COMMISSION DECISION
of 19 July 2010
concerning the financing for the year 2010 of activities in the veterinary field related to the European Union's information policy, support of international organisations, disease notification and computerisation of veterinary procedures

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Decision 2009/470/EC of 25 May 2009 on expenditure in the veterinary field (1), and in particular Articles 20, 23, 35(2) and 36(2) thereof,
Whereas:

(1) |
In accordance with Article 75 of the Financial Regulation and Article 90(1) of the Implementing Rules, the commitment of expenditure from the budget of the European Union shall be preceded by a financing decision setting out the essential elements of the action involving expenditure and adopted by the institution or the authorities to which powers have been delegated by the institution. |

(2) |
In accordance with Article 110 of the Financial Regulation, an annual work programme must be adopted for grants. |
|
(3) |
It is necessary to lay down a work programme for the activities of the European Union in the veterinary field related to information policy, support of international organisations, disease notification and computerisation of veterinary procedures. As the work programme in the annexes is a sufficiently detailed framework in the meaning of Article 90(2) and (3) of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) (hereinafter referred to as the ‘Implementing Rules’), the present decision constitutes a financing decision for the expenditure provided for in the work programme for grants and procurement. |

Article 19 of Decision 2009/470/EC rules that the Union shall make a financial contribution to the establishment of an information policy in the field of animal health, animal welfare and food safety in products of animal origin including the performance of studies necessary for the preparation and development of legislation in the field of animal welfare. |

(5) |
The Commission has committed itself to submit to the European Parliament and to the Council reports on the various stunning methods for poultry (Article 27(3) of Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing (3)), the welfare of animals being transported and on the trade flows of live animals within the enlarged Union (Article 32 of Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and related operations and amending Directives 64/432/EEC and 93/119/EC and Regulation (EC) No 1255/97 (4)) and the influence of genetic parameters on identified deficiencies resulting in poor welfare of chickens (Article 6(1) of Council Directive 2007/43/EC of 28 June 2007 laying down minimum rules for the protection of chickens kept for meat production (5)). |

The Commission has committed itself to improve information of stakeholders and the general public on animal welfare standards with the Community Action Plan on Animal Welfare adopted in 2006 (6). |

(7) |
The Commission has committed itself to present a report to the European Parliament and the Council on cloning for food production by the end of 2010. The report will consider all aspects of cloning for food production in the context of existing legislation and will point out possible options. Data on the current situation of the use of the technology and on the effects on the health and welfare of the animals are needed. |
|
(8) |
The Union should exploit the ‘World Veterinary Year 2011’ to promote its animal health policy and the importance of the role of the veterinary profession in safeguarding public health, animal health and animal welfare. |
|
(9) |
Article 19 paragraph (a)(i) of Decision 2009/470/EC provides that the Union shall make a financial contribution to the gathering and storing of all information relating to Union legislation in the field of animal health, animal welfare and food safety in products of animal origin. |
|
(10) |
A financial contribution is required to make the interactive database of veterinary legislation (Vetlex) established by the Directorate-General for Enlargement for candidate countries, potential candidate countries and countries under the European Neighbourhood Policy initiative available to all Member States. |
|
(11) |
Pursuant to Article 22 of Decision 2009/470/EC, the Union may undertake, or assist the Member States or international organisations in undertaking, the technical and scientific measures necessary for the development of Union veterinary legislation and for the development of veterinary education or training. |
|
(12) |
The World Organisation for Animal Health (OIE) is an intergovernmental organisation responsible for improving animal health worldwide. The OIE will organise a global conference on veterinary legislation from 6 to 8 December 2010. The OIE has realised a first study on veterinary legislation, and intends to enlarge the discussion with all its members in the global conference. It is important that the EU approach to veterinary legislation be shared with all member countries of the OIE and that the EU actively supports this Conference in order to promote the Union's animal health policy at the occasion. |

Under Article 168(1)(c) of the Implementing Rules, grants may be awarded without a call for proposals in the case of bodies with a de facto monopoly. As standard setting body under the WTO/SPS Agreement, and as the intergovernmental organisation responsible for improving animal health worldwide the OIE has a de facto monopoly in this sector hence a call for proposals is not required in order for the EU to contribute to the organisation of the global conference on veterinary legislation. |

(14) |
Article 35(1) of Decision 2009/470/EC allows for Union financial assistance for the introduction of systems to identify animals and notify diseases. |
|
(15) |
A Union financial contribution should be granted for the management of and for improving the Animal Disease Notification System (ADNS), based on Commission Decision 2005/176/EC of 1 March 2005 laying down the codified form and the codes for the notification of animal diseases pursuant to Council Directive 82/894/EEC (7). |
|
(16) |
The Commission has committed itself to improvement of EU preparedness against major threats to animal health including the strengthening of the Union's rapid response network in the Communication from the Commission to the Council, the European Parliament, the Economic and Social Committee and the Committee of the Regions on a new Animal Health Strategy for the EU (2007-2013). |
|
(17) |
Article 36 of Decision 2009/470/EC provides for Union financial contribution for certain computerised systems used in intra Union trade and imports. |
|
(18) |
It is necessary to continue to provide financial contributions for hosting, management and maintenance of the integrated computerised veterinary system Traces (Trade Control and Expert System) introduced by Commission Decision 2003/24/EC of 30 December 2002 concerning the development of an integrated computerised veterinary system (8). |
|
(19) |
This financing decision may also cover the payment of interest due for late payment on the basis of Articles 83 of the Financial Regulation and 106(5) of the Implementing Rules. |
|
(20) |
For the application of this decision, it is appropriate to define the term ‘substantial change’ within the meaning of Article 90(4) of the Implementing Rules. |
|
(21) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS DECIDED AS FOLLOWS:
Article 1
The annual work programme for the implementation of Articles 20, 23, 35(2) and 36(2) of Decision 2009/470/EC, as set out in Annex I and II, is hereby adopted.
The work programme constitutes a financing decision in the meaning of Article 75 of the Financial Regulation.
Article 2
The maximum contribution authorised by this Decision for the implementation of the Programme is set at EUR 4 935 000 to be financed from the following lines of the General Budget of the European Union for 2010:

These appropriations may also cover interest due for late payment.
Article 3
1. The authorising officer may adopt any changes to this Decision which are not considered substantial within the meaning of Article 90(4) of Regulation (EC, Euratom) No 2342/2002, in accordance with the principles of sound financial management and of proportionality.
2. Cumulated changes of the allocations to the actions covered by the work programme not exceeding 10 % of the maximum contribution provided for in Article 2 of this Decision shall not be considered to be substantial within the meaning of Article 90(4) of Regulation (EC, Euratom) No 2342/2002, provided that they do not significantly affect the nature and objective of the work programme.

The Vetlex database is an existing interactive database of all veterinary legislation that is at the moment accessible to Candidate Countries, potential Candidate Countries and countries under the European Neighbourhood Policy initiative. It is kept up to date within 24 hours of new legislation being published and contains the consolidated versions of the concerned legislation. It is managed by an outside company via a contract that they have with DG Enlargement.
The funds to pay for this come for the moment from the budget of DG Enlargement and therefore access to the Vetlex database can not be made available to Member States.
The contribution foreseen will enable Vetlex to be made more widely available to administrators in Member States.

ANNEX II
Programming document detailing joint communication actions as referred to in the Memorandum of Understanding between the European Commission and the World Organisation for Animal Health (OIE) concerning common Communication actions for 2011 (1)
1. Production of video clips
Six (6) video clips on animal health issues relating to for example, the day-to-day work of veterinarians with large animals on farms, trade in live animals and animal products, food safety, animal welfare, the control of zoonoses, crisis management, and food security will be produced by a contractor identified by the Commission.
The Commission will finance the production and the dissemination of the video clips through targeted websites such as EU Tube, and also possibly through TV channels in the EU Member States.
In return, the OIE will ensure the free supply of a large duration of relevant raw footage to be used by the contractor nominated by the Commission, exclusively for the production of the six video clips. The OIE may eventually disseminate the video clips in any other OIE Member Countries through OIE channels.
It is agreed that each editing phase of the spots will be supervised by both partners.
The Commission will own the copyright of the final versions of the video clips, but will seek approval from the OIE concerning the further duplication, modification and reuse modalities of parts or the total of the material produced by the contractor.
The OIE will be authorised by the Commission to use the video clips freely, but will have to provide information concerning the dissemination of the video clips to the Commission.
2. EU Veterinary Week 2011 and design of banners
A visual identity for the EU Veterinary Week 2011, which will incorporate elements of the World Veterinary Year Campaign 2011 (Vet2011) is to be developed for use on a number of related communication tools.
It is agreed that this visual identity will integrate or adapt elements of the current design of the existing Vet2011 design. Any substantial modification to the existing logo Vet2011 should be submitted for approval both to the Director-General of the OIE, Dr Bernard Vallat, and to the President of the Vet2011 Animation and Coordination Committee, Prof. Jean-François Chary.
In the framework of Vet2011, the Commission intends to use the visual identity developed to create banners, including both the EU and the OIE logos. One of these banners is to be displayed on the Berlaymont building during the week 17 to 24 January 2011. In addition, the same banner in a smaller format will be developed and produced by the Commission for display at OIE Headquarters, thus marking the beginning of the World Veterinary Year. The OIE will ensure that the smaller banner is hung and dismounted at the chosen location. Except for the Berlaymont site, the Commission will not cover the costs linked to their hanging and dismounting. The display of these banners at several locations will increase the visibility of the work of the Commission and of the OIE.
3. Web-based photographic competition
In the framework of the World Veterinary Year Campaign 2011, the development of a web-based photographic competition is planned. This website should allow the general public from the EU and worldwide to take part in a photographic competition by uploading their photos on the server as well as their contact details. It is envisaged that the photographic competition will include different categories, both concerning the participants and the themes for the photographs. The design of the website should take this into account and should incorporate the visual identity produced for the campaign and the logos of the EU and the OIE.
The project will be financed by the Commission and it is planned that the shortlisted photographs will be announced during the EU Veterinary Week 2011 planned for 16 to 22 May 2011. In return, the OIE will promote the competition and ensure it plays an active role in the selection of the winning photographs and their publication on external stands, in particular at the location of the 79th General Session in Paris as well as at the OIE Headquarters in Paris.
4. Stands at Grüne Woche (Berlin)/Salon de l’Agriculture (Paris)
The Commission and the OIE agree that Vet2011 should be celebrated as a momentum at the two biggest European animals and food trade fairs in Germany and France respectively in January and February 2011.
It is agreed that the Commission will finance the production of the stand's structures and relevant printed communication material, as well as giveaways. In return, the OIE agrees to negotiate with the relevant authorities the free rental of the stands/locations at the fairs. It is agreed that representatives from both the Commission and the OIE will be present on the joint stand during the fairs.

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Whereas:

(1) |
One of the main objectives of the Union is to ensure the proper functioning of the internal market, of which financial services are an essential part. |
|
(2) |
In accordance with the better regulation principles, the Commission attaches great importance to ensuring proportionate user representation at all stages of the development of its policy on financial services. For this purpose, the Commission needs to call upon the expertise of specialists in an advisory body. |
|
(3) |
The Commission Communication of 4 March 2009‘Driving European recovery’ (1) stated that the Commission will ensure that the voice of European investors is much more strongly heard on all financial issues. |
|
(4) |
In 2004 the Commission services established a forum of financial services users (FIN-USE) in order to secure expert input from the user perspective into the European Commission’s financial services policymaking so that a more active and informed involvement of users could be achieved. The second three-year term of this group will come to an end in June 2010. |
|

In 2006 the Commission services established the Financial Services Consumer Group (FSCG) as a sub-group of the existing European Consumer Consultative Group (ECCG) with the aim of bringing together representatives of consumer organisations from each of the Member States in order to discuss financial services policies and proposals of particular relevance to consumers. Its initial three-year term came to an end in November 2009. |
|

FIN-USE has played an important role in conveying the perspective of users of financial services by providing quality advice to the Commission. FIN-USE members have also engaged in dialogues with a number of stakeholders, contributing usefully to disseminating the views of users of financial services and thereby improving the overall quality of the decision-making process. |
|
(7) |
The FSCG has been a useful channel of communication with national and European consumer associations and has drawn attention to specific problems of concern to consumers. |
|
(8) |
There is a need to further coordinate the input of financial services users and to increase the capacity of consumers and retail investors, that is natural persons investing outside their trade, business or profession, to contribute to its initiatives in this area. This decision has been taken in the light of the experience acquired by the Commission as regards the operation of FIN-USE and the FSCG; the external evaluations of the workings of both bodies, and the relevance of EU financial services policies to the lives of citizens. |
|
(9) |
It is therefore necessary to set up a group of financial services users and to define its tasks, composition and structure in a formal legal act. |
|
(10) |
The group should be composed of financial services experts such as individuals appointed to represent the interests of consumers, retail investors or micro-enterprises, but also individual experts having particular expertise in users’ needs and priorities in the field of financial services, for example lawyers representing consumers, employee or worker representatives or academics. The group should represent an adequate geographical coverage within the Union. |
|
(11) |
The group should assist the Commission in the preparation and monitoring of financial services policies having a potential impact on users of financial services. The group should secure high quality expert input to the Commission’s financial services initiatives from representatives of financial services users and from individual financial services experts. |
|
(12) |
With a view to achieving the aims of further coordinating the input of financial services users and increasing the capacity of consumers, retail investors and micro-enterprises to contribute to its financial services initiatives, it is appropriate to provide adequate financial support to the group, in the form of annual fees for its members, reimbursement of travel and accommodation expenses, and a designated budget for research. |

(13) |
Having regard to the need to attract the best expertise in the very complex field of financial services among stakeholders who are not financial sector professionals, and having regard to the remuneration of members of comparable bodies at national level and the annual fees of FIN-USE and their periodic revision, the members of the group should receive an annual fee to ensure that they are adequately resourced to provide the required substantial input to the Commission, consisting of a workload of approximately 35 days, in addition to their participation in the meetings of the group. |
|
(14) |
Considering that external research might be necessary to enable members to fulfil the tasks of the group, the Commission may grant, upon request from the group, a research budget for that purpose if it considers such request justified. |
|
(15) |
Rules on disclosure of information by members of the group should be laid down, without prejudice to the rules on security annexed to the Commission’s Rules of Procedure by Decision 2001/844/EC, ECSC, Euratom (2). |
|
(16) |
Personal data relating to members of the group should be processed in accordance with Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (3), |
HAS DECIDED AS FOLLOWS:
Article 1
Financial Services User Group
A Financial Services User Group, hereinafter referred to as ‘the group’, is hereby set up.
Article 2
Tasks
1. The group’s tasks shall be:
|
(a) |
to advise the Commission in the context of the preparation of legislative acts or other policy initiatives affecting users of financial services, including consumers, retail investors and micro-enterprises; |
|
(b) |
to provide insight, opinion and advice concerning the practical implementation of such policies; |
|
(c) |
to proactively seek to identify key financial services issues which affect users of financial services; |
|
(d) |
where appropriate, and in agreement with the Commission, to liaise with and provide information to financial services user representatives and representative bodies at the European Union and national level, as well as to other consultative groups administered by the Commission, such as the European Consumer Consultative Group, the Payment Systems Market Expert Group, the European Securities Markets Expert Group and the Expert Group on Financial Education. |
2. The issues on which the group’s opinion may be sought will encompass the full range of financial services policy areas including, but not limited to, retail banking, consumer and mortgage credit, payment means and systems, life and non-life insurance, pensions, retail investment products, securities markets and financial supervision.
Article 3
Membership — Appointment
1. The group shall be composed of 20 members, of which at least 11 shall represent the interests of consumers and retail investors as specified in paragraph 2(a) and (b) of this Article.
2. The Commission shall appoint the members of the group following a call for expressions of interest. Members shall be:

(a) |
individuals appointed to represent the interests of consumers; or |
|
(b) |
individuals appointed to represent the interests of retail investors; or |
|
(c) |
individuals appointed to represent the interests of micro-enterprises, as defined in Commission Recommendation 2003/361/EC (4), but excluding enterprises whose main business activity is the provision of financial services; or |
|
(d) |
individual experts with expertise in financial services from the perspective of the financial services user, excluding individuals currently employed by or acting on behalf of the financial services industry. |
3. Members selected on the basis of paragraph 2(d) of this Article shall be appointed in a personal capacity.
4. The term of office of the members of the group shall be three years. The term may be renewed twice.
5. Members who are no longer capable of contributing effectively to the group’s deliberations, who resign or who do not comply with the conditions set out in paragraphs 2 and 3 of this Article or Article 339 of the Treaty may be removed or replaced for the remainder of their term of office.
6. Members appointed in a personal capacity shall each year sign an undertaking to act in the public interest and a declaration indicating the absence or existence of any interest which may undermine their objectivity.
7. The names of the members shall be published in the Register of Expert Groups of the Commission and on the relevant Commission websites.
8. The names of members shall be collected, processed and published in accordance with Regulation (EC) No 45/2001.
Article 4
Operation
1. The group shall elect a chairperson and a vice-chairperson from amongst the members by a simple majority. Both chairperson and vice-chairperson shall be renewed each year. They can both be reappointed.
2. In agreement with the Commission, subgroups may be set up to examine specific issues under the terms of reference of the group. Such subgroups shall be dissolved as soon as their mandates are fulfilled.
3. In agreement with the Commission, the group may invite experts with specific knowledge to participate in the work of the group and of the subgroups.
4. Members of the group and their representatives, as well as invited experts shall comply with the obligations of professional secrecy laid down by the Treaties and their implementing rules, as well as with the Commission’s rules on security regarding the protection of EU classified information, laid down in the Annex to Decision 2001/844/EC, ECSC, Euratom. Should they fail to respect these obligations, the Commission may take all appropriate measures.
5. The group shall meet approximately eight times a year, normally on Commission premises in Brussels, in the form and according to the timetable determined by the Commission. Upon request of the members, one meeting per year may be held in another Member State.
6. The Commission shall provide secretarial services for the group. Commission officials may attend meetings of the group and its subgroups.
7. The group shall adopt its rules of procedure on the basis of the standard rules of procedure for expert groups.
8. The Commission may publish on the Internet, in the original language of the document, any written output of the group.
Article 5
Remuneration and expenses
1. The members of the group shall be remunerated with an annual fee of EUR 10 000 for their services. The level of the fee will be reviewed after three years.
2. Expenses shall be reimbursed within the limits of the annual budget allocated to the group by the responsible Commission services.
3. The Commission shall reimburse travel and, where appropriate, subsistence expenses for members in connection with the group’s activities in accordance with the provisions in force at the Commission. Where possible, Commission services may reimburse travel and, where appropriate, subsistence expenses of experts invited on an ad hoc basis, provided that the prior approval of the Commission services has been obtained, and in line with the Commission’s rules on the compensation of external experts.
4. Where appropriate, the group may ask for external research to be carried out to enable it to fulfil its tasks. If the Commission considers such request(s) justified, it may decide to make available for this purpose a portion of its annual research budget up to a maximum of EUR 150 000. This budget shall be managed by the Commission in full compliance with its relevant rules and procedures.

MEDIA Mundus — Call for proposals 2011

1. Objectives
This notice of call for proposals is based on Decision No 1041/2009/EC of the European Parliament and of the Council of 21 October 2009 establishing an audiovisual cooperation programme with professionals from third countries (MEDIA Mundus 2011–13) (1).
The aims of the programme are to increase the competitiveness of the European audiovisual industry, to enable Europe to play its cultural and political role in the world more effectively and to increase consumer choice and cultural diversity. The programme will seek to improve access to third-country markets and to build trust and long-term working relationships.
The MEDIA Mundus programme supports cooperation projects between European professionals and professionals from third countries, to the mutual benefit of the European audiovisual sector and that of third countries.
2. Eligible actions
The actions outlined are:
— Action 1 — Support for training: this action aims at strengthening the skills of European and third-country professionals:
Option 1 supports the inclusion of students/professionals and teachers from non-EU countries in initial or continuous training schemes supported by the MEDIA 2007 programme (2),
Option 2 supports the creation of a continuous training scheme specific to MEDIA Mundus.
— Action 2 — Support for market access: this action supports projects to promote access to international markets for audiovisual works. These projects concern the development and/or pre-production phases (for example international co-production markets) and activities downstream (events facilitating international sales of the works).
— Action 3 — Support for distribution and circulation: this action aims at encouraging distribution, promotion, screening and diffusion of European works in third-country markets and of audiovisual works from third countries in Europe under optimum conditions.
— Action 4 — Cross-over activities: this action aims at supporting projects of a cross-cutting nature, i.e. touching upon several priorities of this programme, e.g. trainings with subsequent pitching events at co-production meetings.
This call covers projects starting between 1 February 2011 and 31 December 2011 and projects must be completed by 31 March 2012 at the latest. Preparatory costs for the projects are eligible at the earliest as of 1 January 2011.
3. Eligible candidates
Projects to be funded under MEDIA Mundus must:

Be proposed and implemented jointly by European and third-country professionals in order to qualify for funding under the programme. |
|
— |
Seek to promote international networking. To this end, except for projects submitted under Action 1 — Option 1, each project must be driven and implemented by a group meeting three criteria:

4. Award criteria
Points will be allocated to eligible applications out of a total of 100 on the basis of the following weighting:

quality of the content of the activity (maximum: 25 points, minimum threshold to be attained: 50 %), |
|
— |
project management (maximum: 25 points, minimum threshold to be attained: 50 %), |
|
— |
international and European dimension and added value (maximum: 30 points, minimum threshold to be attained: 50 %), |
|
— |
impact (maximum: 20 points, minimum threshold to be attained: 50 %). |
5. Budget for projects
The amount available under this call for proposals is EUR 4 939 835. The financial support from the Commission cannot exceed 50 %, 60 % or 70 % of the total eligible costs, depending on the nature of the activity.
The financial contribution will be awarded in the form of a grant.
