The notified draft directive is intended as a legal basis for all aid schemes exclusively financed by the Land Carinthia. The draft directive replaces all previous legal bases for State aid to agriculture and forestry in Carinthia where such State aid is financed by the Land Carinthia. All measures contained in the draft directive are financed by Carinthia

Title: Aid for the costs of transporting and destroying fallen stock

Objective: According to national law the owners of animal carcasses, parts thereof and animal by-products have to deliver them to the designated rendering plant, and bear the costs of pick-up, transport, storage, processing and rendering. However, § 4 point 2 sentence 1 of the Gesetz zur Ausführung des Tierkörperbeseitigungsgesetzes (AGTierKBG), as amended, provides that the owners of animals must pay 25 % of the disposal costs while the transport costs and the remaining costs of the disposal are paid by the government of Bavaria and the Tierseuchenkasse. Moreover, § 4 point 3 of the AGTierKBG provides that the authorities bear all costs of transport and disposal where there is an obligation to perform BSE/TSE–tests on fallen stock or where the animals have died or been destroyed due to an animal disease. In the latter case compensation is paid only if the disease in question falls under the national law of 1.6.1991, as amended (Verordnung über anzeigepflichtige Tierseuchen). The authorities are required by law to take measures against the diseases enumerated in that law

Aid under agri-environmental commitments: up to EUR 500 for the birth of a Pentro foal. The aid is granted as a single one-off payment one year after the birth of the foal.

On 22 August 2005, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Apax Europe (‘Apax’, Guernsey), belonging to The Hirzell Trust, acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Panrico S.A. (‘Panrico’, Spain) by way of purchase of shares.

The business activities of the undertakings concerned are:

for Apax: private equity investments;

for Panrico: production of food goods, including packaged fresh bread and baked goods.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
