Programm A der Förderrichtlinie Modernisierung von Mietwohnungen 2010.

Hinweis: Die Berichtspflicht bezieht sich ausschließlich auf das Programm A (Die Programme B bis D unterfallen der Entscheidung der KOM vom 28.11.2005 über die Anwendung von Artikel 86 Absatz 2EG-Vertrag auf staatliche Beihilfen, die bestimmten mit der Erbringung von Dienstleistungen von allgemeinem wirtschaftlichem Interesse betrauten Unternehmen als Ausgleich gewährt werden - bekannt gegeben unter Aktenzeichen K(2005) 2673) - 2005/842/EG – (Freistellungsentscheidung). Die Programme B und C unterfallen als soziale Wohnraumförderung Artikel 2 Abs. 1 b 2.Alt. der Freistellungsentscheidung. Bei dem auf bundesgesetzlicher Rechtsgrundlage (§ 164 a Baugesetzbuchmit § 177 Baugesetzbuch) statuierten Programm D finden zusätzlich auf Landesebene - inhaltlich und von der Wirkung her - die wichtigsten Elemente der Sozialen Wohnraumförderung wie Einkommensgrenzen, Mietpreis- und Belegungsbindungen(entsprechende) Anwendung. Das Programm D wurde daher mit Statuierung der Förderichtlinie auch als sozialer Wohnungsbau im Sinne der Freistellungsentscheidung definiert).
