List of international control and supervisory agencies (hereafter referred to as ‘supervisory agencies’) approved by the Member States under Annex VI to Commission Regulation (EC) No 800/1999

1.   GENERAL

Under Article 16(1)(b) and (2)(c) of Commission Regulation (EC) No 800/1999 (1), supervisory agencies approved by the Member States, are authorised to issue certificates certifying the unloading and importation of agricultural products qualifying for export refunds in third countries or, at least, their arrival at destination in third countries.

Furthermore, supervisory agencies approved and controlled by a Member State in accordance with Articles 16(a) to 16(f) of Regulation (EC) No 800/1999 or an official agency of the Member State shall be responsible for carrying out checks provided for in Article 3 of Commission Regulation (EC) No 639/2003 (2) (granting requirements of export refunds related to the welfare of live bovine animals during transport).

The Member States are responsible for approving and monitoring these supervisory agencies.

Approval of a supervisory agency by one Member State is valid in all Member States. This means that certificates issued by approved supervisory agencies may be used throughout the Community, irrespective of the Member State in which the agency issuing the certificate is based.

For the information of Community exporters of agricultural products, the Commission periodically publishes a list of all the supervisory agencies approved by the Member States. The attached list was updated on 1st June 2007.

2.   NOTICE

The Commission draws the attention of exporters to the following:

The fact that a particular supervisory agency appears on the list does not automatically guarantee that certificates issued by that agency are acceptable. Additional documentary evidence may be required. It may also become apparent later that certificates issued are inaccurate.

Agencies may be taken off the list at any time. Before settling on a particular agency, exporters are accordingly advised to check with the national authorities (cfr Annex X of Regulation (EC) No 800/1999) that it is still approved.

Exporters can obtain further information on any agency from the national authority which approved it.

By means of the following letter dated 5 June 2007, the Commission notified Germany of its decision to close the procedure initiated under Article 88(2) of the EC Treaty.

‘Procedure

(1)

By e-mail dated 24 October 2005, registered on 25 October 2005, Austria notified to the Commission the above-mentioned measure.

(2)

Following the notification, the Commission requested additional information by letter dated 6 December 2005. Austria replied by e-mail of 9 January 2006, registered on the same day.

(3)

By letter dated 8 March 2006, the Commission informed Austria that it had decided to initiate the procedure laid down in Article 88(2) of the EC Treaty in respect of the notified measure. The case was registered as C 8/06. The decision of the Commission to initiate the procedure was published in the Official Journal of the European Union  (1) and interested parties were invited to submit their comments.

After a delay extension was granted, Austria submitted its observations by letter dated 20 April 2006, registered on 21 April 2006. No comments from any interested party were received.

On 21 June 2006, a meeting between the Commission and Austria took place, including representatives of Stadt Dornbirn, of Dornbirner Sparkasse and of the Austrian Savings Banks Association. It was followed up by two Commission requests for additional information dated 6 July 2006 and 16 August 2006. After a further delay extension requested by Austria and granted by the Commission, Austria sent the information by letters dated 13 July and 8 November 2006 and by e-mail dated 12 December 2006.

By letter of 18 April 2007, Austria informed the Commission that they formally withdraw their notification based on Article 8 of the Procedural Regulation (Council Regulation (EC) No 659/1999) and asked the Commission to terminate the formal investigation procedure.

Decision

The Commission has accordingly decided to close the formal investigation procedure under Article 88(2) of the EC Treaty, initiated on 8 March 2006 in respect of the aid referred to above, because it has become without object.’

On 20 July 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking London Acquisition B.V. (‘London Acquisition’, The Netherlands), ultimately controlled by Candover Investments plc (‘Candover’, UK), acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Stork N.V. (‘Stork’, The Netherlands) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

Candover: a private global investment firm. Candover is an arranger and provider of private equity for large European buy-outs,

Stork: an industrial group active in the following sectors: Stork Aerospace, Stork Food Systems, Stork Technical Services and Stork Prints.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

On 23 July 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), by which Flextronics International Ltd (‘Flextronics’, Singapore), acquires, within the meaning of Article 3(1)(b) of the Council Regulation, sole control Solectron Corporation (‘Solectron’, USA) by way of purchase of shares.

The business activities of the undertakings concerned are:

for Flextronics: electronics manufacturing services,

for Solectron: electronics manufacturing services.

On preliminary examination, the Commission finds that the notified concentration could fall within the scope of Regulation (EEC) No 139/2004. However, the final decision on this point is reserved.
