Notice concerning the anti-dumping measures in force in respect of imports into the Community of polyester staple fibres originating, inter alia , in the Republic of Korea: modification of the address of a company subject to an individual anti-dumping duty rate

Imports of polyester staple fibres originating, inter alia, in the Republic of Korea are subject to definitive anti-dumping duties, imposed by Council Regulation (EC) No 2852/2000 (1).

Huvis Corporation, a company located in the Republic of Korea, whose exports to the Community of polyester staple fibres are subject to an individual anti-dumping duty rate of 4,8 % by the aforementioned Regulation, has informed the Commission that it has changed its address to 151-7, Samsung-Dong, Gangnam-Gu, Seoul, Korea. The company has argued that the change of address does not affect the right of the company to benefit from the individual duty rate applied to the company under its previous address of 77-1, Garak-dong, Songpaku, Seoul, Korea.

The Commission has examined the information supplied and concluded that the change of address in no way affects the findings of Council Regulation (EC) No 2852/2000. Therefore, the reference to Huvis Corporation, 77-1, Garak-dong, Songpaku, Seoul, Korea should be read as Huvis Corporation, 151-7, Samsung-Dong, Gangnam-Gu, Seoul, Korea in Article 1 of Council Regulation (EC) No 2852/2000.

The Taric additional code A 151 previously attributed to Huvis Corporation, 77-1, Garak-dong, Songpaku, Seoul, Korea shall apply to Huvis Corporation, 151-7, Samsung-Dong, Gangnam-Gu, Seoul, Korea.

The Commission draws attention to the judgment delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94, ECR I-2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

This judgment confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).

Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

Non-opposition to a notified concentration

On 10 August 2004, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. The full text of the decision is available only in French and will be made public after it is cleared of any business secrets it may contain. It will be available:
