The President made statements on the Irish referendum of 2 October 2009, welcoming the result, on the situation following the natural disaster in Sicily, and on the occasion of the third anniversary of the murder of Anna Politkovskaya.
Several Members held up banners bearing pictures of Anna Politkovskaya, and the President associated himself with this tribute.

The Minutes of the previous sitting were approved.
4. Transfers of appropriations
The Committee on Budgets had considered the Commission's proposal for transfer of appropriations DEC 26/2009 (N7-0009/2009 — C7-0117/2009 — 2009/2081(GBD)).
Having noted the Council's opinion, it had authorised the transfer in its entirety under Article 24(3) of the Financial Regulation applicable to the general budget of the European Communities.

9. Request for the waiver of parliamentary immunity
The Lithuanian authorities had sent a request to the President of Parliament for Viktor Uspaskich's parliamentary immunity to be waived in the context of legal proceedings before the Vilnius Regional Court.
Under Rule 6(2), this request had been forwarded to the relevant committee (JURI).

11. Corrigendum to a text adopted (Rule 216)
The committee responsible had forwarded the following corrigendum to a text adopted by Parliament.
Corrigendum to the position of the European Parliament adopted at first reading on 18 November 2008 with a view to the adoption of Directive 2009/…/EC of the European Parliament and of the Council on statutory markings for two- or three-wheel motor vehicles (codified version) — P6_TA(2008)0530 — (COM(2008)0318 — C6-0205/2008 — 2008/0099(COD)) — JURI
Pursuant to Rule 216(4) of the Rules of Procedure, this corrigendum would be deemed approved unless, not later than 48 hours after its announcement, a request was made by a political group or at least 40 Members that it be put to the vote.
The corrigendum was available on the Séance en direct site.
12. Order of business
The next item was the order of business.
The final draft agenda for the October I sittings (PE 428.981/PDOJ) had been distributed and a number of changes had been proposed (Rule 140):
Wednesday
The report by Edit Bauer on the organisation of the working time of persons performing mobile road transport activities (Item 4 on the final draft agenda) had been rejected in committee and had therefore been withdrawn from the agenda.
Thursday
The following three reports, which had been scheduled to be put to the vote on Thursday, had not been adopted in time. The President proposed that they therefore be withdrawn from the agenda:

The following spoke: Alain Lamassoure (Chair of the BUDG Committee), who stated that both reports by Reimer Böge had been adopted unanimously in committee, but that they could not be translated in time to be put to the vote on Thursday.
The following spoke: Barbara Matera and Gianni Pittella, both of whom requested that the report by Reimer Böge on the mobilisation of the EU solidarity fund for Abruzzo be put to the vote on Thursday, although it had not yet been translated. The President requested that the report be translated urgently with a view to its being put to the vote on Thursday. It was so decided.

The President made the following proposals for changes:

A Council statement on the situation in Guinea would be placed on Wednesday's agenda as the second item, following the Council and Commission statements on the outcome of the referendum in Ireland (Item 2 on the final draft agenda). |

Motions for resolution to wind up debate on passenger compensation in the event of airline bankruptcy (Item 12 on the final draft agenda): the vote would take place during the October II part-session. |
Parliament accepted these proposals.

Request by the PPE Group to withdraw from the agenda the item on freedom of information in Italy (Item 27 on the final draft agenda).
The following spoke: Joseph Daul, on behalf of the PPE Group, who moved the request, Francesco Enrico Speroni, on behalf of the EFD Group, and Martin Schulz, on behalf of the S&D Group.
Parliament rejected the request by roll-call vote (268 in favour, 284 against, abstentions 18).
The item therefore remained on the agenda.
Request by the PPE Group that the debate on freedom of information in Italy not be wound up with the tabling of motions for resolution.
The following spoke: Daniel Cohn-Bendit, on behalf of the Verts/ALE Group, against the request, and Mario Mauro, on behalf of the PPE Group, in favour of the request.
Parliament rejected the request by roll-call vote (286 in favour, 293 against, abstentions 18).
The debate would therefore be wound up by tabling motions for resolution, which would be put to the vote during the next part-session.
The order of business was thus established.

Giorgos Papakonstantinou had informed the President that he had been appointed to the Greek Government as from 7 October 2009.
Parliament noted this and established the vacancy with effect from 7 October 2009 under Article 7(1) of the Act concerning the election of the members of the European Parliament by direct universal suffrage and under Rule 4(4) of its Rules of Procedure.
