A4-0059/99 Proposal for a Council Directive amending Directive 95/18/EC on the licensing of railway undertakings COM(98)0480 - C4-0562/98 - 98/0266 (SYN)) The proposal was approved with the following amendments. (Amendment 1) ARTICLE 1(3a) (new) Article 8(3), 2nd subparagraph (new) (Directive 95/18/EC) >Original text> >Text following EP vote> 3a. In Article 8 the following subparagraph is added to paragraph 3: 'This may only be on a non-discriminatory basis.' (Amendment 2) ARTICLE 1(3b) (new) Article 9 (Directive 95/18/EC) >Original text> >Text following EP vote> 3b. Article 9 is replaced by the following: 'Article 9 A railway undertaking shall be adequately insured or make equivalent arrangements for cover, in accordance with national and international law, of its liabilities in the event of accidents, in particular in respect of passengers, luggage, freight, mail and third parties. For freight services, this may only be permitted where the charges reflect willingness to pay more than costs imposed and where regulatory bodies have safeguards in place to ensure charges are not excessive.' Legislative resolution embodying Parliament's opinion on the proposal for a Council Directive amending Directive 95/18/EC on the licensing of railway undertakings COM(98)0480 - C4-0562/98 - 98/0266 (SYN))(Cooperation procedure: first reading) The European Parliament, - having regard to the Commission proposal to the Council COM(98)0480 - 98/0266(SYN) ((OJ C 321, 20.10.1998, p. 8.)), - having been consulted by the Council pursuant to Article 189c and Article 75 of the EC Treaty (C4-0562/98) - having regard to Rule 58 of its Rules of Procedure, - having regard to the report of the Committee on Transport and Tourism and the opinion of the Committee on Economic and Monetary Affairs and Industrial Policy (A4-0059/99), 1. Approves the Commission proposal, subject to Parliament's amendments; 2. Calls on the Council to incorporate Parliament's amendments in the common position that it adopts in accordance with Article 189c(a) of the EC Treaty; 3. Should the Council intend to depart from the text approved by Parliament, calls on the Council to notify Parliament and for the conciliation procedure to be initiated; 4. Instructs its President to forward this opinion to the Council and Commission.
