RECOMMENDATION OF THE EUROPEAN CENTRAL BANK

to the Council of the European Union on the external auditors of the European Central Bank

THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,
Having regard to the Statute of the European System of Central Banks and of the European Central Bank, and in particular Article 27.1 thereof,
Whereas:
(1) |
The accounts of the European Central Bank (ECB) and of the national central banks of the Eurosystem are audited by independent external auditors recommended by the ECB's Governing Council and approved by the Council of the European Union. |
(2) |
The mandate of the current external auditors of the ECB ended following the audit for the financial year 2007. It is therefore necessary to appoint external auditors from the financial year 2008. |
(3) |
The ECB has selected PricewaterhouseCoopers Aktiengesellschaft Wirtschaftsprüfungsgesellschaft as its external auditors for the financial years 2008 to 2012, |
HAS ADOPTED THIS RECOMMENDATION:
It is recommended that PricewaterhouseCoopers Aktiengesellschaft Wirtschaftsprüfungsgesellschaft should be appointed as the external auditors of the ECB for the financial years 2008 to 2012.

COMMISSION OPINION
of 7 May 2008
concerning the plan for the disposal of radioactive waste arising from the dismantling of the BR3 Pressurised Water Reactor, located at the SCK-CEN site in Belgium, in accordance with Article 37 of the Euratom Treaty

On 22 July 2005, the European Commission received from the Government of Belgium, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the dismantling of the BR3 Pressurised Water Reactor.
On the basis of these data and additional information requested by the Commission on 15 November 2005 and on 7 May 2007 and provided by the Belgian authorities on 19 March 2007 and on 9 November 2007, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

The distance between the plant and the nearest point of another Member State, in this case the Netherlands is approximately 10 km. |
2. |
During normal dismantling operations, the discharges of liquid and gaseous effluents will not cause an exposure liable to affect the health of the population in other Member States. |
3. |
Radioactive solid waste arising from the dismantling operations will be transferred to the Belgoprocess plc site (adjacent to the BR3 site) for treatment, conditioning and interim storage. |
4. |
Non-radioactive solid waste and materials in compliance with clearance levels will be released from regulatory control for disposal as conventional waste or for recycling or reuse. This will be done in compliance with the criteria laid down in the Basic Safety Standards (Council Directive 96/29/Euratom). |
5. |
In the event of unplanned discharges of radioactive waste which may follow an accident of the type and magnitude considered in the General Data, the doses received in other Member States will not be liable to affect the health of the population. |
In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form arising from the dismantling of the BR3 reactor at the SCK-CEN site in Belgium, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

(3) Ship for which the access refusal order was subsequently lifted in accordance with the procedures described in part B of Annex XI to Directive 95/21/EC.

3.2. Description of the product to which the name ‘Radiccho di Verona’ applies
The PGI ‘Radicchio di Verona’ denotes the product obtained from plants belonging to the Compositae family, Cichorium genus, intybus species, early and late Rossa di Verona variety.
The plants of ‘Radiccho di Verona’ PGI have whole, sessile leaves with smooth, unbroken edges, curving upwards to resemble a shower head. With the help of low winter temperatures, these acquire their typical intense dark red colour and, layered closely together, give the head its typical compact heart shape. The main vein structure of the leaves is highly developed and white in colour.
There are two types of ‘Radiccho di Verona’: ‘early’ and ‘late’, which have the following characteristics:
— ‘early variety’: the head weighs 150-350 grams; sowing takes place between 1 and 20 July and harvesting begins on 1 October, with production per hectare of finished product not exceeding 13 tonnes,
— ‘late variety’: the head weighs 100-300 grams; sowing takes place between 21 July and 15 August and harvesting begins on 15 December, with production per hectare of finished product not exceeding 11 tonnes; harvesting should ensure that a significant part of the main root is kept (at least 8 centimetres) and for this variety, successive phases of processing are necessary, consisting of a forcing and blanching phase, during which the leaves acquire their typical crispness and slightly bitter taste.
When released for consumption, ‘Radicchio di Verona’ PGI should, in addition to having the above typical characteristics, be precisely and carefully trimmed with the head and root washed and cleaned and be uniform in terms of the size and length of the heads and the small section of root which remains attached to the head. The head should also have a compact appearance and be tight at its tip, be slightly elliptical in shape, with a very clear and open leaf vein structure. The foliage is dark red in colour and is not variegated. The colour of the main leaf vein is entirely white right down to the base. The heads should be whole, healthy (therefore products affected by rot or other variations which make them unfit for consumption are excluded), fresh in appearance, free from parasites and parasite damage, free from abnormal levels of external moisture and free from extraneous odours and/or flavours.
‘Radicchio di Verona’ PGI is sold with a small (no more than 4 cm long), but nevertheless appreciable, part of the main root attached, the diameter of which is in proportion to the size of the head itself.

3.5. Specific steps in production that must take place in the identified geographical area
The sowing/transplanting, collection, forcing-blanching, trimming and washing operations should take place in the production area indicated in point 4.
3.6. Specific rules concerning slicing, grating, packaging, etc.
‘Radicchio di Verona’ PGI should be packaged in the defined area, since transport and excessive handling can result in a head that is less compact and more prone to ageing, thus altering the quality of the product. ‘Radicchio di Verona’ PGI should be marketed in sealed packaging that meets the following specification, and complies with Community legislation:

trays made of cardboard and/or wood and/or synthetic material, |

baskets made of cardboard and/or wood and/or synthetic material, |
— |
30 × 40 cm packages made of cardboard and/or wood and/or synthetic material, |
— |
30 × 50 cm packages made of cardboard and/or wood and/or synthetic material, |
— |
40 × 60 cm packages made of cardboard and/or wood and/or synthetic material, |
— |
resin-treated bags of 0,5, 1 or 1,5 kg. |
Each package should contain only one layer of the product and it should be sealed in such a way that opening the wrapper causes the seal to break.
3.7. Specific rules on labelling
In addition to the designation and Community logo, the packaging should clearly and legibly state the name, business name and address of the packager, the weight, date and place of packaging, expiry date and all other information required under national or Community legislation.
The logo is formed of three ‘Radicchio di Verona’ hearts, together with lines and a blue stripe representing the Verona Arena and the river Adige, to reflect its geographical origin.
The ‘Radicchio di Verona’ PGI may not contain any additional information not included in this single document. Reference may be made to the name of the farm where the product was produced and its location. The farm's stamp may also be used.
In any event, the font used for the words ‘Radicchio di Verona’ IGP should be significantly larger than any other used.
4. Concise definition of the geographical area
‘Radicchio di Verona’ IGP is produced in the following municipalities, all within the Veneto region of Italy:
In the province of Verona, the municipalities of: Trevenzuolo, Salizzole, Nogara, Concamarise, Sanguinetto, Cerea, Casaleone, Legnago, Minerbe, Roveredo di Guà, Cologna Veneta, Veronella, Arcole, Zimella, Isola della Scala, Bovolone, Bevilacqua, S. Pietro di Morubio, Roverchiara, Gazzo Veronese, Sorgà, Erbè, Oppeano, Isola Rizza, Albaredo d'Adige, Pressana, Villa Bartolomea, Castagnaro, Terrazzo, Boschi S. Anna, Angiari and Bonavigo.
In the province of Vicenza, the municipalities of: Asigliano Veneto, Pojana Maggiore, Noventa Vicentina, Campiglia dei Berici, Agugliaro, Sossano, Villaga, Albettone, Orgiano, Alonte, Lonigo, Barbarano Vicentino and San Germano dei Berici.
In the province of Padua, the municipalities of: Casale di Scodosia, Castelbaldo, Masi, Megliadino S. Fidenzio, Megliadino S. Vitale, Merlara, Montagnana, Ospedaletto Euganeo, Saletto, S. Margherita d'Adige, Lozzo Atestino and Urbana.
5. Link with the geographical area
5.1. Specificity of the geographical area
The area in which Radicchio di Verona PGI is produced contains sandy ground, rich in organic substances and which is deep, well drained, fresh and very fertile. The climate, which is especially favourable to production, is continental with very hot, close summers and cold, foggy winters. The annual temperature range is wide, while rainfall, although well distributed throughout the year, is limited.
5.2. Specificity of the product
The specific characteristics which distinguish Radicchio di Verona PGI from other products in the same product category are the uniquely crisp leaves, the intense red colour and the slightly bitter taste.
5.3. Causal link between the geographical area and the quality or characteristics of the product (for PDO) or a specific quality, the reputation or other characteristic of the product (for PGI)
Radicchio di Verona PGI has a long-standing and well-established reputation. It was first grown commercially in the early 20th century, despite dating back to the late 18th century in ‘broli’ (kitchen gardens). It is also featured in Jaccini's agricultural survey of 1882 (volume 5, part I). It was grown in the high plains of Verona, between rows of fruit trees and vines. ‘Radicchio di Verona’ is also mentioned in the ‘Monografia della provincia di Verona’ by the regio prefetto, Count Luigi Sormano Moretti (Florence, 1911).
Giovanni Rorato, in ‘Cucina veneta’, describes chicory as: ‘Flowers on a table. There is no doubt that chicory has found its home in the Veneto, for it is here that this foodstuff has been grown for centuries, although specialised and selective cultivation did not begin until the end of the 19th century. Today, in the Veneto region, selection has yielded many different types of chicory: red Treviso chicory, Castelfranco variegated chicory, “radicchio di Chioggia”, “radicchio di Verona” (which is also red) and, lastly, “Radicchio variegato di Lusia”, from Polesine …’.
Radicchio di Verona has an undisputed reputation, one which benefits considerably from its use as a key ingredient in many traditional veneto dishes (chicory omelette, chestnut cappelletti in a nut and chicory sauce, chicory fagottini, etc.).
Its compact head, crisp leaves and unique, slightly bitter taste are certainly linked to the environment which characterises the area in which it is produced. The continental climate, the low winter temperatures and the nature of the sandy earth, rich in organic substances, and deep, well drained, fresh and extremely fertile, are the reasons for these organoleptic properties.
The centuries-old work of mankind, the skill with which it has been grown, and the constant search for and implementation of traditional and specific cultivation methods have contributed to Radicchio di Verona's reputation, one which is recognised in both specific agricultural and scientific literature and commercially.

Notice to importers in the European Union that propose to import in 2009 controlled substances that deplete the ozone layer under Regulation (EC) No 2037/2000 of the European Parliament and of the Council on substances that deplete the ozone layer

I. |
This Notice is addressed to undertakings that intend to import the following substances into the European Community from sources outside the European Community from 1 January 2009 to 31 December 2009:

II. |
Article 7 of Regulation (EC) No 2037/2000 of the European Parliament and of the Council (1) requires that quantitative limits are determined and quotas allocated to importers (including producers that import controlled substances) for 1 January 2009 to 31 December 2009 in accordance with the procedure referred to in Article 18(2) for the import of the substances listed under Groups I to IX of Annex I to this Notice (2). Quotas shall be allocated for:
The quantitative limit, which importers may place on the market and/or use for their own account within the European Community in 2009, will be calculated:

III. |
Undertakings engaged in the importation of HCFCs can be either (3):

IV. |
The quantities imported from 1 January 2009 to 31 December 2009 are subject to import licences. In accordance with Article 6 of the Regulation, undertakings may import the controlled substances only if they are in possession of an import licence issued by the Commission. |
V. |
For the purposes of the Regulation, quantities of substances are measured according to their Ozone Depleting Potential (6). |
VI. |
The Commission hereby gives notice to an undertaking that is not in possession of a quota for 2008 and who wishes to apply to the Commission for an import quota from 1 January 2009 to 31 December 2009, to notify the Commission thereof no later than 1 July 2008 by submitting the registration form available online at: http://ec.europa.eu/environment/ozone/ods.htm Following their registration in the ODS-database they also need to follow the procedure described in VII. |
VII. |
Undertakings that received a quota in 2008 should make a declaration by completing and submitting the relevant import declaration form online via the ODS-database available at: http://ec.europa.eu/environment/ozone/ods.htm. In addition to the online submission a signed copy of the import declaration form needs to be sent to the Commission:

VIII. |
Only applications received by 1 August 2008 will be considered by the Commission. Import quotas will be allocated for each importer in consultation with the Management Committee following the procedures specified under Article 18 of the Regulation. The allocated quota will be available in the ODS-database: http://ec.europa.eu/environment/ozone/ods.htm and all applicants will have the Decision notified by post. The submission of an import declaration and the allocation of a quota by itself do not give any right to perform imports. |
IX. |
In order to import controlled substances in 2009, undertakings in receipt of a quota must apply to the Commission via the ODS-database for an import licence using the online import licence application form. Provided the Commission services are satisfied that the request is in accordance with the quota authorised and conforms to the requirements of Regulation (EC) No 2037/2000, an import licence will be issued. The Commission reserves the right to withhold an import licence when the substance to be imported is not as described or may not be used for the purposes authorised or cannot be imported in compliance with the Regulation. |
X. |
Undertakings importing recovered or reclaimed substances, if any, are required to submit additional information with each licence application regarding the source and destination of the substance, and the processing to be undertaken. A certificate of analysis may also be requested. Only undertakings having destruction facilities using a technology approved by the Parties to the Montreal Protocol may be allocated an import quota for destruction. |

I. |
This Notice is addressed to undertakings that intend to export the following substances from the European Community during the period 1 January 2009 to 31 December 2009:

II. |
Pursuant to Article 11 of Regulation (EC) No 2037/2000 of the European Parliament and of the Council (1), exports from the Community of chlorofluorocarbons, other fully halogenated chlorofluorocarbons, halons, carbon tetrachloride, 1,1,1-trichloroethane and hydrobromofluorocarbons or products and equipment, other than personal effects, containing those substances or whose continuing function relies on supply of those substances shall be prohibited. This prohibition shall not apply to exports of:
Exports from the Community of methyl bromide and hydrochlorofluorocarbons to any State not party to the Protocol shall be prohibited. |
III. |
Article 12 of the Regulation (EC) No 2037/2000 requires the authorisation of exports of the substances listed in Annex I to this notice. Such export authorisations should be issued by the European Commission after verification of compliance to Article 11 of the Regulation. |
IV. |
The Commission hereby gives notice to any undertaking that wishes to export controlled substances between 1 January 2009 and 31 December 2009 and have never been issued an export authorisation before to notify the Commission thereof no later than 1 July 2008 by submitting the registration form available online at: http://ec.europa.eu/environment/ozone/ods.htm Following their registration in the ODS-database they also need to follow the procedure described in V. |
V. |
Undertakings who were issued an export authorisation in previous years should make a declaration by completing and submitting the relevant export declaration form online via the ODS-database available at: http://ec.europa.eu/environment/ozone/ods.htm. The Commission reserves the right to withhold an EAN when the substance to be exported is not as described or may not be used for the purposes authorised or cannot be exported in compliance with the Regulation. |
VIII. |
To verify the description of the substance and the purpose of the export, the Commission may ask the applicant to submit additional information for consideration of a request for an EAN for exports to satisfy the basic domestic needs or to satisfy essential or critical uses of Parties in the context of Article 11(1)(a) and 11(1)(b) of the Regulation. This concerns especially:
The Commission reserves the right to issue such an EAN only after the competent authority in the destination country confirmed the purpose of the exports and that the export will not trigger a non-compliance status in relation to the provisions of the Montreal Protocol. |

This Notice concerns the following substances:

This notice is addressed to users that intend to:

III. |
Controlled substances for essential uses may be obtained from production within the Community and, if necessary, by import from sources outside the Community. |
IV. |
Decision IV/25 and Decision XIX/13 of the Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer set out criteria and a procedure for determining ‘essential uses’ for which continued production and consumption are allowed after phase-out. |
V. |
Article 3(1) of Regulation (EC) No 2037/2000 of the European Parliament and of the Council (1) requires the determination of quantities for essential uses of the above-mentioned controlled substances which may be permitted in the Community in 2008 if no adequate alternatives are available and in accordance with Decision IV/25 and Decision XIX/13 of the Parties to the Montreal Protocol (2). |
VI. |
The Parties to the Montreal Protocol may take a Decision in November 2008 authorising the maximum levels of production of CFCs for essential uses in 2009 for metered dose inhalers (MDIs) for the treatment of asthma and chronic obstructive pulmonary diseases as specified in Annex I, subject to the conditions established by the Meeting of the Parties in paragraph 2 of its Decision VII/28. |
VII. |
Decision XVIII/15 and Decision XIX/18 of the Parties to the Montreal Protocol authorises the production and consumption necessary to satisfy essential uses of controlled substances listed in Annexes A, B and C (Group II and III substances) of the Montreal Protocol for laboratory and analytical uses. Authorised uses are listed in Annex IV to the report of the Seventh Meeting of the Parties, subject to the conditions set out in Annex II to the report of the Sixth Meeting of the Parties. The uses listed in paragraph 6 of Decision VII/11, subparagraphs (a) to (c) of Decision XI/15 and in subparagraph (3) of Decision XIX/18 are excluded from the allowed laboratory and analytical uses. |
VIII. |
In accordance with Decision X/19 of the Parties to the Montreal Protocol, the purity of controlled substances for laboratory and analytical uses should be at least 99,0 % for 1,1,1-trichloroethane and 99,5 % for CFCs and carbon tetrachloride. These high purity substances and mixtures containing controlled substances shall be supplied only in re-closable containers or high pressure cylinders smaller than three litres or in 10 millilitre or smaller glass ampoules, marked clearly as substances that deplete the ozone layer, restricted to laboratory and analytical uses and specifying that used or surplus substances should be collected and recycled wherever possible. The material should be destroyed following the procedures described in Article 16(1) of the Regulation if recycling is not practical. |

The procedure for allocating quantities of controlled substances for the above essential uses carried out under Regulation (EC) No 2037/2000 and Regulation (EC) No 2038/2000 of the European Parliament and of the Council is the following:
For CFCs for use in MDIs, all registered undertakings will receive an application form from the Commission. For Laboratory Uses, each applicant should apply by completing the relevant Essential Laboratory Use form online via the ODS-database available at: http://ec.europa.eu/environment/ozone/ods.htm. In addition to the online submission a signed print of the import declaration form needs to be sent to the Commission:

XI. |
Only applications received by 1 August 2008 will be considered by the Commission. |
XII. |
The Commission will issue quotas to those users and shall notify them of the use for which they have authorisation, the substance they are authorised to use and the quantity of the controlled substances concerned. |
XIII. |
Following the above procedure the Commission will notify applicants by a Decision of the quantities of controlled substances allowed for essential uses in the community in 2009 for which production and importation will be permitted. |
XIV. |
Those users holding an essential use quota for a controlled substance for 2009 will be able to make a request to a Community producer via the ODS-database or, if necessary, request an import licence from the Commission for a controlled substance up to their quota limit. The producer must be authorised by the competent authority of the Member State in which its relevant production is situated to produce the controlled substance for meeting that licensed demand. The competent authority of the Member State shall notify the Commission well in advance of any such authorisation. |
