August 2013

(Published in accordance with Article 10 of Commission Regulation (EC) No 794/2004 of 21 April 2004 (OJ L 140, 30.4.2004, p. 1))

Base rates calculated in accordance with the Communication from the Commission on the revision of the method for setting the reference and discount rates (OJ C 14, 19.1.2008, p. 6). Depending on the use of the reference rate, the appropriate margins have still to be added as defined in this Communication. For the discount rate this means that a margin of 100 basis points has to be added. The Commission Regulation (EC) No 271/2008 of 30 January 2008 amending the Implementing Regulation (EC) No 794/2004 foresees that, unless otherwise provided for in a specific decision, the recovery rate will also be calculated by adding 100 basis points to the base rate.

NOTICE OF CLOSURE

By judgment of this 5th of July 2013 the District Court of and in Luxembourg, Commercial Section, has ordered the closure of the liquidation of BCCI SA and BCCI Holdings after verification that all the available assets have been distributed to the beneficiaries. Release was granted to the liquidator for the liquidation operations up to the 21st of May 2013. For those of the beneficiaries whose available data did not permit the liquidator to remit to them the liquidation dividends or part of these, the assets corresponding to the undistributed dividends have been remitted, for their account, to the Caisse de Consignation in Luxembourg, 3, rue de St Esprit, 1475 Luxembourg, — e-mail: BCCI@ts.etat.lu — tel. +352 24782777 — fax +352 467262 — where these funds will be held at their disposal during the legal retention period.
