Notice regarding the request submitted by Mongolia in order to benefit from the special incentive arrangements for the protection of labour rights

(2004/C 243/02)

The Commission has received a request from Mongolia under Article 15 of Council Regulation (EC) No 2501/2001 of 10 December 2001 applying a scheme of generalised tariff preferences for the period from 1 January 2002 to 31 December 2004 (1) to benefit from the special incentive arrangements for the protection of labour rights.

These special incentive arrangements offer additional tariff preferences to countries which effectively implement the standards laid down by ILO conventions concerning forced labour, the freedom of association and the right to collective bargaining, non-discrimination in respect of employment and occupation, and the effective abolition of child labour.

The terms and conditions for requests for the special incentive arrangements are laid down in Title III of Regulation (EC) No 2501/2001.

According to Article 15(2) of that Regulation the request shall provide comprehensive information concerning:

the national legislation referred to in Article 14(2), the measures taken to implement it and to monitor its application,

any sectors in which that legislation is not applied.

Mongolia has provided the Commission with information on the above.

NEW NATIONAL SIDE OF EURO CIRCULATION COINS

National side of the new 2-euro commemorative circulation coin issued by Finland

Euro circulation coins have legal tender status throughout the euro area. With a view to informing the parties professionally handling coins and the public at large, the Commission publishes all new euro coin designs (1). In accordance with the relevant Council conclusions of 8 December 2003 (2), Member States are allowed to issue certain quantities of commemorative euro circulation coins under the condition that only one such coin is issued per Member State and per year and that the EUR 2 denomination is used. These coins correspond to the technical features of normal euro circulation coins, but bear a commemorative feature on the obverse national side.

(2)   Commemorative feature: Enlargement of the European Union by ten new Member States

(3)   Factual description of the design: The design describes a stylised pillar from which the sprouts grow upwards. The sprouts represent the enlargement of the European Union. The pillar represents the foundation for growth. Near the pillar there are the letters ‘EU’. In the upper part of the coin there is the year ‘2004’. Twelve stars, together with the year, surround the design.

List of ships that were refused access to Community ports between 1 November 2003 and 31 August 2004, pursuant to Article 7b of Directive 95/21/EC of 19 June 1995 on the port State control of ships (1)

Under Article 7b(1) of Directive 95/21/CE on the port State control of ships, ships which have been detained several times shall be refused access to the ports of the Member States (2).

Article 7b(3) provides that the Commission shall publish every six months the list of ships that have been refused access to Community ports.

The table below gives the list of ships that were refused access to Community ports between 1 November 2003 and 31 August 2004.

‘A Member State shall ensure that a ship in one of the categories of Annex XI, section A, is refused access to its ports, except in the situations described in Article 11(6), if the ship:

 

either:

flies the flag of a State appearing in the black list as published in the annual report of the MOU, and

has been detained more than twice in the course of the preceding 24 months in a port of a State signatory of the MOU;

 

or:

flies the flag of a State described as “very high risk” or “high risk” in the black list as published in the annual report of the MOU, and

has been detained more than once in the course of the preceding 36 months in a port of a State signatory of the MOU.

The refusal of access shall become applicable immediately the ship has been authorised to leave the port where it has been the subject of a second or third detention as appropriate.’

(3)  Ships for which the access refusal order was subsequently lifted in accordance with the procedures described in part B of Annex XI to Directive 95/21/EC.

With a view to informing the parties professionally handling coins and the public at large, the Commission publishes all new euro coin designs (1). In accordance with the relevant Council conclusions of 8 December 2003 (2), Member States are allowed to issue certain quantities of commemorative euro circulation coins under the condition that only one such coin is issued per Member State and per year and that the EUR 2 denomination is used. These coins correspond to the technical features of normal euro circulation coins, but bear a commemorative feature on the obverse national side.

1.   Member State: Luxembourg

2.   Commemorative feature: effigy and monogram of Grand-Duke Henri

3.   Factual description of the design: the coin depicts on the left hand of the inner part the effigy of His Royal Highness, the Grand-Duke Henri, looking to the right, and on the right hand the monogram of the Grand-Duke Henri (special letter ‘H’ topped with a crown). The 12 stars appear in semi-circular form at the right of the monogram. The year 2004, surrounded by the mint mark as well as the engraver's initials, and the word LËTZEBUERG are written in circular form at the top of the ring. The words ‘HENRI — Grand-Duc de Luxembourg’ appear at the bottom of the ring.
