On 28 November 2008, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. The aid does not relate to a disease in respect of which Community legislation provides for specific charges for control measures.

The aid does not relate to measures in respect of which Community legislation provides that the cost of such measures is to be borne by the agricultural holding, unless this cost is entirely offset by compulsory charges on producers.

In accordance with Article 1 of Regulation (EC) No 1857/2006, the aid will be granted only to small and medium-sized agricultural holdings active in the primary production of agricultural products

Objective of aid: The primary objective will be the providing of technical support to SME's involved in agricultural production. The objectives are specifically to raise understanding of sensing technologies for monitoring soil conditions — and thereby assisting agricultural producers to improve decisions on planting, harvesting and enabling improved environmental assessment and possibly switching to higher value crops. The aid will cover up to 100 % of the costs of providing the technical support and will be granted in kind by means of subsidised services. This scheme will not involve direct payments of money to producers.

The aid will be accessible to all those eligible in the area concerned.

This scheme is an extension of XA 96/08. The scheme administrators were unable to start the scheme and no money was spent

Prior notification of a concentration

(Case COMP/M.5335 — Lufthansa/SN Holding (Brussels Airlines))

1.

On 26 November 2008, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Deutsche Lufthansa AG (‘Lufthansa’, Germany) acquires within the meaning of Article 3(1)(b) of the Council Regulation sole control of the undertaking SN Airholding SA/NV (‘SNAH’, Belgium) by way of purchase of shares.

2.	The business activities of the undertakings concerned are: — for Lufthansa: air transport of passengers and cargo and related services (in-flight catering, IT-services, maintenance and repair of aircrafts), — for SNAH: air transport of passengers and cargo, in-flight catering.

3.	On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission not later than 10 days following the date of this publication. On 30 May 2008, the Commission of the European Communities received notification of a proposed concentration between BHP Billiton and Rio Tinto. On 26 November 2008, the notifying parties informed the Commission that they withdrew their notification.

Prior notification of a concentration

1.

On 2 December 2008, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking A.P. Møller-Mærsk A/S (Denmark) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Broström AB (Sweden) by way of purchase of shares.

The business activities of the undertakings concerned are: — for A.P. Møller-Mærsk A/S: containerized liner shipping, container terminal services, inland transportation, logistics, harbour towage, tankers, oil and gas exploitation and production and retail, — for Broström AB: tankers and marine logistics solutions.

3.	On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission. Observations must reach the Commission not later than 10 days following the date of this publication.
