Communication from the Commission — Notification of the professional associations or organisations fulfilling the conditions of Article 3(2) listed under Annex I to Directive 2005/36/EC

(Text with EEA relevance)

2009/C 111/01

Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications provides in its Article 3(2) subparagraph 1 that ‘A profession practised by the members of an association or organisation listed in Annex I shall be treated as a regulated profession’. It also provides that whenever a Member State grants recognition to an association or organisation referred to in the first subparagraph, it shall inform the Commission. The Commission shall then publish an appropriate notification in the Official Journal of the European Union.

Since the United Kingdom and Ireland have notified the following professional associations or organisations under Annex I, the Commission publishes the present Communication in accordance with Article 3(2) to the Directive (1).

COUNCIL ACT

of 6 April 2009

appointing the Director of Europol

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Convention on the establishment of a European Police Office (Europol Convention) (1), and in particular Article 29(1) thereof,

Acting as the authority vested with the power to appoint the Director of Europol,

Having regard to the opinion of the Management Board,

Whereas:

(1)

Due to the expiry of the term of office of the Director of Europol appointed by Council Act of 28 February 2005 (2), it is necessary to appoint a Director.

(2)

The Staff Regulations applicable to Europol employees (3), and in particular their Appendix 8, establish special provisions on the procedure for the selection of the Director or a Deputy Director of Europol.

(3)

The Management Board presented the Council with a short-list ranking the suitable applicants for appointment, together with the full file of each of those applicants, as well as the full list of the applicants.

(4)

On the basis of all relevant information provided by the Management Board, the Council wishes to appoint the applicant who, according to the Council, meets all the requirements of the vacant position of Director,

HAS DECIDED AS FOLLOWS:

Article 1

Mr Robert WAINWRIGHT is hereby appointed as Director of Europol from 16 April 2009 to 15 April 2013.

Article 2

This Act shall take effect on the day of its adoption.

It shall be published in the Official Journal of the European Union.

CALL FOR PROPOSALS — EACEA/01/2009

Support for the implementation of Pilot Projects

1.   Objectives and Description

This notice of Call for Proposals is based on Decision No 1718/2006/EC of the European Parliament and of the Council of 15 November 2006 concerning the implementation of a programme of support for the European audiovisual sector (MEDIA 2007).

One of the measures to be implemented under this Decision is to support the implementation of Pilot Projects.

The programme may support Pilot Projects to ensure that it adapts to market developments, with a particular emphasis on the introduction and utilisation of information and communication technologies.

2.   Eligible applicants

This notice is aimed at European companies whose activities contribute to the above mentioned objectives.

Applicants must be established in one of the following countries:

the 27 countries of the European Union

the EFTA countries

Switzerland

Croatia

3.   Eligible actions

The following actions are eligible under this Call for Proposals:

1.

Distribution: new ways of creating and distributing European audiovisual content via non linear services

2.

Open Media Production Environment

3.

Distribution — Promotion & Marketing: the use of web techniques to develop local Cinema Communities

4.

Previously funded Pilot Projects: Actions which have received funding under a previous MEDIA Pilot Projects Call for Proposals

The maximum duration of the actions is 12 months.

The actions have to start on 1 January 2010 and finish on 31 December 2010.

4.   Award criteria

Each submitted eligible action will be assessed in the light of the following award criteria:

Relevance of the activity with respect to the Programme’s objectives (20 %)

European Dimension of the activity (20 %)

Clarity of objectives and target groups (15 %)

Clarity and consistency of the general design of the action and likelihood of attaining the desired goals within the action's period (15 %)

Cost effectiveness of the action (10 %)

Experience of the participating organisations and quality of the management plan of the action (10 %)

Quality and effectiveness of the plan for dissemination of the results (10 %)

5.   Budget

The total budget available is EUR 2 million.

There is no maximum amount.

The financial contribution will take the form of a grant. The financial contribution awarded will in no event exceed 50 % of the eligible costs.

The Agency reserves the right not to allocate all the funds available.

6.   Deadline for submission of applications

Applications must be submitted to the Executive Agency (EACEA) no later than 15 July 2009.

Only applications submitted on the official application form, duly signed by the person entitled to enter into legally binding commitments on behalf of the applicant organisation will be accepted. Envelopes must clearly mention:

Call for proposals — EACEA/02/2009

Support to Video on Demand and Digital Cinema Distribution

1.   Objectives and Description

This notice of Call for Proposals is based on Decision No 1718/2006/EC of the European Parliament and of the Council of 15 November 2006 concerning the implementation of a programme of support for the European audiovisual sector (MEDIA 2007).

One of the measures to be implemented under this Decision is to support Video on Demand and Digital Cinema Distribution.

The Video on Demand and Digital Cinema Distribution scheme constitutes one of the ways in which the MEDIA 2007 programme ensures that the latest technologies and trends are incorporated into the business practices of beneficiaries of the programme.

The main objective of this scheme is to support the creation and exploitation of catalogues of European works to be distributed digitally across borders to a wider audience and/or to cinema exhibitors through advanced distribution services, integrating where necessary digital security systems in order to protect online content.

2.   Eligible applicants

This notice is aimed at European companies whose activities contribute to the above mentioned objectives.

Applicants must be established in one of the following countries:

the 27 countries of the European Union

the EFTA countries

Switzerland

Croatia

3.   Eligible actions

The following actions are eligible under this Call for Proposals:

1.

Video on Demand (VoD): Service enabling individuals to select audiovisual works from a central server for viewing on a remote screen by streaming and/or downloading.

2.

Digital Cinema Distribution (DCD): Digital delivery (to an acceptable commercial standard) of ‘Core Content’, i.e. feature films, TV films or series, shorts (fiction, animation and creative documentary) to cinemas for theatrical exploitation (via hard disc, satellite, online…).

The maximum duration of the actions is 18 months.

The actions have to start between 15 July 2009 and 1 January 2010. The actions have to finish on 31 December 2010.

4.   Award criteria

Each submitted eligible action will be assessed in the light of the following award criteria:

Catalogue and Editorial line (10 %)

European dimension of the catalogue (30 %)

Quality and cost-effectiveness of the Business Model submitted (30 %)

Innovative aspects of the action (10 %)

Grouping and Networking Dimension (10 %)

Target audience and Potential impact (10 %)

5.   Budget

The total budget available is EUR 8 million.

There is no maximum amount.

The financial contribution will take the form of a grant. The financial contribution awarded will in no event exceed 50 % of the eligible costs.

CALL FOR PROPOSALS — EAC/21/2009

Preparatory action in the field of Sport

(Open call)

2009/C 111/08

1.   Objectives and description

This call for proposals serves to implement the Preparatory action in the field of sport in accordance with Commission Decision C(2009)1685 of 16 March 2009 adopting the ‘2009 annual work programme on grants and contracts for the preparatory action in the field of sport and for the special annual events’.

The main objective of the Preparatory action in the field of Sport for 2009 is to prepare future EU actions in this field, on the basis of priorities set in the White Paper on Sport.

This call for proposals will support transnational projects put forward by public bodies or civil society organisations in order to identify and test suitable networks and good practices in the field of sport, in the following areas:

(a)

Promoting health-enhancing physical activity

(b)

Promoting education and training in sport

(c)

Promoting European fundamental values by encouraging sport for persons with disabilities

(d)

Promoting gender equality in sport

Any expenditure incurred before the start of activities will not be taken into account.

The Commission department responsible for implementation and management of this action is the Sport Unit of the Directorate-General for Education and Culture.

2.   Eligible applicants

Under this call for proposals, two categories of applicants are eligible:

Public bodies;

Civil society organisations.

Moreover, in order to be eligible, applicants must meet the following conditions:

Have their head office in one of the Member States of the European Union (Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom);

Have a legal status.

Natural persons may not submit applications under this call for proposals.

3.   Budget and project duration

The budget available for this call for proposals is EUR 4 000 000.

EU co-financing will be provided to a maximum of 80 % of the total costs. The external co-financing can be partly made up of contributions in kind.

Depending on the number and quality of the projects submitted, the Commission reserves the right not to award all the funding available.

Projects must start between 1 December 2009 and 31 March 2010 and end no later than 31 March 2011.

The eligibility period for costs will begin on the date specified in the contract, i.e. the project start date. Under no circumstances can the eligibility period for expenditure start before the date of submission of the grant application.

Expenditure incurred before the start of the activities will not be taken into account.

4.   Deadline for applications

The deadline for submission of applications to the European Commission is 31 August 2009, as per the postmark.

The Commission invites entities registered in the European Union to present proposals for the LIFE+ call for proposals 2009.

Applications

Proposals must be written on specific application forms. These forms and the application guide that includes detailed explanations in regard to eligibility and procedures can be obtained from the Commission's web-site on the following address:

Proposals must be submitted on CD-ROM or DVD.

Beneficiaries

Proposals must be presented by entities registered in the Member States of the European Union being public and/or private bodies, actors and institutions.

The following themes are covered by this announcement

1.   LIFE+ Nature and Biodiversity

Principal objective: To protect, conserve, restore, monitor and facilitate the functioning of natural systems, natural habitats, wild flora and fauna, with the aim of halting the loss of biodiversity, including diversity of genetic resources, within the EU by 2010.

2.   LIFE+ Environment Policy and Governance

Principal objectives:

—   Climate change: To stabilise greenhouse gas concentration at a level that prevents global warming above 2 °C;

—   Water: To contribute to enhanced water quality by developing cost-effective measures to achieve good ecological status in view of developing the first river basin management plan under Directive 2000/60/EC (Water Framework Directive) by 2009;

—   Air: To achieve levels of air quality that do not give rise to significant negative impacts on and risks to human health and the environment;

—   Soil: To protect and to ensure the sustainable use of soil by preserving soil functions, preventing threats to soil, mitigating their effects and restoring degraded soils;

—   Urban environment: To contribute to improving the environmental performance of Europe's urban areas;

—   Noise: To contribute to policy development and implementation on environmental noise;

—   Chemicals: To improve the protection of environment and health from risks posed by chemicals by 2020 by implementing chemicals legislation, in particular Regulation No 1907/2006 (REACH) and the Thematic Strategy on the sustainable use of pesticides;

—   Environment and health: To develop the information base for policy on the environment and health (the Environment and Health Action Plan for 2004 to 2010);

—   Natural resources and waste: To develop and implement policies designed to ensure sustainable management and use of natural resources and waste, and to improve the environmental performances of products, sustainable production and consumption patterns, waste prevention, recovery and recycling; To contribute to the effective implementation of the Thematic Strategy on the prevention and recycling of waste;

—   Forests: To provide, especially through an EU coordination network, a concise and comprehensive basis for policy relevant information on forests in relation to climate change (impact on forest ecosystems, mitigation, substitution effects), biodiversity (baseline information and protected forest areas), forest fires, forest conditions and the protective functions of forests (water, soil and infrastructure) as well as contributing to the protection of forests against fires;

—   Innovation: To contribute to developing and demonstrating innovative policy approaches, technologies, methods and instruments to assist in the implementation of the Environmental Technologies Action Plan (ETAP);

—   Strategic approaches: To promote the effective implementation and enforcement of Community environmental legislation and improve the knowledge base for environmental policy; to improve the environmental performance of SMEs.

Whilst any project proposal dealing with the above-mentioned principal objectives is welcome, the Commission would favour those dealing with climate change.

3.   LIFE+ Information and Communication

Principal objective: To disseminate information and raise awareness on environmental issues, including forest fire prevention; and to provide support for accompanying measures, such as information, communication actions and campaigns, conferences and training, including training on forest fire prevention.

Whilst any project proposal dealing with the above-mentioned principal objective is welcome, the Commission would favour those dealing with halting the loss of biodiversity.

EU Cofinancing rates

1.   LIFE+ Nature and Biodiversity projects

The rate of Community financial support shall be a maximum of 50 % of the eligible costs.

Exceptionally, a maximum cofinancing rate of 75 % is applicable to proposals which target priority habitats/species of the Birds’ and Habitats’ Directives.

2.   LIFE+ Environment Policy and Governance

The rate of Community financial support shall be a maximum of 50 % of the eligible costs.

3.   LIFE+ Information and Communication

The rate of Community financial support shall be a maximum of 50 % of the eligible costs.

Deadline

Project proposals shall be submitted to the national competent authorities by 15 September 2009. Project proposals shall be forwarded to the national authority of the Member State in which the beneficiary is registered. Proposals will then be submitted by the national authorities to the Commission by 22 October 2009.

Budget involved

The overall budget for project action grants under LIFE+ in 2009 is EUR 250 000 000.At least 50 % of this amount shall be allocated to measures to support the conservation of nature and biodiversity.

Proposals must be received within 90 days following the date of publication of this notice in the Official Journal of the European Union.

Terms of participation in the selection procedure: an interested party that submits a proposal for the transfer of an extraction area must provide evidence of a valid mining authorisation (or other similar authorisation issued in a state that is a contracting party to the Agreement on the European Economic Area) covering the activities that will be performed in the extraction area forming the subject of the proposal, and must include proposals for waste treatment and a report on mining activities to date.

Terms for obtaining copies of documentation on the designation of a protected deposit area and on the designation of an extraction area: copies may be obtained in accordance with Act No 211/2000 on access to information and amending certain other acts (the Freedom of Information Act), as amended, at the Bratislava District Mining Office.

Requirements for content of proposal for transfer of extraction area: information on the extraction area and on the exclusive deposit, the proposed extraction method and method of developing, preparing, modifying and refining, preliminary dates for the development, preparation and extraction work, measures to reduce the impact on the environment of activities in the extraction area, the financial capacities of the proposing entity, technical capacities of the proposing entity, information on the resolution of conflicts of interest and a calculation of the expected benefits to the Slovak Republic from the use of the mineral deposits, arising from the expected sale of the minerals extracted from the exclusive deposit in the extraction area concerned by the proposal.

Evaluation Criteria for proposals: a panel shall evaluate proposals to transfer the extraction area on the basis of compliance with the requirements listed in the terms of participation in the selection procedure, the proposed extraction method, including the siting of landfills, tips, tailing ponds and other storage facilities, the resolution of conflicts of interest and compliance with the requirements to be met by the content of proposals for the transfer of the extraction area. Each criterion shall carry equal weight.

Proposals for the transfer of an extraction area may be delivered in person or by post to: Obvodný banský úrad v Bratislave, Prievozská 30, SK-821 05 Bratislava, in a sealed envelope marked ‘Návrh do výberového konania’ (Proposal for selection procedure) and indicating the name of the entity submitting the proposal. The proposal must be accompanied by a declaration that the proposing entity agrees to the terms of this notice. The date of the proposal shall be the date of delivery in person or the date on which the proposal was posted.

Proposals must be received within 90 days following the date of publication of this notice in the Official Journal of the European Union.

A decision on the proposals received will be taken not later than 12 months after this period has expired.

The Bratislava District Mining Office is the competent authority responsible for granting authorisation to exploit deposits in the above-mentioned extraction areas. The criteria, conditions and requirements specified in Articles 5(1) and (2) and 6(2) of the Directive are set out in Act No 51/1988 of the Slovak National Council on mining activities, explosives and the State Mining Administration, as amended by Act No 499/1991 of the Slovak National Council, Act No 154/1995 of the National Council of the Slovak Republic, Act No 58/1998, Act No 533/2004 and Act No 577/2007.

3.2.   Description of the product to which the name in (1) applies:

‘Pomodorino del Piennolo del Vesuvio’ PDO designates the fruit of the small tomato ecotypes known by the folk names ‘Fiaschella’, ‘Lampadina’, ‘Patanara’, ‘Principe Borghese’ and ‘Re Umberto’ and traditionally grown on the slopes of Mount Vesuvius. They are oval or slightly plum-shaped with a pointed apex, frequent ribbing towards the stalk and thick skin. Hybrids may not be used. In order to be eligible for protection, they must have the following characteristics. When fresh — size: no greater than 25 g; shape parameters: ratio between the largest and smallest diameters of between 1,2 and 1,3; outer colour: vermilion; colour of the flesh: red; texture: very firm; flavour: sweet and sour, lively and intense; refractive index: min. 6,5 °Bx; strongly attached to the stalk. When stored on ‘piennolo’ bunches — outer colour: dark red; colour of the flesh: red; texture: firm; flavour: lively and intense; turgidity: low at the end of storage.

3.5.   Specific steps in production that must take place in the identified geographical area:

Production and storage activities must take place in the production area, and the following instructions for storing the tomatoes on ‘piennolo’ bunches must be followed:

after being harvested, the natural bunches (known as ‘schiocche’) must be placed on plant fibre twine and tied in a circle so as to make a single large bunch (‘piennolo’) weighing between 1 kg and 5 kg at the end of storage. The ‘piennolo’ bunches made in this way must be hung above ground in a dry, ventilated place using hooks or appropriate supports,

during the storage phase, the product, whether on ‘piennolo’ bunches or packaged, may undergo no chemical treatment. Use may be made only of physical systems for better protecting the product, which cannot adversely affect its characteristics, such as insect nets and ultrasound devices,

the useful life of the ‘piennolo’ bunches is not precisely determined and is linked to how long the tomatoes retain their ideal appearance and organoleptic characteristics.

3.6.   Specific rules concerning slicing, grating, packaging, etc.:

Packaging of the tomatoes in the form in which they are marketed — either fresh or preserved — must take place on the production holdings or in the immediate vicinity, within the production area, so as to:

limit all handling when the fruit is at its most resistant,

prevent the transport over long distances of produce which is unpackaged and, as such, not adequately protected and thus exposed to possible mechanical stress and damage,

help ensure traceability.

3.7.   Specific rules concerning labelling:

‘Pomodorino del Piennolo del Vesuvio’ PDO must be released for consumption in one of the following forms:

fresh: the product must be put on sale as individual fruit or in bunches, placed in bulk in appropriate sealed containers, with a maximum capacity of 10 kg,

on ‘piennolo’ bunches: the ‘piennolo’ bunches must weigh no more than 5 kg and be put on sale individually with the identifying logo of the PDO or in appropriate sealed containers,

preserved, as individual fruit or bunches, placed in bulk in appropriate sealed containers, with a maximum capacity of 10 kg.

The labels must include the following: the wordings ‘Pomodorino del Piennolo del Vesuvio’ and Protected Designation of Origin in larger characters than any other wording or element featured; the Community logo; the name, company name and address of the packager or producer and the quantity of product actually contained in the package. The logo is composed of a silhouette of the ‘Pomodorino del Piennolo del Vesuvio’, including a stalk which extends to depict the profile of Mount Vesuvius. The specific details of the logo and its colours are described exhaustively in the product specification.

4.   Concise definition of the geographical area:

The production and storage area for ‘Pomodorino del Piennolo del Vesuvio’ PDO covers the following municipalities in Naples Province: Boscoreale, Boscotrecase, Cercola, Ercolano, Massa Di Somma, Ottaviano, Pollena Trocchia, Portici, Sant’Anastasia, San Giorgio a Cremano, San Giuseppe Vesuviano, San Sebastiano al Vesuvio, Somma Vesuviana, Terzigno, Torre Annunziata, Torre del Greco, Trecase, and the part of Nola municipality with the following perimeter boundaries: the provincial road linking Piazzola di Nola and Rione Trieste (the stretch known as ‘Constantinopoli’), the Lagno Rosario stream, the border of Ottaviano municipality and the border of Somma Vesuviana municipality.

5.   Link with the geographical area:

5.1.   Specificity of the geographical area:

The specific nature of the area where the ‘Pomodorino’ is grown lies in the volcanic origin of the soils. This area owes it specific characteristics to the pyroclastic nature of the soils, which characterises the entire volcanic fabric of the Somma-Vesuvio complex. These soils have formed on the lava and layers of ash and lapillus and are characterised by a high degree of fertility, a sandy texture that makes them very loose and well-drained and a neutral or sub-alkaline pH with a high level of available macro and micro elements. The climate is prevalently dry, with moderate wind and high temperatures. Wide temperature variations between night and day help to naturally combat parasitic diseases.

5.2.   Specificity of the product:

Besides its small size, the specific characteristics of the ‘Pomodorino del Piennolo del Vesuvio’ are a weight of between 20 g and 30 g, a low ratio of 1,2-1,3 between the largest and smallest diameters, the significant firmness of the skin, a particularly strong attachment to the stalk which is such as to ensure that the bunches tend to hold together well during harvesting and storage, a high concentration of sugars, acids and other soluble solids which mean that it is a product with a long shelf-life during which none of its organoleptic qualities suffer ill effects. The high osmotic pressure of the juice contained in the tomatoes, generated by the high concentration of soluble solids, means that the fruit maintains its typical turgidity for a long period, losing only a little water during storage.

Growing practices are conditioned by the characteristic configuration of the plots, which are very fragmented and often terraced and laid out in an irregular manner. The majority of growing activities are carried out by hand following traditional agricultural practices.

5.3.   Causal link between the geographical area and the quality or characteristics of the product (for PDO) or a specific quality, the reputation or other characteristic of the product (for PGI):

The specific characteristics of ‘Pomodorino del Piennolo del Vesuvio’ are very closely linked to the area where it is grown. The volcanic origin of the soils and all the pyroclastic material accumulated during the eruptions of the Somma-Vesuvio volcanic complex have made this land highly fertile. The sandy texture has made it very loose and well-drained and led to a neutral or sub-alkaline pH with a high level of available macro and micro elements. When grown, the product absorbs all of this and thus takes on its very characteristic qualities. Parasitic diseases are naturally combated by the dry climate characterised by wide temperature variations between night and day. Small tomatoes, stored on ‘piennolo’ bunches or preserved, are one of the oldest and most traditional products of the Vesuvius area. The earliest documented and technically detailed evidence can be found in the 1885, 1902 and 1916 publications of the ‘Regia Scuola Superiore di Agricoltura’ (Royal Higher School of Agriculture) in Portici. In past centuries, growing this type of tomato became popular owing to its ease of cultivation and its suitability for long storage over the winter months as a result of the firmness of its skin. The diffusion of this type of tomato in the past was linked to the need to have fresh tomatoes in the winter months in order to be able to properly garnish home-cooked dishes, which have always been very common in the Naples area, such as pizzas and pasta dishes requiring intense flavour and aromas. The effect of the human factor was to put in place a well-calibrated growing and storage method which is typical of the area and involves the selection of the best tomatoes for production of the seed, the pruning needed to ensure that the plants can grow in an unrestricted direction, tying of the stalks and elimination of the excess shoots until the tomatoes have been harvested. During harvesting, natural bunches are picked whole when at least 70 % of the tomatoes are red, with the remainder still maturing. The procedure for storing the tomatoes on ‘piennolo’ bunches, which makes it possible to consume them, whole and unprocessed, for the whole winter following the harvest, links this product to the area. The traditional procedure involves picking the natural bunches of tomatoes whole and interweaving the stalks with hemp rope, thereby making a single large bunch which is hung from the roof of special ventilated rooms or on verandas or terraces. All of this, combined with the specific environmental context of the Vesuvius area, has created a product which is unique for its type as regards its organoleptic qualities and shelf life, and this is the product that is still grown and stored to this day.
