COUNCIL DECISION

of 28 June 2004

appointing a member of the Boards of Appeal of the Office for Harmonization in the Internal Market (Trade Marks and Designs)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (1), and in particular Articles 120 and 131 thereof,

Having regard to the candidatures presented by the Administrative Board of the Office for Harmonization in the Internal Market (Trade Marks and Designs) on 26 April 2004,

HAS DECIDED AS FOLLOWS:

Article 1

Ms Ilse MAYER, born in Gmünd (Austria) on 19 October 1955, is hereby appointed member of the Boards of Appeal of the Office for Harmonization in the Internal Market (Trade Marks and Designs) for a period of five years.

Article 2

The date on which the five-year period referred to in Article 1 will commence shall be determined by the Administrative Board of the Office for Harmonization in the Internal Market (Trade Marks and Designs).

Initiation of proceedings

COUNCIL REGULATION (EEC) No 4064/89

On 29 June 2004, the Commission decided to initiate proceedings in the above-mentioned case after finding that the notified concentration raises serious doubts as to its compatibility with the common market. The initiation of proceedings opens a second phase investigation with regard to the notified concentration. The decision is based on Article 6(1)(c) of Council Regulation (EEC) No 4064/89.

The Commission invites interested third parties to submit their observations on the proposed concentration to the Commission.

In order to be fully taken into account in the procedure, observations should reach the Commission not later than 15 days following the date of this publication. Prior notification of a concentration

Candidate case for simplified procedure

On 28 June 2004, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EEC) No 4064/89 (1), as last amended by Regulation (EC) No 1310/97 (2), by which the United States undertaking United Technologies Corporation (UTC) and the Japanese company Ishikawajima-Harima Heavy industries (IHI) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of a newly created company, constituting a joint venture (JV).

The business activities of the undertakings concerned are:

for UTC: industrial conglomerate with activities including elevators (Otis), HVAC (Carrier), Security products and services (Chubb), commercial and military jet engines (Pratt & Whitney) and flight systems (Hamilton Sundstrand),

for IHI: industrial conglomerate with activities including shipbuilding, logistics, industrial machinery and aero-engines,

for the JV: manufacture and sale of air compressors in the Republic of China.

On preliminary examination, the Commission finds that the notified concentration could fall within the scope of Regulation (EEC) No 4064/89. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations in accordance with Council Regulation (EEC) No 4064/89 (3) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

1.   OBJECTIVES AND DESCRIPTION

This call for applications concerns European cultural cooperation projects and the analysis of information on cultural cooperation. The projects selected must involve some form of experimentation and must relate to at least two of the following objectives:

to increase the mobility of operators in the cultural sector,

to increase the circulation of cultural products and works,

to develop intercultural dialogue.

2.   ELIGIBLE APPLICANTS

This call for applications by cultural operators established in the Member States of the European Union or other countries of the European Economic Area (1).

3.   BUDGET AND PROJECT DURATION

The total budget available for this call for proposals in 2004 is EUR 2 140 000. This means that funding can be provided for approximately five cooperation projects. The maximum rate of Community funding is 70 % of the eligible budget of each project.

This call for proposals concerns activities beginning before 31 December 2004 and ending before 31 December 2006. The projects supported may run for a maximum of two years.

4.   DEADLINE

Applications must be sent to the Commission no later than 15 September 2004.

Culture 2000: Call for Proposals 2005

1.   OBJECTIVES AND DESCRIPTION

The Culture 2000 programme contributes to the promotion of a cultural area common to the European peoples. Each year the Community supports annual and multiannual cultural events and projects carried out in partnership or in the forms of networks. The annual projects must involve cultural operators from at least three States and respectively the multiannual projects must involve cultural operators from at least five States participating in the Culture 2000 programme.

Under Action 1 (annual projects) Culture 2000 programme provides support in the field of music and performing arts, cultural heritage, plastic and visual arts, literature and books and translation.

Under Action 2 (multiannual projects) Culture 2000 programme provides support in the field of music and performing arts, cultural heritage, plastic and visual arts and literature and books.

2.   ELIGIBLE CANDIDATES

Eligible candidates are public and private organisations with legal status, whose main activity lies in the cultural sphere.

These organisations have to be based in one of the following countries participating in the programme:

the 25 Member states of the European Union as of 1 May 2004,

the three EEA/EFTA countries (Iceland, Liechtenstein and Norway),

the candidate countries for whom the necessary arrangements for participation are in place.

3.   BUDGET AND LENGTH OF PROJECTS

The total budget for projects supported under this call for proposals is approximately EUR 28 million (Action 1 and Action 2).

The Funding requested for annual projects must range from EUR 50 000 to EUR 150 000 and may not exceed 50 % of the project's total eligible budget.

For translation projects, Community funding will cover translator(s)' fees for all books within the application (minimum four, maximum 10 eligible books) provided these do not exceed a total of EUR 50 000 or 60 % of the total operation costs.

Funding requested for multiannual projects must be above EUR 50 000 but not more than EUR 300 000 per year and may not exceed 60 % of the total eligible budget.

The projects have to start before 15 November 2005.

The duration of annual projects is not expected to be more than 12 months. The duration of multiannual projects must be 24 months minimum and is not expected to be more than 36 months.

In exceptional circumstances and provided it is duly justified by the beneficiary, selected projects will have the possibility to extend the project duration by a maximum of six months through an amendment procedure.

4.   DEADLINES FOR SUBMISSION OF APPLICATIONS

The deadlines for submission of applications for Community funding are:

15 October 2004 for annual and translation projects

29 October 2004 for multi-annual projects.

Corrigendum to the Call for proposals 2004 — Consumer policy

On page 2, point 3.2, the second paragraph should read:

‘For the period 2004 to 2007 the Commission proposes to give priority to projects involving consumer organisations in the new Member States and eligible candidate countries, and more specifically:’.

On page 2, point 3.2(a) should read:

‘(a)

projects proposed by consumer organisations in the new Member States and in eligible candidate countries aimed at speeding up the effective application of the acquis communautaire on consumer protection in the new Member States and eligible candidate countries, and more particularly in the field of general product safety (cf. subject area “General product safety” in point 4);’.

On page 3, point 4, under ‘General product safety’, the first paragraph should read:

Objective: to help speed up the effective application of the acquis communautaire in the new Member States and eligible candidate countries, and more particularly of Directive 2001/95/EC of the European Parliament and of the Council of 3 December 2001 on general product safety.’

On page 5, point 5, under ‘Award criteria’ and ‘Quality of the application’, the fourth paragraph should read:

‘For projects from consumer organisations in the new Member States and eligible candidate countries aimed at speeding up the effective application of the acquis communautaire in the area of product safety in the new Member States and eligible candidate countries, only the following award criteria need be met:’.

On page 6, point 7, the last paragraph should read:

‘The Commission will publish in the Official Journal of the European Union a list of the beneficiaries and projects funded under this call for proposals, together with an indication of the amount of funding awarded. This list will also be available on the Internet site of the Commission.’
