COMMISSION OPINION
of 10 November 2009
relating to the plan for the disposal of radioactive waste arising from a modification at the site of the Obrigheim KWO Nuclear Power Station, located in Germany, in accordance with Article 37 of the Euratom Treaty

On 28 May 2009, the European Commission received from the German Government, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from a modification at the site of the Obrigheim KWO Nuclear Power Station.
On the basis of these data, the Commission has considered that the plan concerned a modification to an existing plan on which an opinion had already been given on 21 June 2007. The Commission has further taken into consideration that the intermediate storage facility for irradiated fuel resulting from this modification is designed to operate up to 40 years and could remain in operation after decommissioning and dismantling of the existing power station. Following consultation with the group of experts, the Commission has drawn up the following opinion:

The planned modification does not require adjustment of the existing authorised discharge limits for gaseous and liquid discharges. |
|
2. |
The planned modification has no consequences in relation to solid radioactive waste arising from the decommissioning of the power station. |
|
3. |
The planned modification has no consequences in relation to unplanned discharges of radioactive effluents which may follow an accident of the type and magnitude considered in the General Data of the existing plan. |
In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste resulting from a modification at the site of the Obrigheim KWO Nuclear Power Station, located in the Federal Republic of Germany, both in normal operation and in the event of an accident of the magnitude considered in the General Data, is not liable to result in radioactive contamination of the water, soil or airspace of another Member State.

COMMISSION OPINION

relating to the plan for the disposal of radioactive waste arising from the dismantling of the Chooz-A Nuclear Power Station, located in France, in accordance with Article 37 of the Euratom Treaty

On 5 June 2009, the European Commission received from the French Government, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the dismantling of the Chooz-A Nuclear Power Station.
On the basis of these data and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1. |
The distance between the power station and the nearest border with another Member State, in this case Belgium, is 3 km. Luxembourg is the next nearest Member State at a distance of 70 km. Germany and The Netherlands are at distances of 95 km and 97 km respectively. |

2. |
During normal dismantling operations the discharges of liquid and gaseous effluents will not cause an exposure liable to affect the health of the population in another Member State. |
|
3. |
Solid radioactive waste is temporarily stored on site before being transferred to licensed treatment or disposal facilities located in France. There are no plans to export radioactive waste out of France. |
|
4. |
In the event of unplanned releases of radioactive effluents that may follow an accident of the type and magnitude considered in the General Data, the doses received in another Member State will not be liable to affect the health of the population. |
In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form arising from the dismantling of the Chooz-A Nuclear Power Station in France, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in radioactive contamination of the water, soil or airspace of another Member State.

On 9 November 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), by which the undertaking Hal Holding N. V. (‘Hal’, Netherlands Antilles), acquires, within the meaning of Article 3(1)(b) of the Regulation, control of the whole of the undertaking Safilo Group S.p.A. (‘Safilo’, Italy) by way of purchase of shares and securities. |
