Generally the date of cessation of presumption of conformity will be the date of withdrawal (‘dow’), set by the European Standardisation Organisation, but attention of users of these standards is drawn to the fact that in certain exceptional cases this can be otherwise.

Note 3

In case of amendments, the referenced standard is EN CCCCC:YYYY, its previous amendments, if any, and the new, quoted amendment. The superseded standard (column 3) therefore consists of EN CCCCC:YYYY and its previous amendments, if any, but without the new quoted amendment. On the date stated, the superseded standard ceases to give presumption of conformity with the essential requirements of the directive.

Acceptance of the guidelines for the examination of State aid to fisheries and aquaculture (1)

In accordance with Article 26(1) of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 93 of the EC Treaty (2) the Commission announces the following:

Pursuant to point 5.2 of the guidelines for the examination of State aid to fisheries and aquaculture (‘the Guidelines’), Member States were asked to confirm in writing that they accept these proposals for appropriate measures no later than 15 November 2004.

Failure to do so by any Member State would be taken by the Commission to signify acceptance of the proposals, unless that Member State had notified the Commission in writing of their explicit disagreement.

In letters dated 15 November 2004, 20 January 2005 and 14 June 2005, the Finnish authorities indicated that they did not agree to amend two aid schemes in order to bring them in line with the Guidelines. These schemes relate to fishing insurances and transport of fish. They were notified to the Commission by letter of 27 April 1995 on the basis of Article 144(a) of the Treaty of Accession of the Republic of Finland to the European Union, and subsequently were deemed to be ‘existing’ aid within the meaning of Article 93(1) of the EC Treaty.

The Commission has not received any letters to this effect from other Member States.

The Commission must therefore assume that all Member States except Finland for the abovementioned schemes have accepted the proposals and that all their current aid schemes were brought in line with the Guidelines by 1 January 2005.

On 3 November 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Cinven Limited (‘Cinven’, UK) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Frans Bonhomme SAS (‘Frans Bonhomme’, France) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Cinven: financial investment;

for Frans Bonhomme: wholesale of construction materials and sanitary equipment.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

The regions eligible to be granted state aid under Objective 1 (Promoting the development and structural adjustment of regions whose development is lagging behind) are regions in which the per capita gross domestic product at purchasing power parity averaged over the preceding 3 years is less than 75 % of the average for the European Union. Since 1 March 2002 the regions with EC Treaty Article 87(3)(a) status are Western Slovakia (the territory of the Trnava, Nitra and Trenčín districts), Central Slovakia (the territory of the Žilina and Banská Bystrica districts) and Eastern Slovakia (the territory of the Košice and Prešov districts) .

The regions eligible to be granted state aid under Objective 3 (Supporting the adaptation and modernisation of policies and systems of education, training and employment) are regions not covered by Objective 1. In accordance with Article 87(3)(c) of the EC Treaty, these are regions in which the per capita gross domestic product at purchasing power parity averaged over the preceding 3 years is over 75 % of the average for the European Union. Since 1 March 2002 Article 87(3)(c) status is enjoyed by the region demarcated by the territory of the Bratislava district.
