Explanatory Notes to the Combined Nomenclature of the European Communities

Pursuant to Article 9(1)(a), second indent, of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), the Explanatory Notes to the Combined Nomenclature of the European Communities (2) are amended as follows:

Non-opposition to a notified concentration

(Case COMP/M.4867 — BNP Paribas/Natixis/Slib)

On 31 March 2008, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. The full text of the decision is available only in French and will be made public after it is cleared of any business secrets it may contain. It will be available:

Generally the date of cessation of presumption of conformity will be the date of withdrawal (‘dow’), set by the European Standardisation Organisation, but attention of users of these standards is drawn to the fact that in certain exceptional cases this can be otherwise.

Note 2.1

The new (or amended) standard has the same scope as the superseded standard. On the date stated, the superseded standard ceases to give presumption of conformity with the essential requirements of the directive.

Note 3

In case of amendments, the referenced standard is EN CCCCC:YYYY, its previous amendments, if any, and the new, quoted amendment. The Agency is responsible for co-ordinating the evaluation and supervision of medicinal products for human and veterinary use in the European Union (see Regulation (EC) No 726/2004 of the European Parliament and of the Council — OJ L 136, 30.4.2004, p. 1). The EMEA was established in January 1995. It has many close contacts with the European Commission, 27 EU Member States, EEA-EFTA countries and many other groups in government and the private sector.

The European Medicines Agency is organising a selection procedure with a view to drawing up a reserve list for:

—   EMEA/AD/270: Administrator (International liaison officer), Executive Support (AD8).

Selected candidates will be included on a reserve list and, depending on the budgetary situation, may be offered a five-year renewable contract in accordance with the Conditions of employment of other servants of the European Communities ( Official Journal of the European Communities L 56 of 4.3.1968).

On 4 April 2008, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings EADS NV (‘EADS’, the Netherlands) and Sita France SA (‘Sita’, France) controlled by Suez group (France) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking T.A.R.M.A.C. Aerosave SAS (‘T.A.R.M.A.C. Aerosave’, France) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for EADS: aerospace, defence and related services,

for Suez: management of public utilities in the field of electricity, natural gas, energy services, water and waste management,

for T.A.R.M.A.C. Aerosave: aircraft storage, aircraft decommissioning and spare parts recovery.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

The business activities of the undertakings concerned are:

for ČEZ: an integrated energy conglomerate based in the Czech Republic,

for MOL: an integrated oil and gas company based in Hungary,

for the joint venture: development of gas-fired power generation plants and related gas infrastructure in Slovakia, Hungary, Croatia and Slovenia.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.
