DECISION OF THE EEA JOINT COMMITTEE

amending Annex VII (Recognition of professional qualifications) to the EEA Agreement [2020/321]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Decision (EU) 2016/790 of 13 January 2016 amending Annex V to Directive 2005/36/EC of the European Parliament and of the Council as regards the evidence of formal qualifications and the titles of training courses (1) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Decision (EU) 2017/2113 of 11 September 2017 amending Annex V to Directive 2005/36/EC of the European Parliament and of the Council as regards evidence of formal qualifications and the titles of training courses (2) is to be incorporated into the EEA Agreement.

The EFTA States have notified the EFTA Surveillance Authority of updates to legislative, regulatory and administrative provisions with regard to the issuing of evidence of formal qualifications in the fields covered by Chapter III of Directive 2005/36/EC (doctor of medicine, specialised doctor of medicine, nurse responsible for general care, dental practitioner, pharmacist and architect). In accordance with Article 21(7) of Directive 2005/36/EC of the European Parliament and of the Council (3), as incorporated into Annex VII to the EEA Agreement, the EFTA Surveillance Authority has published Communications on 19 June 2014 (4), 13 May 2015 (5), 11 May 2017 (6) and 14 March 2019 (7) indicating such notified changes. For reasons of clarity and legal certainty, these updates should be reflected in the relevant adaptations to Directive 2005/36/EC contained in Annex VII to the EEA Agreement.

The list of titles of training courses in specialised medicine contained in point 5.1.3 of Annex V to Directive 2005/36/EC refers to basic medical training in maxillo-facial surgery and specialist training in biological haematology, stomatology and dermatology. This list should therefore be adapted to reflect the titles of the relevant training courses in the EFTA States.

Annex VII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

In point 1 (Directive 2005/36/EC of the European Parliament and of the Council) of Annex VII to the EEA Agreement:

Article 2

The texts of Delegated Decisions (EU) 2016/790 and (EU) 2017/2113 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 14 December 2019, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
