The Commission draws attention to the judgement delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94 — ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

This judgement confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).

Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

COMMISSION OPINION

of 15 November 2005

concerning the modified plan for the disposal of radioactive waste from the Golfech Nuclear Power Station located in France, in accordance with Article 37 of the Euratom Treaty

On 13 April 2005, the European Commission received from the Government of France, in accordance with Article 37 of the Euratom Treaty, General Data relating to the modified plan for the disposal of radioactive waste from the Golfech Nuclear Power Station.

On the basis of these General Data and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance between the plant and the nearest point on the territory of another Member State, in this case Spain, is approximately 150 km.

2.

The planned modification will lead to a general decrease of the gaseous and liquid discharge limits except for liquid tritium, for which an increase is foreseen.

3.

During normal operation, the planned modification will not cause an exposure of the population in another Member State that is significant from the point of view of health.

4.

In the event of unplanned releases of radioactive effluents resulting from an accident of the type and magnitude considered in the General Data, the planned modification to the fuel management system will not give rise to any exposure significant from the point of view of health on the population of another Member State.

In conclusion, the Commission is of the opinion that the implementation of the modified plan for the disposal of radioactive waste in whatever form from the Golfech Nuclear Power Station located in France, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State.

NEW NATIONAL SIDE OF EURO CIRCULATION COINS

Euro circulation coins have legal tender status throughout the euro area. The Commission publishes all new euro coin designs (1) with a view to informing anyone required to handle coins in the course of their work and the public at large. In accordance with the Council conclusions of 8 December 2003 (2), Member States and countries that have concluded a Monetary Agreement with the Community providing for the issuance of euro circulation coins are allowed to issue certain quantities of commemorative euro circulation coins on condition that not more than one new coin design is issued per country per year and that only the EUR 2 denomination is used. These coins have the technical features of normal euro circulation coins, but bear a commemorative design on the obverse national side.

Issuing State: Italian Republic

Subject of commemoration: 1st anniversary of the signing of the European Constitution

Factual description of the design: The inner part of the coin shows a representation of Europa and the bull. Europa holds a pen and the text of the European Constitution. To the upper left of the image is the mintmark ‘R’. The initials of the engraver Maria Carmela Colaneri ‘MCC’ appear at the lower left. The year of mintage appears in the top right of the illustration above the head of the bull. In the lower part of the illustration there is the monogram of the Italian Republic, ‘RI’. The words ‘COSTITUZIONE EUROPEA’ form a quasi-semicircle on the lower part of the outer ring. Twelve stars are depicted on the upper part of the outer ring.

Twelve stars in a quasi-semicircle appear on the upper part of the outer ring. At the top, within the outer ring, the year of mintage (2005) and the mintmark ‘R’ are inserted between the stars. On the lower part of the outer ring the words ‘CITTA' DEL VATICANO’ form a semicircle.

The Hungarian authorities have notified the Commission of their decision to recognise under Article 19 of Council Regulation (EC) No 2200/96 of 28 October 1996 on the common organisation of the market in fruit and vegetables (1), as last amended by Commission Regulation (EC) No 47/2003 (2), the national interbranch association for fruit and vegetables (FruitVeB — Magyar Zöldség-Gyümölcs Szakmaközi Szervezet és Terméktanács).

—   Activities: FruitVeB will carry out all the activities laid down for interbranch organisations in the relevant parts of Regulation (EC) No 2200/96.

Prior notification of a concentration

(Case COMP/M.3910 — Rockwood/Süd-Chemie)

1.

On 8 November 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking Rockwood Specialties Group Inc. (‘Rockwood’, US) controlled by Kohlberg Kravis Roberts & Co. L.P. (‘KKR’, US) acquires within the meaning of Article 3(1)(b) of the Council Regulation control over the rheological additives and carbonless clay business (‘Sold Business’) of the undertaking Süd Chemie AG (‘Süd-Chemie’, Germany) by way of purchase of assets.

2.

The business activities of the undertakings concerned are:

for Rockwood: manufacture of specialty chemicals and advanced materials;

for KKR: private equity fund;

for the Sold Business: manufacture of carbonless developers and rheological additives.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
