On 21 October 2009, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. The full text of the decision is available only in English and will be made public after it is cleared of any business secrets it may contain. It will be available:

The aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers

The firm Irmino s.r.l. — having its registered office in Palermo (PA), via Principe di Villafranca 50 (cap 90141) — registered with the Palermo Chamber of Commerce (VAT No 03922140821; REA No 160160) applied on 22 May 2009 to the Regional Minister for Industry, the competent authority for granting mining rights in the Region of Sicily, at via Ugo La Malfa 87/89, 90146 Palermo, and in accordance with Sicilian Regional Law No 14 of 3 July 2000 transposing and implementing Directive 94/22/EC, for an oil and gas exploration licence (generally known as Scicli) in an area of 9 600 ha (96 km2) located entirely in the municipality of Scicli in the province of Ragusa, south-eastern Sicily. This area is bordered to the west by the Irminio concession, which is owned by Irminio s.r.l. (which is 100 % controlled by Sviluppo Risorse Naturali s.r.l.), to the south by the sea area ‘d355C.R.-SR’, for which a licence is being issued to Sviluppo Risorse Naturali s.r.l., and in other directions by unlicensed territories.

The perimeter of the area for which the licence is sought is an irregular six-sided polygon delineated by continuous lines between points ‘A’, ‘B’, ‘C’, ‘D’, ‘E’ and ‘F’, except for the line that follows the coastline from points ‘D’ and ‘E’. The ‘AF’ side borders on the eastern edge of the Irminio concession.

The above points are as follows:

A.

Point is to the north-west of the area IGMI No 276-II-NO ‘Scicli’, in the municipality of Scicli, in the district of Mangiagesso. Specifically, it is at km 7 on provincial road SP94. To the north this road turns into the SS 194 Modica–Ragusa trunk road near Modica, and it ends to the south in Scicli.

B.	Point is also to the north west of the area IGMI No 276-II-NO ‘Scicli’, in the municipality of Scicli, in the district of Milocca. Specifically, it is at km 6 on provincial road SP54, which runs from Modica to Scicli.

C.

Point is in the central part of the area IGMI No 276-II-NO ‘Scicli’, in the municipality of Scicli, in the district of Fami Giurgia. It is near a group of buildings and farm depots marked on maps as ‘C. Nuova’. Specifically, it is at the northernmost corner of the northernmost of the buildings to the eastern side of the road. Access is by an unmetalled north-south road crossed by the SP122 provincial road.

D.

Point is in the central part of the area IGMI No 276-II-SO ‘Scicli’, in the municipality of Scicli, in the Pisciotto district, approximately 120 m from the coast. Specifically, it is on a lighthouse (marked on maps) near the ruins at Fornace Penna. Point D continues to the coastline along the virtual segment linking points D and E.

E.

Point is in the central southern part of the area IGMI No 276-III-NE ‘Donnalucata’, in the municipality of Scicli, about 1,5 km east-northeast of the village of Donnalucata and about 30 m from the coast. Specifically, it is at the junction (marked T) of Via Cernia and Viale della Repubblica. Point E continues to the coastline along the virtual segment linking points D and E.

F.

Point is in the central southern part of the area IGMI No 276-III-NE ‘Donnalucata’, in the municipality of Scicli, in the district of Dammusi. Specifically, it is at the southernmost corner of a rural building, not named on the reference maps used here, which can be reached by following provincial road SP89 to the junction with Via Cernia and following the Dammusi district access road in a northerly direction for about 500 m.

Interested parties may submit an application for a licence for the same area within 90 days of the date of publication of this notice in the Official Journal of the European Union; applications received after that period will be declared inadmissible. The Decree granting the exploration licence will be issued within six months of the closing date for the submission of competing applications. In accordance with Article 5(1) of Directive 94/22/EC, notice is also given that the criteria on the basis of which prospection licences, exploration licences and production licences are issued have already been published in Official Journal of the European Communities C 396 of 19 December 1998, with reference to Legislative Decree of the President of the Republic No 625 of 25 November 1996 (published in Official Gazette of the Italian Republic No 293 of 14 December 1996), which transposes and implements the above mentioned Directive into Italian law, and were specified in Regional Law of Sicily No 14 of 3 July 2000 (published in Official Gazette of the Region of Sicily No 32 of 7 July 2000).

The conditions and requirements regarding the performance or cessation of activities are laid down in the above mentioned Regional Law of Sicily No 14 of 3 July 2000 and in the Standard Specifications issued by Decree No 91 of 30 October 2003 and Decree No 88 of 20 October 2004 of the Regional Minister for Industry and published in the Official Gazette of the Region of Sicily Part I, No 49 of 14 November 2003 and Part I, No 46 of 5 November 2004 respectively.

The application documents have been lodged at the Regional Office for Hydrocarbons and Geothermal Energy of the Regional Department of Industry and Mining, Via Ugo La Malfa 101, 90146 Palermo PA, ITALIA where they may be consulted by any interested party.

1.

On 27 October 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Renesas Technology Corp. (‘Renesas’, Japan), jointly-controlled by Hitachi Ltd. (‘Hitachi’, Japan) and Mitsubishi Electric Corporation (‘Mitsubishi’, Japan) enters into a full merger within the meaning of Article 3(1)(a) of the Council Regulation with the undertaking NEC Electronics Corporation (‘NEC-EL’, Japan), controlled by NEC Corporation (‘NEC’, Japan) by way of purchase of shares.

2.

The business activities of the undertakings concerned are: — for Renesas: design, manufacture and sale of semiconductor solutions including microcontrollers, system-on-chip products and LCD drivers for mobile, automotive and audio visual applications, — for NEC-EL: design, manufacture and sale of semiconductor solutions including microcontrollers, system-on-chip products and LCD drivers for various end-applications, including automotive, industrial and consumer electronics products.

3.	On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission not later than 10 days following the date of this publication.
