Objective of aid: This grant is aimed at encouraging the production and sale of quality agricultural products from the province of Salamanca with a denomination of origin, protected geographical indication, guarantee mark or with the status of quality wines produced in a specified region.
This aid scheme falls within the scope of Articles 14 and 15 Commission Regulation (EC) No 1857/2006 of 15 December 2006 on the application of Articles 87 and 88 of the Treaty to State aid to small and medium-sized enterprises active in the production of agricultural products.
Participation in fairs organised by the Diputación or agri-food fairs attended by the Diputación de Salamanca, carrying out studies that promote the recognition of a quality mark or the improvement of the quality of products that bear a quality mark and activities promoting food quality are considered as eligible activities.
Eligible expenditure is taken to mean:

1. |
registration, space and stand rental, security, hosts and participation fees; |
|
2. |
publications related to the activity; |
|
3. |
travelling expenses. |
|
1. |
studies aimed at the conception and recognition of a quality mark (denomination of origin, protected geographical indication, guarantee mark or quality wine produced in a specified region) of agricultural products from the province of Salamanca; |
|
2. |
other studies aimed at improving the quality of agricultural products from the province of Salamanca that already bear one of the quality marks listed in the previous point. |

1. INTRODUCTION

The EFTA Surveillance Authority (the ‘Authority’) has received a set of commitments formally endorsed by Liechtensteinische Kraftwerke Anstalt (‘LKW’) and Telecom Liechtenstein AG (‘Telecom Liechtenstein’) formerly Liechtenstein TeleNet AG, in the course of an investigation pursuant to Article 53 of the EEA Agreement into the telecommunications markets of the Principality of Liechtenstein. |

By publishing this notice the Authority intends to market test the proposal of LKW and Telecom Liechtenstein for commitments, which are designed to address the Authority's competition concerns expressed in its preliminary assessment in this case. Subject to the results of this market test, the Authority intends to adopt a decision pursuant to Article 9(1) of Chapter II, Protocol 4 to the Surveillance and Court Agreement on the implementation of the rules on competition laid down in Articles 53 and 54 of the EEA Agreement. Such a decision would render binding the commitments offered by LKW and Telecom Liechtenstein. The decision would not conclude whether or not there had been or still was an infringement. |
2. SUMMARY OF THE CASE

On 1 December 2006, the Authority received a complaint against LKW, Telecom Liechtenstein and the Principality of Liechtenstein alleging that an agreement concluded between Telecom Liechtenstein and LKW on 11 July 2006, aimed at restructuring the telecommunications markets in Liechtenstein (the ‘Consolidation Contract’) had as its object or effect the elimination of all competition between the LKW and Telecom Liechtenstein. |

LKW is a 100 % State-owned electricity and telecommunications undertaking in Liechtenstein. LKW is established as a public law company. It supplies energy and also provides telecommunications infrastructure services. |
|

Telecom Liechtenstein is a 100 % State-owned telecommunications operator in Liechtenstein which provides a range of communications and multimedia product offerings at the retail and wholesale level. Telecom Liechtenstein is established as an incorporated company. |
|

Following the Consolidation Contract, at the infrastructure level LKW wholly owns the network infrastructure in Liechtenstein (in nine out of eleven municipalities). LKW offers wholesale access to its electronic communications network infrastructure to Telecom Liechtenstein and third party providers. Telecom Liechtenstein offers wholesale access to third party service providers using its infrastructure and retail supply of voice telephony, internet, and audio-visual services. |

On 19 December 2007, the Authority adopted a preliminary assessment focussing on two elements of the Consolidation Contract and their effects on competition on the telecommunications markets of Liechtenstein. This document was a preliminary assessment within the meaning of Article 9(1) of Chapter II, Protocol 4 to the Surveillance and Court Agreement. |

The preliminary assessment considered that a so-called strategic alignment provision, which requires the two companies to discuss network infrastructure development and requires LKW to achieve the network infrastructure requirements of Telecom Liechtenstein may restrict competition. The preliminary assessment concluded that this provision may operate as an obstacle or foreclose existing competitors or new entrants by making access to the markets more difficult. The preliminary assessment also expressed the concern that provisions in the Consolidation Contract pursuant to which LKW and Telecom Liechtenstein commit not to compete with each other for an unlimited time (‘non-competition clause’) restricted competition on the telecommunications markets in Liechtenstein. |

Council Regulation (EC, Euratom) No 58/97 of 20 December 1996 concerning structural business statistics, as adapted by way of Protocol 1 to the EEA Agreement and referred to at point 1 of Annex XXI thereto (hereinafter ‘the Act’), established a common framework for the collection, compilation, transmission and evaluation of Community statistics on the structure, activity, competitiveness and performance of businesses in the European Economic Area. Article 11 of the Act provides that derogations from the provisions of the Annexes thereto may be accepted during a transitional period.
Regulation (EC) No 1893/2006 of the European Parliament and of the Council of 20 December 2006 establishing the statistical classification of economic activities NACE Revision 2 and amending Council Regulation (EEC) No 3037/90 as well as certain EC Regulations on specific statistical domains (hereinafter ‘Regulation (EC) No 1893/2006’) has been incorporated into point 20c of Annex XXI to the EEA Agreement by EEA Joint Committee Decision No 61/2007 (OJ L 393, 30.12.2006, p. 1). Regulation (EC) No 1893/2006 amends the Act as to definitions of the variables laid down in the Annexes to the Act, which are described in Annex II to Regulation (EC) No 1893/2006.
The EFTA Surveillance Authority is entrusted with the task of accepting derogations in accordance with Article 12 of the Act as regards applications from Iceland, Liechtenstein and Norway.
Pursuant to Article 11 of Regulation (EC, Euratom) No 58/97, Norway applied for partial and complete derogation from transfer of certain data contained in Annex 7 of the Act as amended by Annex II to Regulation (EC) No 1893/2006.

Huîtres Marennes Oléron are oysters which are matured or bred on oyster beds. They are not open sea oysters.
Depending on the degree of transformation of the product after it has been placed on oyster beds, which is basically measured using the filling power index (ratio of drained flesh to total weight × 100), the Huître Marennes Oléron is classified:

3.5. Specific steps in production that must take place in the identified geographical area
The maturing or breeding of Huîtres Marennes Oléron must take place in oyster beds situated in the identified geographical area.
3.6. Specific rules concerning slicing, grating, packaging, etc.
Packaging and dispatch of the Huîtres Marennes Oléron must take place within the identified geographical area in order to preserve their quality and to ensure better sanitary conditions through speed of execution, and in order to guarantee their origin.
To safeguard their quality and ensure better sanitary conditions for the product, the oysters must be packaged within 24 hours of being fished. The oyster bed worker ensures that the sanitary condition of the oysters is good and monitors the sanitary condition of the oysters that they dispatch. Each consignor is subject to a collective multi-year plan of sanitary own checks, as part of which sampling and bacteriological analyses are carried out. Quality is also guaranteed by means of a final check before packaging, carried out by qualified or managerial staff, in order to eliminate empty, badly formed or soiled oysters. The oysters must be packaged flat, with the cupped valve on the bottom, to guarantee the most favourable preservation conditions possible. The packages are secured tightly and the baskets are adapted to the quantity of oysters packaged, in order to prevent the oysters from moving.
To guarantee the origin of the product, the consignor keeps a register to monitor the products (in batches) and this allows them to be tracked at all stages of the process. In accordance with current legislation (Decree 94-340) each consigning establishment must be approved by the veterinary services (EC No) as a consigning establishment of live shellfish.
On no account can the product be transported loose or presented for sale out of its original packaging.

4. Concise definition of the geographical area
The geographical area for maturing on oyster beds, breeding on oyster beds, packaging and dispatching Huîtres Marennes Oléron is the area of the Bassin de Marennes Oléron.
This includes twenty-seven communes: Le Gua, Nieulle-sur-Seudre, St Just-Luzac, Marennes, Bourcefranc-le-Chapus, Hiers-Brouage, Moëze, Saint Froult, Port des Barques, Beaugeay, Soubise, Saint Nazaire (right-bank of the Seudre: 12 communes), La Tremblade, Etaules, Chaillevette, L'Eguille, Arvert, Breuillet, Mornac (left-bank of the Seudre: 7 communes), Saint Trojan, Grand Village, Le Château d'Oléron, Saint Pierre d'Oléron, Dolus, Saint Georges d'Oléron, La Brèe les Bains, Saint Denis d'Oléron (Ile d'Oléron: 8 communes).
5. Link with the geographical area
5.1. Specificity of the geographical area
The principle activity of the Bassin de Marennes Oléron is shellfish farming. Oyster farming is carried out on tidal land (for breeding) and salt marshes (for maturing and breeding).
The oyster beds are often former salt marshes, they are shallow basins located on the edges of the Seudre or on the coast between the île d'Oléron and the mainland. They are fed through the action of gravity by brackish waters (mixture of sea water and freshwater) when the tide comes up through channels.
The oyster bed has an environment which is very rich in minerals and nutrients, and allows phytoplankton, on which oysters feed, to grow. Oysters filter the water with their developed gills and effectively benefit from the nutritional resource specific to the oyster bed. By taking in this nourishment specific to the oyster bed within several hours, the oyster becomes transformed by means of a significant renewal of its cellular tissues and, in turn, acquires the characteristics of this particular environment.
5.2. Specificity of the product
Huîtres Marennes Oléron are oysters which are matured or raised on oyster beds, and this confers on them a more refined taste (less bitter and iodized) than that of open sea oysters, better resistance to decreases in water levels and therefore they are better preserved, a quality shell (outside free from parasites and inside renacred), a green hue around the gills (for the Fine Fattened Green Oysters or the Special Fattened Green Oysters) and natural purification. Breeding on oyster beds allows, in addition to the characteristics gained from maturing on oyster beds, the oysters to grow significantly (flesh and shell), and gives them a very specific texture and flavour.

improved presentation: certain organisms which colonise the outsides of the open sea oyster shells, such as barnacles and macrophytic algae, recede or disappear. Furthermore, being placed in oyster beds enables the oyster to increase the solidity of the insides of its shell by means of a renacring effect, |

improved quality outside the water: the quality of the packaged oysters is significantly superior where they come from oyster beds, as the strengthened shells which are the result of placement in oyster beds limits the inter-valvular loss of water during decreases in the water level, |

a more refined taste: the clay and mineral content of the soil and the walls is specific to the oyster bed. It helps to build up a nutritious substratum which is important for the development of the oyster's nourishment. Oysters placed in beds have access to this nourishment which is specific to the bed. acquisition of the green hue around the gills (not systematic): the wall of the oyster beds can naturally become covered by a diatom known as Navicula ostrea which produces a blue pigment.
