Call for proposals — OLAF/2012/D5/02

Technical support for national authorities’ use of special investigative tools and methods in the fight against fraud and corruption and technical support to strengthen inspections of containers and trucks at the EU's external borders, including the fight against cigarette smuggling and counterfeiting

1.   Objectives and description

This notice of call for proposals is based on Decision No 878/2007/EC of the European Parliament and of the Council of 23 July 2007 establishing a Community action programme to promote activities in the field of the protection of the Community's financial interests (Hercule II programme), OJ L 193 of 25 July 2007.

2.   Eligible applicants

This notice is aimed at national or regional administrations (‘applicants’) of a Member State or a country outside the European Union, as defined below, which promote the strengthening of European action to protect the European Union's financial interests.

Applicants from countries outside the European Union must reside in:

1.

acceding States;

2.

EFTA/EEA countries, in accordance with the conditions laid down in the EEA Agreement;

3.

candidate countries associated with the European Union on the basis of the conditions stipulated in the association agreements or their additional protocols on participation in European Union programmes concluded or to be concluded with those countries.

3.   Eligible actions

Eligible actions for technical assistance consist of:

technical support for national authorities' use of special investigative tools and methods in the fight against fraud and corruption, and

technical support to strengthen inspections of containers and trucks at the EU's external borders, including the fight against cigarette smuggling and counterfeiting.

The technical support should reinforce the Member States' capacities and logistics allocated to the technical operational support units in the fight against fraud, in particular the actions aimed at setting up, improving or upgrading of existing:

automated container-code recognition systems,

automated number-plate recognition systems,

technical equipment for electronic surveillance,

technical equipment for mobile surveillance,

technical equipment for the acquisition and analysis of digital evidence,

technical equipment for encrypted communications,

equipment and devices to detect smuggled and counterfeited goods on the basis of the scent characteristics of the smuggled and counterfeited goods.

4.   Award criteria

Each submitted eligible action will be assessed in the light of the following award criteria:

1.

consistency of the proposal with OLAF's objectives in technical assistance field;

2.

degree of preparation and organisation of the measure, and the clarity and precision of its objectives, design and planning;

3.

cost-effectiveness: the project's costs should be consisted with its objectives;

4.

cross-sector nature of the proposal;

5.

compatibility of the project with the work carried out or planned in connection with the EU's policy priorities for preventing fraud against the EU budget (prevention, information analysis, methods of cooperation, etc.);

6.

compatibility of the project with similar projects carried out in other Member States and carried out by other national law enforcement and customs agencies;

7.

possibility that the results can be used (e.g. through targeted distribution) to enhance cooperation and effectiveness in the field of the fight against fraud (‘mainstreaming’).

If several projects have equal merit in the light of these award criteria, funding priority may be given to, in descending order:

proposals that are international and deal with cooperation through the European Union,

proposals that make fair geographical distribution possible,

applicants who have not received grants in previous years for the same or a similar project.

5.   Budget

The total budget available is EUR 3 750 000.

A budget of EUR 2 000 000 is available for proposals submitted before the first deadline of 31 May 2012. The remainder and the balance of the first deadline, EUR 1 750 000, will be available for the proposals submitted before the second deadline of 13 September 2012.

The financial contribution will take the form of a grant. The financial contribution awarded will not exceed 50 % of the eligible costs.

The Commission reserves the right not to allocate all the funds available.

7.   Deadline for submission of applications

1.   Objectives and description

This notice of call for proposals is based on Decision No 878/2007/EC of the European Parliament and of the Council of 23 July 2007 establishing a Community action programme to promote activities in the field of the protection of the Community's financial interests (Hercule II programme). This call relates to the activities under Article 1(a) (b) of the Hercule II Decision, which consists of the organisation of training, seminars and conferences to support the fight against fraud, corruption and other illegal activities as well as the development and implementation of fraud prevention and detection policies.

2.   Eligible applicants

Proposals eligible for funding can be submitted by the following applicants:

all national or regional administrations of a Member State, an acceding country or a candidate country which promote the strengthening of the EU's actions in the field of the protection of the EU's financial interests,

all research and education institutes that have had legal personality for at least one year and are established and operating in a Member State or in a country outside the Union that promote the strengthening of the EU's action in protecting its financial interests,

all non-profit-making bodies that have had legal personality for at least one year and are legally established in a Member State or a country outside the Union that promote the strengthening of EU action to protect the EU's financial interests.

Applicants from countries outside the European Union must reside in:

1.

acceding States;

2.

EFTA/EEA countries, in accordance with the conditions laid down in the EEA Agreement;

3.

candidate countries associated with the European Union on the basis of the conditions stipulated in the association agreements or their additional protocols on participation in European Union programmes concluded or to be concluded with those countries.

3.   Eligible actions

The organisation of seminars and conferences to enhance the degree of development of the specific legal and judicial protection of the financial interests against fraud, by promoting:

studies in comparative law,

dissemination, including the publication, of scientific knowledge concerning the protection of the EU's financial interests,

publication and distribution of a scientific periodical on the protection of the European Union's financial interests,

the organisation of the annual meeting of the presidents of the associations for European criminal law and for the protection of the EU financial interests.

The activities are eligible for funding up to 90 % of the eligible costs. The total amount of assistance granted by the Commission OLAF for each project will not exceed:

EUR 50 000 for a one-day seminar; EUR 100 000 for a two-day seminar,

EUR 300 000 for a comparative law study,

EUR 25 000 for the dissemination of expertise,

EUR 60 000 for the publication and distribution of a periodical publication by the associations for one year,

EUR 45 000 for the meeting of presidents of the associations.

4.   Award criteria

The following award criteria will be used to examine the proposals:

1.

the consistency of the proposed activity in relation to the objectives of the programme;

2.

the complementarity of the proposed activity with other assisted activities;

3.

the feasibility of the proposed activity, i.e. the real possibility that it can be carried out using the proposed means;

4.

the cost-benefit ratio of the proposed activity;

5.

the added value of the proposed activity;

6.

the size of the public targeted by the proposed activity;

7.

the transnational and multidisciplinary aspects of the proposed activity;

8.

the geographic scope of the proposed activity.

If several projects have equal merit in the light of these award criteria, funding priority may be given to, in descending order:

proposals of a transnational and multidisciplinary character,

proposals allowing a fair geographical distribution,

applicants which have not already received a grant in previous years for a similar project.

5.   Budget

A budget of EUR 400 000 is available for proposals submitted before the first deadline of 31 May 2012. The remainder and the balance of the first deadline, EUR 300 000, will be available for the proposals submitted before the second deadline of 1 October 2012.

The financial contribution will take the form of a grant.

The Commission reserves the right not to allocate all the funds available.

Support for the networking of cinemas screening European films — ‘Cinema network’

1.   Objectives and description

This notice of a call for proposals is based on Decision No 1718/2006/EC of the European Parliament and of the Council of 15 November 2006 concerning the implementation of a programme of support for the European audiovisual sector (MEDIA 2007).

The specific objectives are:

to improve the circulation of non-national European films on the European and international markets by incentive measures for export, distribution on any medium and cinema exhibition,

to encourage the screening of non-national European films on the European market, in particular by supporting the coordination of a cinema network.

The call for proposals EACEA/17/12 offers a two-year framework partnership agreement.

2.   Eligible applicants

This notice is aimed at European cinemas grouped in a network whose activities contribute to the above objectives.

The coordinator (the network) and the co-beneficiaries (the cinemas) must be owned and continue to be owned, whether directly or by majority participation, by nationals of countries participating in the MEDIA programme and registered in one of these countries:

the 27 countries of the European Union,

the EEA countries, Croatia and Switzerland,

Bosnia and Herzegovina (under the condition of the finalisation of the negotiation process and the formalisation of the participation of this country to the MEDIA programme).

Co-beneficiaries:

European independent theatres shall be eligible as co-beneficiaries.

A European independent theatre is a company, association or organisation with a single or several screens based in countries participating in the MEDIA programme and which operates under the same company name. The screening of films should be the principal activity of the applicant or division of the applicant organisation.

Only those European independent theatres shall be eligible:

that are first run cinemas (programming European films in first run, within a maximum period of 12 months after the first national release). Those cinemas which dedicate a maximum of 30 % of their screenings to retrospectives or re-releases may be eligible,

that have been open to the public for a minimum of six months,

that possess a ticketing and entry declaration system;

that have at least one screen and 70 seats,

that had at least 300 screenings per year for single-screen cinemas and 520 screenings per year for multi-screen cinemas (cinemas in operation for a period of at least 6 months per year), and at least 30 screenings per month for summer/open air cinemas (cinemas in operation for less than 6 months per year),

that had at least 20 000 spectators in the previous 12 months.

In order to meet, as a group, the above eligibility criteria, different cinemas may be allowed to pool their results. The circumstances under which this may occur must be clearly defined by the applicant in its application and in the accompanying draft guidelines.

Coordinator:

Cinema networks shall be eligible as coordinator.

The cinema network is defined as a group of cinemas developing, through the medium of a legally constituted coordination entity, joint activities in the area of screening and promoting European films. In particular, this coordination entity shall ensure the operation of a communication and information system between the cinemas.

To be eligible, the cinema network must represent at least 100 cinemas situated in at least 20 countries participating in the MEDIA programme.

3.   Eligible actions

The following actions and their activities, taking place in the MEDIA countries, are eligible:

actions aiming at promoting and screening European films,

educational activities aiming at raising awareness among young cinema-goers,

activities aiming at encouraging and accompanying the introduction of digital cinema among exhibitors,

networking activities: information, animation and communication.

4.   Award criteria

Points will be allocated out of a total of 100 on the basis of the following weighting:

5.   Budget

The call offers a two-year partnership agreement. The maximum budget available under this call for proposals is EUR 10 800 000 for the first year.

Only one beneficiary will be selected.

The financial contribution awarded is a subsidy. The financial support cannot exceed 40 % of the total eligible costs.

Notice of the impending expiry of certain anti-dumping measures

1.   As provided for in Article 11(2) of Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community (1), the Commission gives notice that, unless a review is initiated in accordance with the following procedure, the anti-dumping measures mentioned below will expire on the date mentioned in the table below.

2.   Procedure

Union producers may lodge a written request for a review. This request must contain sufficient evidence that the expiry of the measures would be likely to result in a continuation or recurrence of dumping and injury.

Should the Commission decide to review the measures concerned, importers, exporters, representatives of the exporting country and Union producers will then be provided with the opportunity to amplify, rebut or comment on the matters set out in the review request.

3.   Time limit

Union producers may submit a written request for a review on the above basis, to reach the European Commission, Directorate-General for Trade (Unit H-1), N-105 4/92, 1049 Brussels, Belgium (2) at any time from the date of the publication of the present notice but no later than three months before the date mentioned in the table below.

4.   This notice is published in accordance with Article 11(2) of Regulation (EC) No 1225/2009.

On 25 April 2012, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Vilmorin & Cie SA (‘VCO’, France) controlled by Groupe Limagrain Holding (‘Limagrain’, France) and KWS SAAT AG (‘KWS’, Germany) acquire, within the meaning of Article 3(1)(b) of the Merger Regulation, joint control of Genective SA (‘Genective’, France) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Limagrain: agro-industrial activities including field seeds, vegetable seeds and cereal products,

for VCO: research, breeding, production and sale of seeds to the professional sector,

for KWS: research, breeding, production and sales of seed for agricultural crops,

for Genective: research and development of pre-commercial events containing one or more transgenic traits and licensing such these events.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the EC Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the EC Merger Regulation (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
