Objective and type of aid: The objective of this aid scheme is environmental protection, within the meaning of Article 4(3)(d) of Commission Regulation (EC) No 1857/2006.

List of eligible agricultural equipment for environmental purposes:

Soil working equipment: plant shredders, rotating shredders, rotating mowers, hoes, weeders, decompactors, tooth and disc stubble cleaners and seeders to facilitate working the soil,

Equipment for adding organic material: compost spreaders, organic matter spreaders, manure spreaders, plant shredders and slurry vats equipped with spreader systems,

Grass working equipment: mowers, windrowers, haymakers, bale-wrappers, presses, windrow turners,

Containment equipment.

Eligible expenditure includes: the purchase of new agricultural machinery (with the exception of replacement machinery or machinery such as tractors or sprayers) and the construction, purchase or extension of premises used to carry out CUMA activities or to store equipment or machinery.

Sector(s) concerned: All the CUMA in the Moselle irrespective of what their members produce.

Objective and type of aid: This aid scheme falls under Article 10 of Regulation (EC) No 1857/2006. The department will put in place an aid programme to provide farmers with health assistance for animal disease prevention (paratubercolosis, BVD, IBR and Q fever) and good practices to improve health conditions in livestock holdings.

The aim of this aid scheme is to encourage appropriate and efficient health monitoring by auditing animal health and well-being in holdings.

In the case of young farmers, the services proposed will be more comprehensive so as to allow them to adopt an appropriate and efficient health monitoring system from the very start.

The aid will be granted in the form of subsidised services available to all livestock farmers regardless of whether they belong to a producers′ organisation or another structure.

(a)

cost of constructing, purchasing or improving immovable goods, except purchasing land,

(b)

cost of new machinery and equipment, including computer software,

general expenses related to points (a) and (b), e.g. engineering fees, consultancy fees and expenditure related to feasibility studies, patents and licences, up to 8 % of the total budget.

Duration of the aid scheme: End of 2008/end of 2009

Objective of aid: The measure complies with Article 11 (‘Aid for losses due to adverse climatic events’) of Regulation (EC) No 1857/2006.

As the ‘Fonds national de garantie des calamités agricoles’ (French agricultural disaster guarantee fund) does not cover damage by natural disasters (except floods), which is considered insurable, the General Council wishes to support glasshouse producers in Berre l'Etang whose installations have been seriously affected by hail.

The small and medium agricultural holdings affected by strong hail on 4 September 2008 will benefit, if insured, from insurance allowances for reconstructing and renovating glasshouses or parts thereof that were damaged or destroyed by hail. However, these allowances will only partly cover the reconstruction and restoration costs of structures (depending on the contracts, an obsolescence criterion and/or a lump sum is applied) and, in any case, will not cover the exceptional costs incurred in temporarily mobilising workers to clean broken glasshouses before renovation works proper. Some companies refuse to work on the restoration of glasshouses before the cleaning has been done, which requires skilled labour for the cleaning of crops.

Cleaning 117 000 m2 of glasshouses with broken roofs will require about 13 480 hours of cleaning.

For this exceptional expenditure relating to service provision, entailing considerable costs for each holding, the General Council would like to grant aid to cover in part the costs of getting workers to clean up broken glass in glasshouses.

The amount of eligible expenditure will be limited to a threshold of 3 000 hours per holding, i.e. work costing a maximum of € 45 000 per holding.

The Department will pay a maximum of 65 % of the financing needed to cover the costs of labour, i.e. a maximum of € 29 250 per agricultural holding, with the remaining 35 %, i.e. € 15 750, to be paid by the owners of the holding.

This measure fulfils the dual objective of securing installations and restoring production facilities.

We wish to point out that outside the specific framework of this exempted scheme, aid will be made available for any installations whose roofs need to be completely replaced (frame and glass panes) under aid No N 484/2007 approved by the Commission.

(‘GDF Suez Energy Services’, France), controlled by the GDF Suez Group (France), acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Elyo Italia S.r.l. (‘Elyo Italia’, Italy) by way of purchase of shares.

The business activities of the undertakings concerned are:

for GDF Suez Energy Services: energy services,

for Elyo Italia: energy services and multi-technical management.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

On 14 April 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the Financial Market Stabilization Fund (commonly known as ‘Sonderfonds Finanzmarktstabilisierung’ or ‘SoFFin’, Germany), controlled by the Federal Republic of Germany, acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Hypo Real Estate (‘HRE’, Germany) by way of public bid announced on 9 April 2009.

The business activities of the undertakings concerned are:

for SoFFin: Stabilization of the financial system in Germany,

for HRE: commercial mortgaging, financing of public infrastructure, refinancing by issuing ‘Pfandbriefe’.
