COUNCIL DECISION

of 16 February 2007

appointing members of the European Social Fund Committee

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 147 thereof,

Having regard to Council Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999 (1), and in particular Article 104(3) thereof,

Having regard to the proposal from the Commission,

Whereas:

Under Council Decision 2005/C 252/01 of 24 September 2004 renewing the membership of the European Social Fund Committee (2)(hereinafter the Committee), the term of office of the members expires on 30 April 2007.

(2)

Article 104(2) of Regulation (EC) No 1083/2006 sets out different requirements for the nomination of representatives and their alternates from those laid down in Article 49(1) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down provisions on the Structural Funds (3), therefore, the composition of the Committee should be respectively adjusted.

It is however appropriate that the Committee continues to carry out its tasks under its present set up till the end of the 2000-2006 programming period and the new set-up becomes operational only as from 1 January 2007.

Pending nomination of a representative and/or an alternate member for one of the categories referred to in Article 104(1) of Regulation (EC) No 1083/2006 by Belgium, Denmark, France, Greece and the United Kingdom, already nominated representatives and alternate members for the Committee should nevertheless be appointed in view of the start of the 2007-2013 programming period.

The members and alternate members of the Committee should therefore be appointed for a period of three years,

HAS DECIDED AS FOLLOWS:

Article 1

The persons listed in the Annex are hereby appointed members and alternate members of the European Social Fund Committee for the period 1 January 2007 to 31 December 2009.

Article 2

The Council Decision of 24 September 2004 is repealed from 31 December 2006.

Article 3

This Decision shall be published, for information, in the Official Journal of the European Union.

Notice of the impending expiry of certain anti-dumping and countervailing measures

(2007/C 52/10)

1.

As provided for in Article 11(2) of Council Regulation (EC) No 384/96 of 22 December 1995 (1) on protection against dumped imports from countries not members of the European Community and in Article 18(4) of Council Regulation (EC) No 2026/97 of 6 October 1997 (2) on protection against subsidised imports from countries not members of the European Community, the Commission gives notice that, unless a review is initiated in accordance with the following procedure, the anti-dumping and countervailing measures mentioned below will expire on the date mentioned in the table below.

2.   Procedure

Community producers may lodge a written request for a review. This request must contain sufficient evidence that the expiry of the measures would be likely to result in a continuation or recurrence of dumping/subsidisation and injury.

Should the Commission decide to review the measures concerned, importers, exporters, representatives of the exporting country and Community producers will then be provided with the opportunity to amplify, rebut or comment on the matters set out in the review request.

3.   Time limit

Community producers may submit a written request for a review on the above basis, to reach the European Commission, Directorate-General for Trade (Division B-1), J-79 5/16, B-1049 Brussels (3) at any time from the date of the publication of the present notice but no later than three months before the date mentioned in the table below.

4.

This notice is published in accordance with Article 11(2) of Council Regulation (EC) No 384/96 of 22 December 1995 and with Article 18(4) of Council Regulation (EC) No 2026/97 of 6 October 1997.

Communication from the Government of the Republic of Poland concerning Directive 94/22/EC of the European Parliament and of the Council of 30 May 1994 on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons

Pursuant to Article 3(2)(a) of Directive 94/22/WE of the European Parliament and of the Council of 30 May 1994 on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons and Article 11(2) of the Geological and Mining Law Act of 4 February 1994 (1), the Minister for the Environment hereby invites all interested parties to submit applications for authorisations for hydrocarbon prospecting and exploration, hereinafter referred to as ‘mining usufruct rights’.

2.

The subject of the tender is the establishment of mining usufruct rights for the prospection and exploration of oil and natural gas deposits in the areas (blocks) not covered by concessions, listed in the table published in the Official Journal of the European Union  (2) and on the website of the Department of Geology and Geological Concessions of the Ministry of the Environment (www.mos.gov.pl/dgikg/english). The geographical coordinates of the areas that are the subject of the tender may be found on the website of the Department of Geology and Geological Concessions of the Ministry of the Environment and in the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’.

Proposals for the establishment of mining usufruct rights may cover an area no smaller than that stipulated in the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’, but no greater than 1 200 km2.

4.

Mining usufruct rights shall be granted to the successful bidder for the duration of the concession for the exploration and prospection of oil and natural gas deposits.

5.

Proposals for the establishment of mining usufruct rights must be delivered to the central office of the Ministry of the Environment no later than 12 noon CET, on the last day of the 91-day period commencing on the day following the date of publication of the communication in the Official Journal of the European Union.

The tender committee shall evaluate the proposals received on the basis of the following criteria:

a.

Scope and technology proposed for conducting geological work (60 %),

b.

Technical and financial capacities of the bidder (30 %),

c.

Fee proposed for the establishment of mining usufruct rights (10 %).

The above criteria are described in more detail in the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’.

The proposals shall be opened in public at the central office of the Ministry of the Environment at 12 noon CET, on the fourteenth working day after the expiry of the deadline for the submission of proposals. The tender shall be finalised within a period of six months after the completion of the tender submission stage. Bidders shall receive written notification of the outcome of the tender.

To obtain a copy of the ‘Detailed conditions of the tender for the acquisition of mining usufruct rights for the exploration and prospection of oil and natural gas deposits in selected concession areas’ a written application should be submitted to the Department of Geology and Geological Concessions of the Ministry of the Environment. The conditions of the tender contain, among other things:

a.

Definition of the subject of the tender;

b.

Requirements with regard to the content of the proposal;

c.

Requirements that must be fulfilled by bidders;

d.

Information about documents to be submitted by bidders to confirm that they fulfill the necessary requirements, including an extract from the Register of Entrepreneurs;

e.

Objective proposal evaluation criteria;

f.

Definition of the location and deadlines for the submission and opening of proposals;

g.

Information about the appeals procedures available to bidders during the course of the tender procedure for the acquisition of mining usufruct rights;

h.

Model contract for the establishment of mining usufruct rights.

The rules for tenders for the acquisition of mining usufruct rights were established on the basis of the Regulation of the Council of Ministers of 21 June 2005concerning the tender procedure for the acquisition of mining usufruct rights  (3), which transposes the provisions of Directive 94/22/EC of the European Parliament and of the Council of 30 May 1994on the conditions for granting and using authorisations for the prospection, exploration and production of hydrocarbons.

Proposals shall be submitted in Polish.

11.

The successful bidder shall sign a contract for mining usufruct with the State Treasury, represented by the Minister for the Environment, and shall subsequently apply to the Minister for the Environment to obtain a concession for the prospection and exploration of oil and natural gas deposits.

12.

The enterprise in question must hold both mining usufruct rights and a concession in order to be able to carry out activity involving the prospection and exploration of hydrocarbon deposits in Poland.

Prior notification of a concentration

(Case COMP/M.4500 — Nemak/TK Aluminum ‘A’)

On 28 February 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking Tenedora Nemak, S.A. de C.V. (‘Nemak’, Mexico) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of parts of the undertaking TK Aluminum Ltd. (together TK Aluminum ‘A’, Bermuda) by way of purchase of shares and purchase of assets.

2.

The business activities of the undertakings concerned are:

for Nemak: active in the automotive components industry,

for TK Aluminum ‘A’: active in the manufacture and supply of cylinder heads, transmission components and other castings.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
