Notice from the Commission pursuant to paragraph 17 of Article 4 of the Protocol 1 to the Economic Partnership Agreement between the European Union and the SADC EPA States, concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation
Notification of the revised list of materials originating in South Africa and which cannot be imported directly into the EU duty-free quota-free, to which the cumulation provided for under paragraph 2 of Article 4 of the Protocol 1 to the EU-SADC EPA shall not apply

The European Commission publishes the revised list of materials originating in South Africa and which cannot be imported directly into the EU duty-free quota-free, to which the cumulation provided for under paragraph 2 of Article 4 of the Protocol 1 to the EU-SADC EPA shall not apply. The list is based on the 2017 edition of the WCO Harmonized System Nomenclature.
The EU has notified the list to the Secretariat of the Southern African Customs Union and the Ministry of Industry and Trade of Mozambique.
The present notice is published in accordance with paragraph 17 of Article 4 of Protocol 1 to the EU-SADC EPA, and replaces Notice 2018/C 407/06 published on 12 November 2018.

Informative note: measures affecting higher levels of the structure of the code nomenclature (i.e. at the level of 2 (1), 4 (2), 6 (3) or 8 (4) digits), are also applicable to all codes in lower levels of the code structure. For example: Import into the EU of products originating in South African under Harmonized System (HS) Heading 1704 are subject to duties and, therefore, in accordance with Art. 4.15(c) of Protocol 1, they can not be used for cumulation provided for in Art 4.2 of the Protocol 1. This affects all the codes under this heading: 17041010; 17041090; 17049010; 17049030; 17049051; 17049055; 17049061; 17049065; 17049071; 17049075; 17049081; 1704909911; 1704909919; 1704909991 and 1704909999. Import into the EU of products originating in South African under HS Subheading 0201 10 are subject to duties and, therefore, in accordance with Art. 4.15(c) of Protocol 1, they can not be used for cumulation provided for in Art 4.2 of the Protocol 1. This affects all the codes under this HS subheading, which are: 0201100021; 0201100029; 0201100092; 0201100094; 0201100097 and 0201100098. |
