DECISION OF THE EEA JOINT COMMITTEE
No 70/2017

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2019/182]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Implementing Decision (EU) 2016/1840 of 14 October 2016 amending Annex IV to Council Directive 2009/156/EC as regards methods for African horse sickness diagnosis (1) is to be incorporated into the EEA Agreement. |

(2) |
Commission Implementing Decision (EU) 2017/9 of 4 January 2017 authorising certain laboratories in Morocco and Taiwan to carry out serological tests to monitor the effectiveness of rabies vaccines in dogs, cats and ferrets (2) is to be incorporated into the EEA Agreement. |

(3) |
This Decision concerns legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland. |

(4) |
This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. |

Annex I to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Chapter I of Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 3 (Council Directive 2009/156/EC) in Part 4.1: ‘as amended by:

The following indent is added in point 2 (Council Directive 2009/156/EC) in Part 8.1:

The following point is inserted after point 102 (Commission Implementing Decision (EU) 2016/1235) in Part 4.2:

Article 2
The texts of Implementing Decisions (EU) 2016/1840 and (EU) 2017/9 in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 6 May 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
