1. Resumption of the session
The sitting opened at 17.00.
2. Approval of the minutes of the previous sitting
The minutes of the previous sitting were approved.
Sean Kelly had been present at the sittings of 22 November 2010 and 1 February 2012, although his name was not on the attendance register.
The President recalled that José Manuel Barroso (President of the Commission) would present his declaration on the state of the Union (point 36 of the FDA) on Wednesday, 12 September 2012.
3. Tribute
On behalf of Parliament, the President paid tribute to the memory of Jiří Havel MEP, former MEPs Edith Mastenbroek, Alexander Falconer and Patrick Lane, and Oswaldo Payá, winner of the Sakharov Prize in 2002.
Parliament observed a minute's silence.
4. Statement by the President
The President made a statement on the continuing violations of human rights, democracy and the rule of law in Belarus and called on the President, Alexander Lukashenko, immediately to set free, without condition, all political prisoners and ensure that the forthcoming parliamentary elections would be fair and would conform to international standards.
The President announced that he had sent a letter to the President of the Republic of the Gambia after the state execution of nine people in that country. He called on the government to put an end to executions and to reintroduce the moratorium on the death penalty.
The President congratulated Stavros Lambrinidis, former MEP and Vice-President of Parliament, on his appointment to the post of EU Special Representative for Human Rights.
5. Composition of Parliament
The Cyprus authorities had given notice of the election of Sophocles Sophocleous to replace Kyriakos Mavronikolas as Member of Parliament with effect from 1 September 2012.
Under Rule 3(2), until such time as his credentials had been verified or a ruling had been given on any dispute, and provided that he had previously made a written declaration stating that he did not hold any office incompatible with that of Member of the European Parliament, Sophocles Sophocleous would take his seat in Parliament and on its bodies and would enjoy all the rights attaching thereto.
6. Verification of credentials
On a proposal from the JURI Committee, Parliament validated the mandates of MEPs Erik Bánki with effect from 1 June 2012 and Martina Anderson with effect from 12 June 2012.
7. Request for the waiver of parliamentary immunity
The Polish authorities had forwarded a request to waive the parliamentary immunity of Małgorzata Handzlik.
The Austrian authorities had forwarded a request to waive the parliamentary immunity of Ewald Stadler.
Under Rule 6(2), the request had been referred to the committee responsible, the JURI Committee.
8. Request for the defence of parliamentary immunity
Gabriele Albertini had written to the President requesting that his parliamentary immunity be upheld.
Under Rule 6(3), the request had been referred to the committee responsible, the JURI Committee.
9. Composition of committees and delegations

11. Corrigendum (Rule 216)
The committee responsible had forwarded the following corrigendum to a text adopted by Parliament:

12. Delegated acts and implementing measures (Rule 87a(6) and Rule 88(4)(d))
In accordance with Rule 87a(6), the President of the Conference of Committee Chairs had informed the President of Parliament that no objections had been raised with regard to:

a recommandation from the TRAN Committee to raise no objections to draft implementing provisions falling within the regulatory procedure with scrutiny ‧Recommendation for a decision to raise no objections to the draft Commission decision authorising the French Republic to derogate from Commission Regulation (EU) No 1332/2011 with respect to the use of a new software version of the airborne collision avoidance system (ACAS II) on certain newly-built aircraft (B7-0423/2012)‧. |
2) |
a recommandation from the AGRI Committee to raise no objections to a delegated act: ‧Recommendation for a decision to raise no objections to the Commission Delegated Regulation of 28 June 2012 supplementing Council Regulation (EC) No 1234/2007 as regards transnational cooperation and contractual negotiations of producer organisations in the milk and milk products sectors (B7-0424/2012)‧. |
If no objections were raised to these recommendations by a political group or at least 40 Members within 24 hours, they would be deemed to have been approved. Otherwise, they would be put to the vote.

17. Transfers of appropriations

The Committee on Budgets had authorised the Commission's proposal for transfer of appropriations DEC 14/2012 (N7-0073/2012 - C7-0152/2012 - 2012/2122(GBD)) in accordance with Article 24(4) of the Financial Regulation as interpreted in point 20 of the joint declaration on transitional measures applicable to the budgetary procedure after the entry into force of the Lisbon Treaty.
