Notice of the expiry of certain anti-dumping measures

(2005/C 235/02)

Further to the publication of a notice of impending expiry (1), following which no request for a review was received, the Commission gives notice that the anti-dumping measures mentioned below will shortly expire.

This notice is published in accordance with Article 11(2) of Council Regulation (EC) No 384/96 of 22 December 1995 (2) on protection against dumped imports from countries not members of the European Community.

Prior notification of a concentration

(Case COMP/M.3894 — Unicredito/HVB)

1.

On 13 September 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Unicredito Italiano S.p.A. (‘UCI’, Italy) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Bayerische Hypo-und Vereinsbank AG (‘HVB’, Germany) by way of public bid announced on 12 June 2005.

2.

The business activities of the undertakings concerned are:

for undertaking UCI: retail and corporate banking services, investment banking and asset management,

for undertaking HVB: retail and corporate banking services, investment banking and asset management.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. Observations can be sent to the Commission by fax (No (32-2) 296 43 01 or 296 72 44) or by post, under reference number COMP/M.3894 — Unicredito/HVB, to the following address:

The Commission draws attention to the judgement delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94 — ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

This judgement confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).

Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

Acknowledgment of receipt of complaint No 2005/4483 — plans for the M-30 motorway around Madrid (Spain)

1.

The European Commission has registered under number 2005/4483-SG(05)A/4559 a complaint regarding the Madrid municipality's plans for improving and modifying the old M-30 inner orbital motorway around the city of Madrid (Spain).

2.

In this complaint and in others already received, the complainants allege among other things that the competent Spanish authorities have failed correctly to apply Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment, as amended by Council Directive 97/11/EC of 3 March 1997.

Given the significant number of complaints it has received on this project, the Commission, anxious to respond swiftly and to inform those concerned while making the most economical use of its administrative resources, is publishing this acknowledgment of receipt in the Official Journal of the European Union and on the internet at:

The complaint will be examined by the Commission in the light of the applicable Community legislation. The complainants will be kept informed, through the same channels, of the results of this examination and of any follow-up action that the Commission may decide to take.

The Commission will endeavour to take a decision on the substance of the case (opening of infringement proceedings or closure of the case) within 12 months from the date of registration of the complaint by the Secretariat-General.

6.

Should the Commission need to contact the Spanish authorities, it will do so without mentioning the identity of the complainants in order to protect their rights. The complainants may, however, authorise the Commission to reveal their identity in any contacts with the Spanish authorities.

CALL FOR PROPOSALS — DG EAC 46/05

Promotion of active European citizenship — Support for non-governmental organisations and associations and federations of European interest

(2005/C 235/07)

1.   OBJECTIVES AND DESCRIPTION

This call for proposals supports initiatives by non-governmental organisations (NGOs) and associations and federations of European interest (AFE) participating in European dialogue, where these initiatives focus on specific themes of the programme to promote active European citizenship.

Project proposals should relate to one or more of the following thematic areas, with a view to encouraging reflection and discussion on the consolidation of the European Union, and/or promoting and disseminating its values and objectives:

(a)

promoting and disseminating the values and objectives of the European Union;

(b)

bringing citizens closer to the European Union and its institutions and encouraging them to engage more frequently with its institutions;

(c)

involving citizens closely in reflection and debate on the construction of the European Union;

(d)

stimulating initiatives by the bodies engaged in the promotion of active and participatory citizenship.

Thematic areas

(a)   Non-governmental organisations

(i)

building on the impact of EU policies on the daily lives of citizens, with the aim of raising awareness and improving the understanding and application of these policies in the European Union;

(ii)

promoting the active participation of citizens of those Member States that have recently joined the Union;

(iii)

encouraging the implementation of European projects favouring specifically pluralism, tolerance, respect for diversity, non-discrimination and solidarity, especially towards disadvantaged groups (such as the disabled, the elderly, young people in difficulty), in the context of European integration;

(iv)

encouraging European projects in favour of solidarity and dialogue between the generations, with the active involvement of young people.

(b)   Associations and Federation of European interest

(i)

promoting dialogue and reflection between European citizens concerning the ethical and spiritual values of European integration;

(ii)

developing links between ethics and politics in order to foster the active and direct participation of citizens in civil society;

(iii)

exploring the possibility of developing a European identity which respects and is based on historical and cultural diversity and is oriented towards a common future, with particular attention to the active participation of the citizens of those Member States that have recently joined the Union;

(iv)

involving various ethnic and/or religious groups in Europe in the promotion of mutual understanding, respect and tolerance between these groups, with the direct and active involvement of citizens at local and regional level;

(v)

promoting the active participation of citizens of those Member States that have recently joined the Union.

2.   ELIGIBLE ORGANISATIONS

Proposals may be submitted by non-governmental organisations (NGOs) and associations/federations of European interest (AFE) that have legal personality and are registered in one of the countries referred to below, are independent of public authorities, have the ability and the requisite financial and operational resources to complete the project, and are of known legal and moral integrity.

Applications for funding from NGOs or associations/federations of European interest having a legal status and being established in one of the following countries are eligible:

The 25 Member States of the European Union as of 1 May 2004 (Austria, Belgium, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, the Slovak Republic, Slovenia, Spain, Sweden, the United Kingdom);

The EEA/EFTA countries, in accordance with the conditions laid down in the EEA Agreement;

Romania and Bulgaria, the conditions of whose participation to be laid down in accordance with the European Agreements, their additional protocols and the decisions of the respective Association Councils;

Turkey, the conditions for whose participation to be laid down in accordance with the Framework Agreement between the European Community and the Republic of Turkey on the general principles for the participation of the Republic of Turkey in the Community programmes.

3.   BUDGET AND PROJECT DURATION

(a)   Non-governmental organisations (NGOs)

The total amount of the budget earmarked for cofunding projects submitted by non-governmental organisations is approximately EUR 2,63 million.

All project proposals must include a request for funding of between EUR 35 000 and EUR 70 000.

The contribution from the Commission cannot exceed 60 % of the total eligible project costs.

The maximum grant will be EUR 70 000.

The project must start between 1 May 2006 and 31 October 2006.

The project must end no later than 30 April 2007.

The maximum duration of a project will be 12 months.

(b)   Associations and Federations of European interest (AFEs)

The total amount of the budget earmarked for cofunding projects submitted by associations and federations of European interest is approximately EUR 1,32 million.

All project proposals must include a request for funding of no more than EUR 35 000.

The contribution from the Commission cannot exceed 60 % of the total eligible project costs.

The project must start between 1 May 2006 and 31 October 2006.

The project must end no later than 30 April 2007.

The maximum duration of a project will be 12 months.

4.   DEADLINE FOR APPLICATIONS

The deadline for submission of proposals is 30 November 2005.
