COUNCIL DECISION

of 18 September 2006

renewing the Governing Board of the European Centre for the Development of Vocational Training

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to Council Regulation (EEC) No 337/75 of 10 February 1975 establishing the European Centre for the Development of Vocational Training, and in particular Article 4 thereof (1),

Having regard to the lists of nominees submitted to the Council by the Governments of the Member States as regards their representatives, and by the Commission as regards the employees' and employers' representatives,

Whereas:

(1)

By its Decision of 6 March 2003 and 29 April 2004 (2), the Council appointed the members of the Governing Board of the European Centre for the Development of Vocational Training for the period from 6 March 2003 to 5 March 2006.

(2)

The members of the Governing Board of that Centre should be appointed for a period of three years,

Commission communication pursuant to Article 4(1)(a) of Council Regulation (EEC) 2408/92

Imposition of a public service obligation in respect of a scheduled air service within the United Kingdom

1.

Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes, the United Kingdom has decided to impose a public service obligation in respect of a scheduled air service between Cardiff and RAF Valley, Anglesey.

2.

The public service obligation is as follows

—   Minimum frequencies:

Two daily return flights on each day from Monday to Friday. No services are required to operate on Saturday and Sunday.

—   Capacity:

Total capacity per day of at least 36 passenger seats in each direction.

—   Fares:

The price of a single adult ticket must not exceed GBP 50 (including passenger service charge and security charge but excluding air passenger duty).

The maximum fare on the route may be increased once every year with the prior written consent of the National Assembly for Wales in line with the United Kingdom's Retail Price Index (all items) or any successor index to this.

No changes may be made to the fare levels without the prior written consent of the National Assembly for Wales.

The new maximum fares must be notified to the Civil Aviation Authority and to the European Commission, which may publish them in the Official Journal of the European Union.

Prior notification of a concentration

(Case COMP/M.4321 — Siemens/Bayer Diagnostics)

1.

On 26 September 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the German undertaking Siemens AG (‘Siemens’, Germany) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of Bayer Diagnostics, the Diagnostic division of Bayer Healthcare, a business unit of Bayer AG (‘Bayer’, Germany) by way of combined purchase of shares and assets.

2.

The business activities of the undertakings concerned are:

for Siemens: diversified company active in various manufacturing, technology and services business activities, including medical systems. Within the latter, active in-vitro diagnostics through its subsidiary Diagnostic Products Corporation;

for Bayer Diagnostics: development, manufacture and sales of in-vitro diagnostic systems for hospitals, medical laboratories and physicians' offices.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Prior notification of a concentration

Candidate case for simplified procedure

1.

On 25 September 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking Compagnie Plastic Omnium SA (‘Plastic Omnium’, France) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking INOPART SA (‘Inopart’, France), undertaking in which Plastic Omnium currently holds 49,01 % of the shares, by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Plastic Omnium: active in the plastic industry, for the production of automobile components, environmental services and high tech products,

for Inopart: automobile components.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
