adjusting the basic salaries and allowances applicable to Europol staff

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Council Act of 3 December 1998 laying down the Staff Regulations applicable to Europol employees (1), (hereinafter referred to as Staff Regulations), and in particular Article 44 thereof,

Having regard to the initiative of the Republic of Finland (2),

Having regard to the opinion of the European Parliament (3),

Having regard to the review of remuneration of officials of Europol by the Management Board of Europol,

Whereas:

(1)

In the review of remuneration of officials of Europol, the Management Board took account of the changes in the cost of living in the Netherlands, as well as of the changes in salaries in the public service in the Member States.

(2)

The review period from 1 July 2005 to 30 June 2006 justifies an increase of 1,5 % of remuneration for the period from 1 July 2006 to 30 June 2007.

(3)

It is for the Council, acting unanimously, to adjust the basic salaries and allowances of officials of Europol, on the basis of the review,

HAS DECIDED AS FOLLOWS:

Article 1

The Staff Regulations are hereby amended as follows:

With effect from 1 July 2006:

in Article 45, the table of basic monthly salaries shall be replaced by the following:

INITIATIVE OF THE REPUBLIC OF FINLAND WITH A VIEW TO ADOPTING A COUNCIL DECISION

amending the Council Act adopting rules applicable to EUROPOL analysis files

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Convention on the establishment of a European Police Office (Europol Convention (1)), and in particular Article 10(1) thereof,

Having regard to the initiative by the Republic of Finland (2),

Having regard to the opinion of the European Parliament (3),

Having regard to the draft prepared by the Management Board of Europol,

Whereas:

(1)

The Europol Convention makes provision in Title III for work files for the purposes of analysis; changes thereto were introduced by the Protocol drawn up on the basis of Article 43(1) of the Convention on the Establishment of a European Police Office (Europol Convention), amending that Convention; in particular, amendments were made to Articles 10, 12, 16 and 21 of the Europol Convention, which constitute the framework for the opening of an analysis file and the collection, processing, utilization and deletion of personal data contained therein.

(2)

Implementing rules were adopted for work files for the purpose of analysis by Council Act (1999/C 26/01) of 3 November 1998 adopting rules applicable to Europol analysis files (4); these rules require to be amended as a consequence of the changes made by the said Protocol to the Europol Convention; the Act should therefore be amended accordingly.

(3)

After consulting the Joint Supervisory Body,

HAS ADOPTED THE FOLLOWING DECISION:

Article 1

Council Act (1999/C 26/01) adopting rules applicable to Europol analysis files is hereby amended as follows:

1)

in Article 3(1), the third subparagraph shall be replaced by the following:

‘After receipt, it shall be determined as soon as possible to what extent the data shall be included in a specific file.’;

2)

Article 5(3) shall be replaced by the following:

‘The orders mentioned in this Article, including later amendments, shall be established in accordance with the procedure stipulated by Article 12 of the Europol Convention.’;

3)

Article 7 shall be amended as follows:

(a)

in paragraph 1, the fourth subparagraph, shall be replaced by the following:

‘The review of the need for the continuation of an analysis work file according to Article 12(4) of the Europol Convention shall be carried out by the participants in the analysis. On the basis of this review, a decision shall be taken by the Director on the continuation or closure of the file. The Director shall inform the Management Board of his decision.’;

(b)

paragraph 3 shall be replaced by the following:

‘3.   Personal data may not be retained for a period longer than that mentioned in Article 12(4) of the Europol Convention. Where, as a consequence of the continuation of the analysis file, data concerning persons as referred to in Article 6(3) to (6) are stored in a file for a period exceeding five years, the Joint Supervisory Body shall be informed accordingly.’;

4)

Article 12 shall be amended as follows:

(a)

in paragraph 2, the first subparagraph shall be deleted and the text of the second subparagraph shall be preceded by the number ‘2.’;

(b)

in paragraph 3 shall be replaced by the following:

‘3.   Analysis activities and the dissemination of analysis results may begin immediately after the analysis file has been opened in accordance with Article 12(1) of the Europol Convention. Should the Management Board instruct the Director of Europol to amend an opening order or close the file, data which may not be included in the file or, if the file is to be closed, all data contained in that file, shall be deleted immediately.’;

5)

the following Article shall be inserted:

‘Article 12a

The retrieval of data by participants of the analysis project according to Article 10(2) of the Europol Convention shall only be granted after they have been accredited by Europol and following a training on their specific obligations under the Europol legal framework.’;

6)

Article 15(4) and (5) shall be deleted.

Article 2

This Decision shall enter into force on the first day following its publication in the Official Journal of the European Union.

Article 3

This Decision shall be published in the Official Journal of the European Union.

for the implementation of Action 1, Action 2 and Action 3 in the academic year 2008/2009 and Action 4 in the year 2007 of Erasmus Mundus

The Community Action programme for the enhancement of quality in higher education and the promotion of intercultural understanding through co-operation with third countries

Please note that the implementation of the present Call for proposals is subject to the adoption by the Commission of the annual work plan relating to the Erasmus Mundus programme in 2007

1.   Objectives and Description

The Erasmus Mundus programme's overall aim is to enhance the quality of European higher education by fostering co-operation with third countries in order to improve the development of human resources and to promote dialogue and understanding between peoples and cultures.

The following activities are covered by the call for proposals:

Select high-quality integrated masters courses which are offered by a consortium of at least three higher education institutions in at least three participating countries (Action 1);

Give scholarships to highly qualified graduate students and scholars from third countries to follow or participate in the selected masters courses (Action 2);

Select high-quality partnerships between selected masters courses and third-country higher education institutions (Action 3);

Select projects of at least three institutions in at least three participating countries aiming to improve accessibility and enhance the profile and visibility of higher education in the European Union (Action 4).

2.   Eligible applicants

Action 1: higher education institutions in the 27 EU Member States, the countries of the European Economic Area/European Free Trade Association (Iceland, Liechtenstein, Norway) and the candidate countries for accession to the EU (Croatia, Former Yugoslav Republic of Macedonia, and Turkey). As regards institutions from the candidate countries for accession to the EU they will be able to participate under the present call for proposals for Action 1 only if the official participation of these countries in the programme has been formalised through the relevant instruments governing the relations between the European Community and those countries before the selection decision is taken (October 2007). Otherwise, institutions coming from those countries are not eligible for Action 1 under the present call for proposals.

Action 2: individuals from third countries, i.e. any country other than the countries mentioned under Action 1 above;

Action 3: higher education institutions from all countries of the world;

Action 4: institutions from all countries of the world.

3.   Budget and project duration

The total budget earmarked for the funding of projects is estimated at EUR 88,9 millions. In case of Action 4, financial assistance cannot exceed 75 % of the total eligible costs.

Action 1: each grant will amount to EUR 15 000 annually. Masters courses must start between July and December 2008.

Action 2: each scholarship will amount to EUR 21 000 annually for each third-country student and a maximum of EUR 13 000 for each third-country scholar. Scholarships are for Masters courses starting in the academic year 2008/2009.

Action 3: each grant will amount to a minimum of EUR 5 000 and a maximum of EUR 15 000 annually plus allocations for the mobility of European students and scholars. Partnerships must start between July and December 2008 and will last for a maximum duration of 3 academic years.

Action 4: grants will vary according to the project size. Projects must start between 1 November and 15 December 2007 and will last for a maximum duration of 3 years.

On 15 February 2007 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), and following a referral pursuant to Article 4(5) of this Regulation, by which Berkshire Hathaway Inc. (‘Berkshire’, USA) acquires within the meaning of Article 3(1)(b) of the Council Regulation sole control of TTI Inc. (‘TTI’, USA) by way of transfer of shares.

2.

The business activities of the undertakings concerned are:

for Berkshire: diversified holding company engaged in numerous business activities, including insurance, and manufacturing sectors such as carpet, architectural and industrial coatings, insulation and building products and financial products;

for TTI: distributor of electromechanical components.

3.

On preliminary examination, the Commission finds that the notified concentration could fall within the scope of Regulation (EEC) No139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
