Initiation of proceedings

(Case COMP/M.4874 — Itema/BarcoVision)

(Council Regulation (EC) No 139/2004)

On 15 April 2008, the Commission decided to initiate proceedings in the above-mentioned case after finding that the notified concentration raises serious doubts as to its compatibility with the common market. The initiation of proceedings opens a second phase investigation with regard to the notified concentration, and is without prejudice to the final decision on the case. The decision is based on Article 6(1)(c) of Regulation (EC) No 139/2004.

The Commission invites interested third parties to submit their observations on the proposed concentration to the Commission.

In order to be fully taken into account in the procedure, observations should reach the Commission not later than 15 days following the date of this publication. Observations can be sent to the Commission by fax ((32-2) 296 43 01 or 296 72 44) or by post, under reference number COMP/M.4874 — Itema/BarcoVision, to the following address:

Maximum aid intensity: Aid may be granted to livestock farmers at a rate of up to 70 % of the value of subsidised services for tests to determine the genetic quality or productivity of livestock, with the exception of checks undertaken by the owner of the livestock and routine checks on milk quality

Further information: State aid is granted in the form of subsidised services, via an accredited breeders' organisation or a recognised stock-farming organisation.

Grants are applied for by accredited breeders' organisations or recognised stock-farming organisations. Aid may be granted only to small and medium-sized enterprises, pursuant to Annex I to Commission Regulation (EC) No 70/2001 of 12 January 2001 on the application of Articles 87 and 88 of the Treaty to State aid to small and medium-sized enterprises.

Applications for grants are to be submitted, in response to an invitation issued by the paying agency, to the relevant regional office of the paying agency by 31 January of the calendar year concerned. In 2007, applications are to be submitted by 30 September.

On the basis of the applications received, the paying agency adds together all the eligible grant applications received in the relevant calendar year. If the total for such applications exceeds the amount of funding available in the budget, the paying agency sets a conversion coefficient by means of which the grant entitlement is re-calculated for each applicant.

Grants will be made on the basis of a grant-award contract concluded between the paying agency and the applicant. The accredited breeders' organisation or recognised stock-farming organisation takes the grant received into account when providing the service, up to 70 % of the value of the service, but not exceeding the amount of the grant.

Maximum aid intensity:

1.   Investment in agricultural holdings for primary production:

up to 50 % of eligible costs in less-favoured areas and up to 40 % of eligible costs in other areas,

up to 60 % of eligible costs in less-favoured areas, and up to 50 % of eligible costs in other areas, in the case of investments made by young farmers within five years of setting up.

The purpose of the aid is investment to restore farm features and to purchase equipment to be used for agricultural production, to invest in permanent crops, to improve farmland and to manage pastures.

2.   Aid for conserving traditional buildings:

for non-productive features, up to 100 % of actual costs,

for productive assets on farms, up to 60 % of actual costs, or 75 % in less-favoured areas, provided that the investment does not entail any increase in the production capacity of the farm,

additional aid may be granted at a rate of up to 100 % to cover the extra costs incurred by using traditional materials necessary to preserve the heritage features of buildings.

3.   Relocation of farm buildings in the public interest:

up to 100 % of actual costs where the relocation simply consists of the dismantling, removal and re-erection of existing facilities,

where the relocation results in the farmer benefiting from more modern facilities, the farmer must contribute at least 60 %, or 50 % in less-favoured areas, of the increase in the value of the facilities concerned after relocation. If the beneficiary is a young farmer, this contribution is to be at least 55 % or 45 % respectively,

where the relocation results in an increase in production capacity, the contribution from the beneficiary must be at least 60 %, or 50 % in less-favoured areas, of the expenses relating to this increase. If the beneficiary is a young farmer, this contribution is to be at least 55 % or 45 % respectively.

4.   Aid towards the payment of insurance premiums:

the amount of municipal co-financing is the difference between the amount of co-financing of insurance premiums from the national budget and up to 50 % of eligible costs of an insurance premium for insuring crops and fruit and insuring livestock against disease.

5.   Aid for land reparcelling:

up to 100 % of actual legal and administrative costs incurred.

6.   Aid to encourage the production of quality agricultural products:

up to 100 % of costs incurred; this is to be provided in the form of subsidised services and must not involve direct payments of money to producers.

7.   Provision of technical support in the agricultural sector:

up to 100 % of costs in the form of subsidized services for education and training of farmers, consultancy services, the organisation of forums, competitions, exhibitions and fairs, publications, catalogues and websites, and for disseminating scientific knowledge

If the beneficiary is a young farmer, his contribution shall be at least 55 % or 45 % respectively,

where the relocation results in an increase in production capacity, the contribution from the beneficiary must be at least equal to 60 %, or 50 % in less-favoured areas, of the expenses relating to this increase. If the beneficiary is a young farmer, his contribution shall be at least 55 % or 45 % respectively.

4.   Aid towards the payment of insurance premiums:

the amount of municipal co-financing is the difference between the amount of co-financing of insurance premiums from the national budget and up to 50 % of eligible costs of insurance premiums for insuring crops and fruit and for insuring livestock against disease.

5.   Aid for land reparcelling:

up to 100 % of actual legal and administrative costs incurred.

6.   Aid to encourage the production of quality agricultural products:

up to 100 % of actual costs incurred or of activities, insofar as they relate to improving the quality of agricultural products. The aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers.

7.   Provision of technical support in the agricultural sector:

Objective of aid: The objectives of the notified Measure are to grant compensation for loss of income to pig, sheep-and-goat and cow farmers who have been affected by restrictive measures taken by the public authorities to deal with the situation following detection by the Community Laboratory of cases of foot-and-mouth disease in Cyprus (1). To be specific, the measures that have been taken do not allow, inter alia, the export of pigs, pig meat, pig sperm and other types of meat. The outcome is that the weight of the animals and, in particular, their density increase, which is prejudicial to their welfare. In order to improve their welfare, a number of the animals need to be removed immediately and aid has to be granted to livestock farmers in respect of the resultant income losses. Aid is also granted under the Measure for loss of income resulting from the fact that the animals' heads, liver and sperm are not marketed. Lastly, in the case of sheep-and-goat farmers, the Measure provides for compensation for loss of income due to the additional feeding costs incurred as a result of the obligation not to allow the animals to graze freely within the 10-kilometre surveillance zone.

The Measure is based on Article 10 of Regulation No 1857/2006, which provides that aid of 100 % may be granted in respect of income losses incurred as a result of livestock-quarantine obligations

Notice of the impending expiry of certain anti-dumping measures

The Commission gives notice that, unless a review is initiated in accordance with the following procedure, the anti-dumping measures mentioned below will expire on the date mentioned in the table below, as provided in Article 2 of Council Regulation (EC) No 1205/2007 of 15 October 2007 imposing anti-dumping duties on imports of integrated electronic compact fluorescent lamps (CFL-i) originating in the People's Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EC) No 384/96 and extending to imports of the same product consigned from the Socialist Republic of Vietnam, the Islamic Republic of Pakistan and the Republic of the Philippines (1).

2.   Procedure

Community producers may lodge a written request for a review. This request must contain sufficient evidence that the expiry of the measures would be likely to result in a continuation or recurrence of dumping and injury.

Should the Commission decide to review the measures concerned, importers, exporters, representatives of the exporting country and Community producers will then be provided with the opportunity to amplify, rebut or comment on the matters set out in the review request.

3.   Time limit

Community producers may submit a written request for a review on the above basis, to reach the European Commission, Directorate-General for Trade (Unit H-1), J-79 4/23, B-1049 Brussels (2) at any time from the date of the publication of the present notice but no later than three months before the date mentioned in the table below.

This notice is published in accordance with Article 11(2) of Council Regulation (EC) No 384/96 (3).

Prior notification of a concentration

On 11 April 2008, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Sofinco SA (‘Sofinco’, France) a subsidiary of Crédit Agricole SA (‘CASA’, France) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Agos SpA (‘Agos’, Italy) by way of purchase of shares.

The business activities of the undertakings concerned are:

for Sofinco: undertaking specialised in consumption credit in France and internationally,

for Agos: undertaking specialised in consumption credit in Italy.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
