On 18 November 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Bominflot Bunkergesellschaft für Mineralöe MbH & Co KG (‘Bominflot’, Germany) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of SBI Holding B.V. (‘SBI’, The Netherlands) controlled by Seatrade Holding B.V. (‘Seatrade’, The Netherlands) by way of purchase of shares. |

The business activities of the undertakings concerned are:

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. |

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission not later than 10 days following the date of this publication. Notice concerning a request in accordance with Article 30 of Directive 2004/17/EC — extension of the period
Request from a contracting entity

On 15 October 2009 the Commission received a request pursuant to Article 30(5) of Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors (1).
That request, from Shell U.K. Limited, concerns exploration for and extraction of oil and gas in England, Scotland and Wales (that is, the United Kingdom excluding Northern Ireland). The request was published in OJ C 255 of 24 October 2009, p. 23. The initial period ends on 16 January 2010.
Since the Commission needs to obtain and examine additional information, the period which the Commission is allowed for the adoption of a decision is to be extended by three months, in accordance with the provisions in the second sentence of Article 30(6).
The final period therefore ends on 16 April 2010.
