EFTA SURVEILLANCE AUTHORITY DECISION

of 19 February 2007

concerning the Norwegian national scrapie control programme and additional guarantees regarding intra-Community trade and import to Norway

THE EFTA SURVEILLANCE AUTHORITY,

HAVING REGARD to the Agreement on the European Economic Area (EEA), in particular Article 109 and Protocol 1 thereof,

HAVING REGARD to the Agreement between the EFTA States on the Establishment of a Surveillance Authority and a Court of Justice, in particular Article 5(2)(d) and Protocol 1 thereof,

HAVING REGARD to the Act referred to at Point 7.1.12 of Chapter I of Annex I to the EEA Agreement, Regulation (EC) No 999/2001 of the European Parliament and of the Council of 22 May 2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies as amended and as adapted to the EEA Agreement by Protocol 1 thereto (1),

HAVING REGARD to the Act referred to at point 7.2.27 of Chapter I of Annex I to the EEA Agreement, Commission Regulation (EC) No 546/2006 of 31 March 2006 implementing Regulation (EC) No 999/2001 of the European Parliament and of the Council as regards national scrapie control programmes and additional guarantees and derogating from certain requirements of Decision 2003/100/EC and repealing Regulation (EC) No 1874/2003 (2), as adapted to the EEA Agreement by Protocol 1 thereto,

HAVING REGARD to the EFTA Surveillance Authority Decision No 21/07/COL of 14 February 2007, whereby the competent College Member is instructed to adopt the Decision concerning the Norwegian national scrapie control programme and additional guarantees regarding intra-Community trade and import to Norway if the draft decision is in accordance with the opinion of the EFTA Veterinary Committee (EVC),

WHEREAS Regulation (EC) No 999/2001 provides for the approval of the national scrapie control programmes of EEA EFTA States if they comply with certain criteria laid down in that Regulation,

WHEREAS Regulation (EC) No 546/2006 provides for additional guarantees in intra-Community trade and official movements restrictions relating to holdings of ovine and caprine animals destined for the EEA EFTA States whose national scrapie control programmes have been approved by the EFTA Surveillance Authority,

WHEREAS by letter of 14 February 2006, Norway submitted a national scrapie control programme to the EFTA Surveillance Authority and, on 20 November 2006, following discussions at the package meeting in Oslo, certain amendments to that programme as well as detailed information clarifying the extent of the programme were submitted to the EFTA Surveillance Authority,

WHEREAS the EFTA Surveillance Authority, in close cooperation with the European Commission, has examined the proposed Norwegian national scrapie control programme and this examination shows that the Norwegian programme fulfils the requirement for approval,

WHEREAS it is therefore appropriate to provide for the approval of the national scrapie control programme submitted by Norway in accordance with Regulation (EC) No 999/2001 and Regulation (EC) No 546/2006,

WHEREAS, the measures provided for in this Decision are in accordance with the opinion of the EFTA Veterinary Committee assisting the EFTA Surveillance Authority,

HAS ADOPTED THIS DECISION:

1.

The Norwegian national scrapie control programme and the additional guarantees regarding intra-Community trade and import to Norway submitted on 14 February 2006 and on 20 November 2006 are hereby approved.

2.

Pursuant to Article 109(2) of the EEA Agreement, the EFTA Surveillance Authority shall forward to the European Commission the Norwegian national scrapie control programme and the additional guarantees regarding intra-Community trade and import to Norway and any amendments thereto.

3.

This Decision shall enter into force on 19 February 2007.

4.

This Decision shall be authentic in the English language.
