COMMISSION RECOMMENDATION

of 26 July 2012

on the implementation of performance plans and targets in consistency with the European Union-wide performance targets adopted pursuant to Commission Regulation (EU) No 691/2010 and the preparation for the second performance reference period

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 100(2) thereof,

Having regard to Commission Regulation (EU) No 691/2010 laying down a performance scheme for air navigation services and network functions and amending Commission Regulation (EC) No 2096/2005 laying down common requirements for the provision of air navigation services (1),

Whereas:

Commission Regulation (EU) No 691/2010 provides for the adoption by the Member State(s) of national or functional airspace block performance plans including binding national targets or targets at the level of functional airspace blocks. It also provides that the Commission should assess whether national or functional airspace blocks targets are found consistent with, and adequately contributing to, the European Union-wide performance targets, which were adopted for the first performance reference period (from 2012 to 2014) by Commission Decision 2011/121/EU of 21 February 2011 (2).

A Performance Review Body was designated by the Commission on 29 July 2010, pursuant to Article 3 of Commission Regulation (EU) No 691/2010, to assist it in the implementation of the performance scheme.

Member States communicated their initial national plans to the Commission by 5 July 2011, including a plan jointly presented by Belgium and Luxembourg. Denmark and Sweden communicated a plan to the Commission on behalf of their functional airspace block (Danish-Swedish FAB). Belgium, France, Germany, Luxembourg and the Netherlands communicated a plan to the Commission on behalf of their functional airspace block (FABEC).

Pursuant to Article 13(3) of Commission Regulation (EU) No 691/2010, the Commission adopted on 23 November 2011 Commission Recommendation C(2011) 8329 final on the revision of targets contained in performance plans.

By 1 February 2012, all Member States except Cyprus notified the Commission in accordance with Article 13(4) of Commission Regulation (EU) No 691/2010 their adoption of revised performance plans and targets. By the date of adoption of this Recommendation, Cyprus had not notified the Commission that it had adopted a revised performance plan and targets.

The Commission, assisted by the Performance Review Body, assessed the revised national or functional airspace block performance plans and targets in accordance with the procedure referred to in Article 14(1) of Commission Regulation (EU) No 691/2010.

On the basis of this assessment, the Commission found that the targets contained in the national or functional airspace block performance plans are consistent with, and contribute adequately to, the European Union-wide targets. Member States were notified thereof pursuant to Article 14(2) of Commission Regulation (EU) No 691/2010.

While the overall assessment allowed the Commission to establish consistency and adequate contribution to the European Union-wide targets, the assessment showed that there are significant differences between the individual efforts made by Member States. In some instances, the Commission found that individual Member States could have further improved their performance targets.

In the light of the Commission’s assessment, this Recommendation covers the implementation of performance plans and targets in consistency with the European Union-wide performance targets and the preparation for the second performance reference period. To this end, the Commission will take into account the outcome of the first performance reference period in its assessment of performance plans and targets for the second performance reference period.

The Commission consulted the Member States concerned by the present Recommendation,

HAS ADOPTED THIS RECOMMENDATION:

1.

The aim of this Recommendation is to ensure the implementation of performance plans and targets in consistency with the European Union-wide performance targets adopted by Commission Decision 2011/121/EU for the first performance reference period, i.e. the years 2012 to 2014. It also aims to ensure that the outcome of the first performance reference period is duly taken into account when preparing for the second performance reference period.

Based on the recommendations contained in the assessment reports of the Performance Review Body and taking due consideration of the collective progress achieved by the Member States participating in the performance scheme, the Commission considers that:

(a)

Member States should ensure that their air navigation service providers amend their capacity plans to enable sufficient capacity to be provided in order to meet the targets of the performance plans adopted;

(b)

Member States should deliver the planned capacity, whilst remaining within the set cost-efficiency target for which the control of cost evolution will be particularly important;

(c)

Member States should report to the Commission on a yearly basis, as from the first performance reference period:

(i)

the difference between the determined costs and the actual costs, with a view to identifying the uncontrollable costs in particular and to scrutinise the development and relevance of these costs;

(ii)

the difference between the investments of the air navigation service providers recorded in the performance plans and the actual spending, as well as between the planned date of entry into operation of these investments and the actual situation;

(d)

Member States from the following functional airspace blocks: North European Functional Airspace Block (NEFAB), Baltic and Blue MED should communicate to the Commission by the end of 2012 at the latest, for information, aggregated performance targets highlighting the consistency at functional airspace block level with the European Union-wide targets as specified in Article 5(3) of Commission Regulation (EU) No 691/2010.

With a view to preparing for the second performance reference period, the Commission considers that:

(e)

the relative contribution of Member States to the attainment of the EU-wide performance targets during the first performance reference period should be taken into account when assessing the performance plans and targets for the second performance reference period, taking the year 2009 as the benchmark year;

(f)

Member States should anticipate that substantial efforts will be needed in order to achieve a cost-efficiency target for the second performance reference period well below the average rate in the first performance reference period. It is expected that this will entail major downward pressure on costs to European air navigation service providers consistent with the establishment of functional airspace blocks;

(g)

Member States should take into full consideration for the preparation of the second performance reference period the actual risk faced by the air navigation service providers and ensure that the return on equity more reasonably reflects this risk.

The Commission, in conjunction with the Performance Review Body, intends to follow up this Recommendation and other recommendations contained in the assessment report of the Performance Review Body through bilateral and/or multilateral contacts with the Member States.

5.

The Commission reminds the Member States of their obligation under Article 17(1) and (3) of Commission Regulation (EU) No 691/2010 to ensure ongoing monitoring and reporting of the implementation of the performance plans.

This Recommendation is addressed to the Member States.

Having regard to Council Regulation (EEC) No 337/75 of 10 February 1975 establishing the European Centre for the Development of Vocational Training, and in particular Article 4 thereof (1),

Call for expressions of interest for the position of member of the Management Board of the European Food safety Authority

Applications are invited for the position of member of the Management Board of the European Food Safety Authority (hereinafter referred to as ‘EFSA’ or ‘the Authority’) established by Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (1). The Authority is located in Parma, Italy.

A member of the Authority’s Management Board, appointed until 30 June 2014, has resigned and is to be replaced until the end of the term of office, i.e. until 30 June 2014.

THE EUROPEAN FOOD SAFETY AUTHORITY

The European Food Safety Authority (EFSA) is the keystone of the European Union system of risk assessment for food and feed safety. The Authority was established to provide scientific advice and support for Union legislation and policies in all fields that may have a direct or indirect impact on food and feed safety, as well as closely associated questions in the field of animal health and welfare and plant health. It provides independent information on these matters and communicates on risks. Its mission also includes provision of scientific advice in many areas of food and feed law and whenever Union legislation so requires, including new food technologies such as GMOs. The Authority is widely recognised as the accepted point of reference by virtue of its independence, the scientific quality of its opinions and public information, the transparency of its procedures and its diligence in performing its tasks. In addition to having its own specialist personnel, the Authority is supported by networks of competent organisations in the EU.

Legal background

In accordance with Article 25 of the above-mentioned Regulation, ‘the members of the Board shall be appointed in such a way as to secure the highest standards of competence, a broad range of relevant expertise and, consistent with these, the broadest possible geographic distribution within the Union’. In addition, four of the members of the Management Board ‘shall have their background in organisations representing consumers and other interests in the food chain’.

Furthermore, Recital 40 of the aforementioned Regulation stipulates that ‘Cooperation with Member States is also indispensable’ and Recital 41 states that ‘the Management Board should be appointed in such a way as to secure the highest standard of competence, a broad range of relevant expertise, for instance in management and in public administration, and the broadest possible geographic distribution within the Union. This should be facilitated by a rotation of the different countries of origin of the members of the Management Board without any post being reserved for nationals of any specific Member State.’

Role and operation of the Management Board

The responsibilities of the Management Board include, in particular:

general monitoring of the work of the Authority to ensure that it carries out its mission and performs the tasks assigned to it in accordance with its mandate and within a culture of independence and transparency,

the appointment of the Executive Director on the basis of a list of candidates drawn up by the Commission, and, if necessary, his or her dismissal,

the appointment of the members of the Scientific Committee and Panels, which are responsible for providing the scientific opinions of the Authority,

the adoption of annual and multi-annual programmes of work of the Authority and the general report of annual activities,

the adoption of the Authority’s internal rules and financial regulation.

The Board operates by formal meetings, private and public sessions, informal contacts between members and correspondence. EFSA papers, Board correspondence and private or informal sessions are held in English. Formal sessions include interpretation where members need this. The Board meets four to six times per year, predominantly in Parma.

Composition of the Management Board

The Management Board is composed of 14 members appointed by the Council in consultation with the European Parliament, plus a representative of the Commission, as stated in Article 25(1) of Regulation (EC) No 178/2002 (2). Four of the members shall have their background in organisations representing consumers and other interests in the food chain. The term of office for seven members of the current Management Board expires on 30 June 2014, in accordance with Council Decision 2010/C 171/05 (3). The term of office of the other seven members will end on 30 June 2016, in accordance with Council Decision 2012/C 192/01 (4).

This publication concerns the replacement of a member of EFSA's Management Board who has resigned; the term of office expires on 30 June 2014. This Call may also be used for the replacement of other members who are unable to complete their term of office.

The current membership of the Management Board includes only three members with a background in organisations representing consumers and other interests in the food chain. The Commission therefore encourages in particular applications from candidates having a background in organisations representing consumers or in organisations representing other interests in the food chain, it being noted that in the current composition there is one member with a background in organisations representing consumer interests and two members with a background in organisations representing other interests in the food chain.

Qualifications for the position

The members of the Management Board need the competence and collective expertise necessary to guide the Authority on matters relating to its mission, particularly to ensure:

1.

efficient delivery of scientific advice and support to meet the European Union’s needs in relation to its legislation and policies and its work in the public interest;

2.

application of sound principles of management and public administration (including human resources, legal and financial aspects);

3.

its functioning is guided by the principles of integrity, independence, transparency, ethical practices and a high level of scientific quality while maintaining the indispensable cooperation with Member States and reliability with its stakeholders;

4.

effective communication and information to the public on the Authority's scientific work;

5.

promotion of the necessary coherence between risk assessment, risk management and risk communication functions.

Candidates will need to demonstrate that they can contribute effectively to one or more of the areas listed above. Excellence in one of the specific areas will be taken into account in order to ensure a well-balanced, collective expertise in the Board. Candidates must have had at least 15 years of experience in one or more of these areas, including at least five years at a senior level. Candidates shall have at least five years of experience gained from work in connection with food and feed safety or other areas related to the Authority’s mission, notably in the field of animal health and welfare, protection of the environment (5), plant health and nutrition. On the basis of their experience, candidates shall demonstrate their ability to operate in a multilingual, multicultural and multidisciplinary environment. Candidates will be selected on the basis of comparative merits in relation to the above-mentioned criteria and, consistent with these, of the broadest possible geographic distribution within the Union.

Independence and declarations of commitment and interest

Board members will be nominated in a personal capacity. They will be required to make a declaration of commitment to act independently in the public interest and to make a declaration in relation to interests which might be considered prejudicial to their independence.

The independence of the Authority is crucial. It implies that the members of the Management Board observe the highest standard of ethical conduct. They are expected to act honestly, independently, impartially, with discretion and without regard to self-interest, and to avoid any situation liable to give rise to a personal conflict of interests. They are expected to be mindful of the importance of their duties and responsibilities, to take into account the public character of their function and to conduct themselves in a way that maintains and promotes the public's trust in the Authority.

Therefore, applicants are asked to complete a declaration of interest form and to confirm that they are willing to make a commitment to act independently of any external influence and to make an annual written declaration of interests and to declare at each meeting of the Management Board any interest which might be considered as prejudicial to their independence in relation to the items on the agenda.

Participation in the Board meetings

Members will need to make a high level of commitment to participate in the meetings of the Management Board. They are asked to indicate in the application form their availability to actively participate in the Management Board. It is estimated that the Management Board will meet four to six times per year. Members of the Board are not remunerated, but will be reimbursed for their normal travel and subsistence costs. They will also receive indemnities for each day spent at meetings in accordance with Article 12 of the Rules of Procedure of the Management Board of EFSA, which states that ‘members of the Management Board other than the Commission representative and those employed by a national public body or institution will receive a daily indemnity of EUR 385 for each meeting of the Board at which he/she is present’.

Members of the Management Board having a background in organisations representing consumers or other interests in the food chain

Candidates are asked to indicate and justify in their application if they wish to be considered as one of the four Board Members having a background in organisations representing consumers or other interests in the food chain. The justification should include details of their background in organisations representing consumers or other interests in the food chain.

Appointment and term of mandate

With the exception of the Commission representative, who is appointed by the Commission, members of the Management Board are appointed by the Council, in consultation with the European Parliament, from a list drawn up by the Commission on the basis of a call for expressions of interest. The term of office for the post referred to in this publication shall be until 30 June 2014 (expiration date of the term of office of the member who has resigned) and can be renewed once for a further term of four years. Applicants should note that the Commission’s list will be made public. Individuals on the Commission’s list who are not appointed may be invited to constitute a reserve list to be used in the event of the need to replace members who are unable to complete their mandate.

Nationality

In this call, the Commission will seek to establish a short-list that, consistent with appointments securing the highest standards of competence and a broad range of expertise, will enable the appointments also to meet the objective of ‘the broadest possible geographical distribution within the Union’ to be facilitated by ‘a rotation of the different countries of origin of the members’. It should be noted that members whose term of office ends on 30 June 2014 and 30 June 2016 respectively, already include nationals of Belgium, Cyprus, Czech Republic, Denmark, Finland, France, Italy, Poland, Portugal, Romania, Slovakia, Sweden, and United Kingdom. To date, the Board has not included nationals of Bulgaria, Estonia, Latvia, Lithuania, Luxembourg and Malta.

This Call is open to nationals of any EU Member State. Applicants must be nationals of an EU Member State.

Applications shall comply with the requirements set out below; otherwise they will not be taken into consideration:

After completion, the application form and the form on declaration of interests should be printed (if using the on-screen version), signed and dated by the applicant.

The application must include:

(a)

the completed application form (signed);

(b)

the completed form on declaration of interests (signed);

(c)

a CV of minimum 1,5 pages and maximum 3 pages.

The application form, the form on declaration of interests, the CV, and any supporting documents have to be written in an official language of the European Union. It would, however, be appreciated, without it being a requirement, if a summary of experience and other pertinent information in English could be provided in order to facilitate the selection procedure. All applications will be treated as confidential. Supporting documents must be submitted at a later stage, if requested.

The final deadline for submission of applications is 21 September 2012.

In the case of (b), a receipt must be obtained as proof of submission, signed and dated by the official in the Commission's central mail department who took delivery. The department is open from 8.00 to 17.00 Monday to Thursday, and from 8.00 to 16.00 on Fridays. It is closed on Saturdays, Sundays and Commission holidays.

Neither applications sent by electronic mail or fax, nor those sent directly to the European Food Safety Authority will be accepted.

In submitting an application, applicants accept the procedures and conditions as described in this Call and in the documents to which it refers. In compiling their application, applicants may under no circumstances refer to any documents of any type submitted in prior applications (example: photocopies of previous applications will not be accepted). Any misrepresentation in supplying the required information may lead to exclusion from the present Call.

All candidates applying to this call for expressions of interest will be informed about the outcome of the selection process.

Protection of personal data

The Commission will ensure that candidates’ personal data are processed as required by Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (OJ L 8, 12.1.2001, p. 1). This applies in particular to the confidentiality and security of such data.
