1.   Resumption of the session

The sitting opened at 14.35.

2.   Statements by the President

The President made a statement on the terrorist attacks of 29 March 2010 on the Moscow underground and expressed his condolences to the victims' families on Parliament's behalf. He added that the European Parliament condemned all terrorist attacks.

The President made a statement regarding the 70th anniversary of the massacre of Polish prisoners by Soviet forces at Katyń.

The President announced that the Commission would be represented by Maroš Šefčovič (Vice-President of the Commission) at that day's debate as José Manuel Barroso (President of the Commission) was unable to attend.

3.   Approval of the minutes of the previous sitting

The minutes of the previous sitting were approved.

8.   Fight against breast cancer in the European Union (written declaration)

Written Declaration 0071/2009, submitted by Elizabeth Lynne, Michail Tremopoulos, Lívia Járóka and Lidia Joanna Geringer de Oedenberg, on the fight against breast cancer in the European Union, had been signed by the majority of Parliament's component Members. 9.   Parliamentary immunity

During the plenary sitting of 17 December 2009 (minutes of 17.12.2009, item 15), Parliament had referred a request for the waiver of the parliamentary immunity of Marek Henryk Migalski, submitted by a lawyer on behalf of a Polish citizen, to the Committee on Legal Affairs.

In a letter of 5 March 2010, the Chair of the Committee on Legal Affairs informed the President of Parliament that, in the light of Parliament's resolution of 24 April 2009 on parliamentary immunity in Poland, the Committee had deemed the request inadmissible.

10.   Composition of committees and delegations

11.   Verification of credentials

At its meeting on 22 March 2010, the Committee on Legal Affairs had verified the credentials of Constance Le Grip and Jan Kozłowski, in accordance with Rule 3(3) and (4) of the Rules of Procedure, and recommended unanimously that the mandate of Constance Le Grip be declared valid with effect from 10 February 2010 and that of Jan Kozłowski be declared valid with effect from 4 March 2010.

13.   Statements by the President

The President paid tribute to the victims of the railway accident of 12 April 2010 in Italy, and to their families.

He thanked those who had attended the commemorative sitting of 14 April 2010, which had been held in solidarity with the Polish people.

The President referred to the exceptional circumstances in which that part-session was being held as well as to the fact that it had proven impossible for certain Members to be present in Strasbourg. He presented a proposal by the Conference of Presidents to change the order of business. Among other things, under that proposal, there would be no sitting on Thursday, and no votes in plenary or in committee during the entire part-session. He added that Members could sign the attendance register on Thursday and Friday.

The President announced that he had received, on 7 April 2010, a letter from Nigel Farage (Co-President of the EFD Group), in which Mr Farage referred to Rule 6 of the rules of Procedure and made a complaint about the treatment of parliamentary immunities in Europe. The complaint had been forwarded to the JURI Committee.

On 16 July 2009, the President of the European Parliament had received a request for the waiver of the parliamentary immunity of Sławomir Witold Nitras, submitted by a Polish citizen through his lawyer.

Having been asked his opinion on the admissibility of this request, the Chair of the Committee on Legal Affairs had informed the President of Parliament by letter of 17 April 2010 that, with respect to the Parliament resolution of 24 April 2009 on parliamentary immunity in Poland, this request must be deemed inadmissible.

Report on discharge in respect of the implementation of the budget of the SESAR Joint Undertaking for the financial year 2008 [SEC(2009)1089 - C7-0262/2009- 2009/2188(DEC)] - Committee on Budgetary Control. Rapporteur: Véronique Mathieu (A7-0077/2010)

The following spoke: Jean-Pierre Audy, who wanted to know the reasons for the absence of the European Court of Auditors and the Council from the debate that was to be held.

(The sitting was suspended at 9.10 and resumed at 9.20.)

The President said that it was not essential that the Council attend the debate, but was surprised that no representatives from the Court of Auditors were present. He nevertheless asked the Members to start the discussions.
