Title: Financing of expenses paid by slaughterhouses and processing plants in relation to the monitoring of TSE among bovine animals, sheep and goats

Objective: Prevention of TSEs. The present aid scheme is a continuation of the State aid scheme N 341/2004, approved by the Commission by letter SG (2004) D/205873 of 15.12.2004 (‘the previous aid scheme’). The previous aid scheme ended on 31.12.2004. The Danish authorities have indicated that the present aid scheme is identical with the previous aid scheme except that TSE tests for bovine and ovine animals for slaughter will be eligible for State aid only if the tests are performed on animals subject to emergency slaughtering or animals aged over 24 months in which signs of an illness are observed in the slaughterhouse before slaughtering. Furthermore, 100 % aid would now be paid for the TSE tests on all goats whereas under the previous aid scheme aid was paid only for random testing.

Prior notification of a concentration

1.

On 13 October 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Gazprom Finance B.V. controlled by Gazprom (‘Gazprom’, Russia) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Siberian Oil Company (‘Sibneft’, Russia) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Gazprom: exploration, production, transportation, refining and marketing of natural gas and petrochemical products;

for Sibneft: exploration of oil and gas, production, refining and marketing of oil and oil products and the sale of certain petrochemical products.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. Observations can be sent to the Commission by fax (No (32-2) 296 43 01 or 296 72 44) or by post, under reference number COMP/M.3999 — Gazprom/Sibneft, to the following address:

On 11 October 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which Canon Europa N.V. (‘Canon’, The Netherlands) a wholly-owned subsidiary of Canon Inc. (Japan), will acquire sole control over Canon España S.A. (‘Canon España’, Spain) by way of share purchase.

2.

The business activities of the undertakings concerned are as follows:

Canon: the manufacture and sale of office, consumer and industrial products;

Canon España: the wholesale distribution in Spain of Canon office and consumer products.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

Non-opposition to a notified concentration

On 27 September 2005, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004.
